OF THE PLANNING AND ZONING BOARD
OF THE CITY OF FORT COLLINS
VACATING A PORTION OF AN ACCESS AND UTILITY EASEMENT
DEDICATED WITH TRACT B OF THE 7-ELEVEN CONVENIENCE STORE P.U.D.
WHEREAS, Section 2-353 (4) of the Code of the City of Fort
Collins authorizes the Planning and Zoning Board to vacate certain
rights -of -way, by resolution or by approval of replats containing
notation of such vacation; and
WHEREAS, the Owner of the Rosetree Village P.U.D. has
requested that the City vacate a portion of the utility and
drainage easement dedicated on Tract B of the 7-Eleven Convenience
Store P.U.D. and now a part of the Rosetree Village P.U.D. and more
particularly described below; and
WHEREAS, the vacation request has been reviewed and approved
by the pertinent City and private utilities, and they report no
objections.
NOW, THEREFORE, be it resolved by the Planning and Zoning
Board of the City of Fort Collins, that a portion of the utility
and drainage easement dedicated on Tract B of the 7-Eleven
Convenience Store P.U.D., more particularly described as follows to
wit:
Commencing at the Southwest corner of said Section 26;
thence N 89' 42' 44" E 603.00 feet; thence N 00° 171 16"
W 178.47 feet to the TRUE POINT OF BEGINNING; thence
16.29 feet along the arc of a curve to the right having
a radius of 41.82 feet, a central angle of 22° 19' 2611,
and a long -chord which bears N 62° 26' 59" W 16.19 feet;
thence N 51° 17' 16" W 22.02 feet; thence N 38° 42' 44"
E 4.50 feet; thence N 86° 30' 15" E 36.00 feet; thence S
44° 38' 13" W 10.40 feet; thence S 00° 17' 16" E 19.57
feet to the POINT OF BEGINNING.
be and is hereby vacated.
