801 South Shields Street
The developer is requesting a variance from two provisions of our Street Standards: 'Fable 5 and
Figure D-10, Applying these standards to the existing driveway entrance and diagonal parking
area on the cast side of the site reveals conflicts between the standards and the existing situation.
As we discussed with Mark Sears_ this situation was produced by the City project which widened
Shields Street several Nears ago. It is likely. however, that the standards for setback of the
parking spaces and entry drive were not met prior to the City project either, but it is recognized
that the widening project produced a greater degree of non-conformance.
I agree with you that, ideally, we would have the developer remove this east entry altogether. It
seems likely that unsafe conditions may be created, especially if westbound traffic on Plum
Street tries to turn left into this east drive entry. As close as it is to Shields Street, there is a
likelihood of backing traffic into the intersection. Also, a high volume of pedestrian and bicycle
traffic along Plum Street probably complicates the problem for motorists wishing to use this east
entry.
However, it appears that the change of use for this property will not increase (and may even
decrease) the intensity and traffic impacts of this site. Given that the City participated in
designing and building the situation that exists, and given the fact that other agreements
concerning access were made with this property owner as well as the owner to the south, it is my
judgment that it would be unreasonable to require the closure of this east entry at this time. "fhe
safety hazard is not that great, and the redevelopment of the site is primarily an interior
renovation of the existing facilit}
In order to mitigate the safety problem, I would ask that you work with the owner/developer to
improve the west entry and parking lot, and to accentuate it thru signage and curb cut
improvements_ so that the west entry becomes the primary access to this property. The narrow
allev along the south edge of the property can also be improved to provide a
circulation/connectivity opportunity. Also. you and the developer should work with Eric Bracke
to try to eliminate or minimize left turns into the east entry. That east entry should become a
single movement., right -in only situation, if at all possible.

I recently received a variance request to our street standar s from RBB Architects, Inc.
Rebecca Spears is requesting a variance to allow en existing curb -cut on Plum Street at the -
intersection of Plum Street and South Shields Street. Originally the engineering department _
denied their proposed access because of it's close proximity to the abovementioned
intersection. This item was brought to the attention of staff at a Transportation Coordination '
meeting, and staff agreed that the access should be closed.
After reviewing their formal variance request, I am still uncomfortable allowing this access to
be used. I have enclosed a drawing, which was submitted by Rebecca, showing the
location of the proposed access and its relation to the intersection. It also occurred to me
that the parking stalls are too close to Plum Street as indicated on Table 5 of the streets'
standards manual. I feel that the City should still deny this variance request.
Please find enclosed an original copy of the variance request letter and drawing showing the \
proposed site for your review. Your review and comments regarding this issue would be
appreciated as soon as possible to not hinder the progress of this development.

Dear Mr Blandford,
I am writing in regard to the property at 801 South Shields Street. My client, Turning Point Center for Youth and
Family Development. currently has the property under contract and is considering using the existing building for a
residential treatment facility and administrative offices. This is being considered a minor amendment by the
current planning department.
The engineering department has stated that the existing entrance from Plum Street to the parking area in front of
the building may not be used as it is too close to the intersection at Plum Street and South Shields Street. I would
like you to bring a recommendation of variance on this standard to the city engineer so that the parking area may
continue to be used.
As you may know, the city designed and constructed the improvements in front of the building as part of the
project to widen Shields Street five years ago. This was done in exchange for the additional right-of-way required.
Due to the location of the building on the lot, it is not possible to use this parking area except as currently accessed
from Plum Street. Cars can not physically enter from the south, park, and then back out, turn around and exit to
the south.
Since this is a minor amendment and involves an existing condition and we are not proposing to further deviate
from the standards of the Land Use Code, we are asking you to recommend consideration of this variance. Please
contact me with your response as soon as possible as this greatly impacts the use of this site.

SUBJECT: VARIANCE REQUEST FOR TURNING POINT: 801 SOUTH SHIELDS STREET
Dear Miss Spears:
This letter is to inform you that Cam McNair, the City Engineer for the City of Fort Collins, has granted you
a variance to the City's Street Standards. The variance is granted with the condition that the
Owner/Developer work with the Development Review Engineering Department to "improve the west entry
and parking lot, and to accentuate it through signage and curb cut improvements, so that the west entry
becomes the primary access to this property." He also encourages the Owner/Developer to work with the
Development Review Engineering Department and Eric Bracke, the City's Traffic Engineer, to try to
eliminate or minimize left turns into the east entry. The east entry should become a single movement,
right -in situation, if possible. It is of the opinion of Mr. McNair that the justification presented by your firm
does support the need of the variance. The variance is for the reduced distance of the east access from
an intersection.
