South Glen PUD Fourth Filing

The final plan revisions for South Glen have been to Steve Oft on Tuesday, May 24, for review.
In order to help expedite the development agreement these are the issues in addition to the
standard agreement that I believe need addressing
I The agreement will be executed with BLS Development LLC, Vicki Wagner General
Manager a Colorado Limited Liability Co. I havea copy of our Articles of
Incorporation..
2 The second item has to do with the emergency fire access. I would propose that we add
language to the agreement that building permits will not be issued on lots 1 1 - 18 until the
Fincrgency lire access is completed.
3_ Pedestrian and drainage access between lots 9 and 10. The City wants to have the option to
use this as a public access in the event that the city creates a bike -way through this area
across the New Mercer Canal and the railroad tracks. As I have stated before I do not have
a problem with this, although I do not feel that it is fair to the home owners of these Tots or
the I IOA that there is an open ended agreement_ 1 believe that it needs to have a time frame
in which the trail would be completed. I would propose that if the city has not made this a
Part of there bike system within 5 years form the completion of South Glen with plans to
complete the crossings over the railroad tracks within 8 years, then the city world no
longer have the option to use this as a public access across the canal and railroad tracks
4. The other area of concern to the city was the homes on lots 1 - 1 1 having basements. With
high ground water in this area the basements would have to be specially engineered and
designed to make sure that the basements did not flood and that the ground water was
carried away from the buildings and into the drainage ponds. With the drainage system
directly behind these lots I believe that foundations can be designed to accommodate the
water problems. We will probably need in our agreement that should there be basements on
the lots they must be designed and approved by a qualified foundation engineering specialist
I believe that it is the builders intent to offer basements as an option for the homes on these
lots with the understanding that it may not be possible to have basements.
Presently our construiction schedule is to begin staking the first week of June and proceed ahead
with the dirt work_ It would be my hope that we could have the development agreement
completed or substantially complete by the week ofJune 13 so that we could begin construction
ofthe sewer and storm sewer. We would begin construction of the water line approx. June 29
Will] the curb, gutter and street improvements to follow.
In reading through a copy of a Development Agreement these were the only items that I was
aware of that needed to be addressed in addition to the standard things. With the delay in
Steward Finginecring completing the plans and reports it has crowed my schedule a lot. I realize
that this is not your problem and that you are also very busy, if however there is any thing that I
can do to help expedite this process please let me know.
