HomeMy WebLinkAboutPROSPECT PARK PUD - Filed GC-GENERAL CORRESPONDENCE - 2005-06-10Transpo ion Services Engineering Department City of Fort Collins September 29, 1997 Mr. Scott Schafer Colorado Structures Inc. 4720 Forge Road Suite 106 Colorado Springs, Colorado 80907 RE: Prospect Park P.U.D. - Replacement of the Shields Street Median Dear Mr. Shafer As per our phone conversation on September 29, 1997 and several previous conversations, the City of Fort Collins is requiring the concrete median cover constructed with your project on Shields Street be removed and replaced. The replacement of the median cover is due to poor quality workmanship. The surface of the median cover was finished improperly resulting in a deviation of the top surface of up to 1 1/2". The following sections of the City of Fort Collins Design and Construction Criteria, Standards and Specifications are the basis for requiring the replacement . Section 3.10.02 States "The maximum deviation of the top surface shall not exceed one-fourth (1/4) inch in ten feet". Section 3.12 "DEFECTIVE WORKMANSHIP AND MATERIALS" pertains to work performed in the Public Right -of -Way and states "The Contractor shall guarantee his portions of street construction for a period of one year after acceptance against defective workmanship and materials. The determination of the necessity, during such guarantee period, for the Contractor to repair said street, or any portion thereof, shall rest entirely with the Engineer, whose decision upon the matter shall be final and binding upon the Contractor." As you are aware we are holding $35,796.00 in escrow for the completion of this work. We are requesting that you complete the above mentioned work within 30 days of today unless otherwise approved by the City of Fort Collins. If the above mentioned work is not completed within the next 30 days the City will initiate processes to have the work completed by a third party at your expense. In addition, the City will perform the striping on Prospect at no cost to your project. It is my understanding that all other costs associated with this work will be your responsibility. As we discussed, please be sure that all work within the public right-of-way is done in compliance with the City's standards, to include insuring that the all paving on this drive approach within the right-of-way is done in concrete. It is also important that this change be captured on as -built drawings of this site. Once the work is completed and approved, I would ask that you send an invoice for the $5,000.00 to my attention at the City's Engineering Department.
