Enclosed you will find one blue line copy of final Zeigler Access plans for CDOT, one
copy of Matthew Delich's Traffic Impact Study, and one signed copy of CDOTs's ROW
Access Permit Application. This is one complete package of what will be given to Tess at
our next meeting on February 1, at 1:15 pm. It is my understanding the final permit
application for CDOT also requires the signature of the City Engineer. if possible I would
like to get a copy of the application with all signatures prior to our meeting with Tess, but I
understand that the timing is short. Please feel free to contact me, should you have any
questions, or i f there is anything else I can do for you in this matter.

Application for Vacation of Easement for Hilton Hotel Site

Dear Katie:
Attached you will find an Application Form for Vacation of a portion of an easement for the
proposed Hilton Hotel site located as noted above. The purpose of this letter is to provide you
with the justification for the proposed easement vacation. We have also attached a legal
description for the casement vacation and exhibit showing the location of the easement
vacation.
It is our understanding that the utility, drainage and public access easement shown on the plat
does not allow for an entrance canopy from the proposed Hilton Hotel to encroach into this
casement. Given this City requirement, we are requesting that a small portion of the
easement be vacated to accommodate the entrance canopy.
If you should have any questions or comments, please contact me at 491-9888. Thank you for
your assistance in addressing this matter.

Dear Mr. Stringer:

Enclosed you will find four copies of the site utilities plan for the above referenced project
indicating a proposed minor change. As we discussed, our client would like to phase the
public improvements. We did not want to proceed with construction knowing that we
intended to request this change and are unsure of how to address this item with respect to
the plans and Development Construction Permit.
The proposed change in phasing is minor and the only public improvement affected is the
storm drainage inlets, piping and flared end section east of Lot 2 as indicated by the cloud
on the attached sketch. The value of this proposed Phase 2 improvement is approximately
$22,000, as indicated on the attached bid provided by Schmidt Earth Builders.
Our request is that we would like to proceed with the construction as soon as possible
(hopefully within the next few weeks) and then follow-up with the proposed change that
would allow deferring construction of the indicated storm drain piping. The purpose of this
request is to allow the hotel to begin construction of foundations before colder weather.
After you review this information, please call or e-mail your thoughts on this request. I
would very much appreciate a call or e-mail from you on this matter by Friday,
November 3"1.

RE: Harmony Road Design
The intent of this letter is to address the possible improvements to Harmony and Timberline
Roads, and the intersection of these streets, related to the timing of processing development
proposals impacting these roads. At a meeting on July 14, 1998, among the City Engineering
Department and consultants associated with the proposed development sites along Harmony road,
it wL; t etecmined that: the City would take the lead on determining the location of centerline along
Harmony Road
Since that meeting, City staff has been attempting to gather the information from various
consultants. Our staff is still in the process of piecing this information together to determine the
daurn line. However„ due to various constraints, it has been difficult to collect the data and the
centerline bits not been precisely defined at present.'
Because the review of development proposals includes the determination of the associated
roadway improvements, the point must be clear that all proposals in the process at this time, or
anticipating submittal, are proceeding with some risk. The determination of the centerline of
Harriony Road could impact the ultimate location of buildings, setbacks, and landscaping.
Development proposals already in the process will continue to be reviewed, but, again once the
datum line is determined, additional comments affecting the site layout may be forthcoming.
