RE: Variance Request for Schrader Oil Scout Station (320 N. College)
The following is a variance request for Schrader Oil Scout Station for the allowed driveway
width for a commercial access. Per Detail D-15 of the Design and Construction Criteria,
Standards and Specifications for Streets, Sidewalks, Alleys and Other Public Ways the maximum
driveway width for a business is 35 feet. The Schrader Oil Scout Station is requesting that the
eastern access drive on Willow be allowed to be 45 feet in width.
Per the attached exhibits the applicant has shown the wheel paths for the trucks that will access
the site through this driveway for the gas station use and the adjacent bulk fueling facility. The
bulk fueling facility has no other access points off of Willow at this time.
Mx recommendation for this variance is for annroval. I feel that the applicant is providing
significant improvements along Willow Street and that a drive cut of 45 feet at this location
would be acceptable. It could possibly be narrowed and still meet there needs, but currently
Willow street has no curb and gutter and is one giant curb cut for this property. Defining curb
cuts and providing sidewalk along this portion of the road is a definite improvement to this area.

We would like to request a variance to the City Street standards for the northeast drive approach onto Willow
Street from the Schrader Oil Convenience Store. This variance would grant a 45'-0" wide approach in lieu of
the 35'-0" wide standard.
Our justifications for the granting of this variance are as follows.
• Both this project and the bulk fueling facility to the east share this approach. It is the only
access from the bulk fueling facility to Willow Street.
• A 45'-0" approach will mitigate the encroachment of fuel transport trucks into the westbound
lane of Willow Street (See Attached Exhibit). With a standard 35'-0" wide approach, fuel
transport trucks leaving the bulk fueling facility to the east of this project and turning east onto
Willow Street will be turning into the on -coming traffic lane.
• A 45'-0" approach will allow fuel transport trucks traveling west on Willow Street to enter the
bulk fireling facility without having to make a partial turn and backing up into Willow Street
in order to complete the turn.
• A 45'-.0" approach will allow business customers with large trucks and long trailers to gain
access to the north dispenser islands, exit the site, and travel west on Willow Street safely.

Re: Schrader Site- College and Willow
Dear Cam:
This letter is to follow up requests from Sheri Wamhoff, as well as our phone conversation
ofJune7,1999. With this letter I am forwarding three legal descriptions which I received from King
Surveyors showing casements which were requested by the City for parking, sewer and water service
in conjunction with development requests made by Schraders and related to the station located on
the southeast comer of College and Willow, I have also enclosed a proposed Deed of Dedication
for Easement related to the water line.
The exhibit showing the parking casement depicts both the station site (westerly tract) and
the bulls plant site (easterly tract), immediately to the south and east, of the two tracts are properties
owned by the Union Pacific Railway, Intervening property immediately to the south and adjacent
to the southern lot line of the station tract is owned by the Burlington Northern Railway. The
Burlington rdlwa;y line was removed and the now line was installed immediately to the cast of the
bulk plant station.
'rho City agreed to convey to Schraders the Burlington Northern right-of-way in return for
Schraders' conveyance ofthenew easterly right-of-way. 'thus far, this conveyance has not occurred.
Unfortunately, the; sewer line easement is located over this southerly tract which is to be acquired
from Burlington. Schraders can convey an easement using a bargain and sale type deed, which
would pass title at. such time as Schraders acquired the property. I spoke with Carrie Daggett in the
City Attorney'-, oflice regarding this situation, and it was my understanding that she would he
comfortable with a conveyance of this type.
The City also requested the parlcinl,/construction/access casement. In discussions with Sheri,
she indicated that this was to ensure that the bulk plant site received access over the station site,
Previously, access to the bulk plant was from the cast, and this access was cut off when the now
railroad line was constructed. As a result. Schraders have accessed the bulk plant site over the
station property. (Sheri indicated that the station and bulk plant are in common ownership. She was
concerned that if this but k plant was ultimately conveyed, there would be insufficient access for gas

transport trucks unless an easement was granted over the station property. She therefororequested
a private cascnient. Asa legal matter, an casement granted by an owncrto himself is a nullity, The
only effect of the easement would be to create a cloud on Schraders'title. I spoke with Paul Eckman
about my analysis and it was my impression that he agreed that the proposed deed would be of no
effect. obviously it is in Mr. Schrader's best interest, if he should ever sever title to the bulk plant
and station, to retain an easement. However, until such time as the title is conveyed, he does not
havo the ability to convey an easem=t to himself
If the City would like me to prepare an easement for the sewer line along the same form as
the water line casement. I would be happy to do so. Alternatively, if an easement needs to be granted
tiller the City conveys the railroad property to Schraders. I would be happy to prepare an easement
at lhat_juncture.
Tf you could advise of the necessity of the parsing and sewer easement and confirm whether
the water easement is in acceptable form, it would be appreciated.
