Dear Katie:
The purpose of this letter is to provide you with the justification for the proposed easement vacation as shown
on the attached legal description exhibit as required in step one of this application process.
The 90.15-foot wide access and utility easement shown on the recorded plat of Preston Center at Wild Wood
Business Park, First Filing includes a 10-foot by 10-foot area within Lot 2. This 10-foot by 10-foot area was
provided in the First Filing to accommodate utility services. A 1-foot by 10-foot area along the westerly line of
this 10-foot by 10-foot area is being vacated because the proposed build footprint encroaches into this area.

I would like to hear any feedback you may have regarding a retaining
wall encroachment in a utility easement. The issue is on Hilton Garden
Inn at Preston Center, a project that we are currently reviewing. It is
located at the south corner of Timberwood Dr. and Gifford Ct. The
easement in question is the grayed 9' utility easement just behind the
sidewalk on the north side of Timberwood Dr. (Please refer to the
attached figure).
It is my understanding that Tricia Kroetch with Northstar will be
coordinating with the Qwest folks regarding your existing telephone
line, but I would like to know if any other utilities will be using the
easement, and if the proposed design would be acceptable to you. If I
do not hear back Friday, May 12th, I will assume that there are no
comments.

Light & Power's plans are to cross perpendicularly through the easement just
on the east side of the driveway, extending to the transformer location shown.
We have no plans to install electric facilities in the easement other than
that.

Xcel Energy has no current plans to utilize the 9' easement along the south
edge of Blk 1 lot 2. We have a separate easement between blk 1 lot 1 and blk 1

The proposed building location for Lot 4 as shown on the revised Minor Amendment for this lot encroaches on
the 41.85-foot wide access and utility easement shown on the recorded plat of Preston Center at Wild Wood
Business Park, First Filing. This encroachment necessitates the vacation of a portion the access and utility
easement.

In our meeting of October 19, 2000, we observed that the above referenced access permit
will soon expired. The purpose of this letter is to request that a time extension be granted
for this permit as allowed in Paragraph I, Permit Expiration. In accordance with
Paragraph 1, this permit will expire on October 27, 2000, the permit issue date.
The anticipated construction date for this permit is April, 2001

SUBJECT: HARMONY ROAD BIKE LANE STRIPING
Dear Robert:
This letter concerns the striping of the bike lanes along Harmony Road adjacent to the Preston
Center, First Filing and Preston Center, Third Filing ("Preston Center') projects. As you know, it
is the City's policy to construct and stripe bike lanes on certain streets within the City in
accordance with our street standards and the standards set forth by the City's Transportation
Planning Department. Harmony Road, although categorized as State Highway 68, is also
classified under the City's standards as a major arterial street. Because of this, the City is
requiring the Developer of the Preston Center to construct the necessary bike lanes required.
After a series of meetings and negotiations among you, your clients and City staff, it was
determined that Harmony Road would be striped as indicated on the approved Utility Plans for
the Preston Center. Because you have expressed concerns about the safety of the approved
striping plan, I want to assure you that the City of Fort Collins accepts the responsibility and
holds you and JR Engineering harmless of any wrong doing or professional negligence in the
design of the proposed bike lanes.
I hope this addresses your concerns regarding the striping of the bike lanes on Harmony Road.

Re: The Development Construction Permit for the Harmony Road Improvements
Dear Mr. Whitaker,
Please find enclosed an application for the Development Construction Permit ("DCP") associated
with the Preston Center, 151 Filing project. This DCP pertains to the construction of the Harmony
Road Improvements between Corbett Drive and Ziegler Road. The application should be completed
in its entirety and returned to the City of Fort Collins Development Review Engineering Department
at your convenience:.
For your information, the DCP cannot be issued until the A -line issues have been resolved, the State
Highway Access Permits have been approved and the Notice -To -Proceed has been issued by the
State. Currently the! A -Line amendment is scheduled for 2nd reading on August 15, 2000 and the
State Highway Access Permits have been completed and approved by the State pending the
approval of the A -Line amendment. Hence, I feel we can still hold the DCP meeting, since the plans
have been approved, but the City would not issue the DCP until the above conditions have been
met.

Re: Timberwood Drive variance request
Dear Miss Kroetch:
Thank you for submitting the variance request for Timberwood Drive at the Preston Center.
The current street standards state that whenever a residential or collector street intersects
another street, a tangent length shall be provided for safe sight distance and safe traffic
operation. Since Timberwood is a collector street, the standards state that the minimum
tangent length at the intersection of two streets shall be a minimum of 150 feet. However,
after reviewing the traffic study and analyzing the sight distance, the City of Fort Collins'
Engineering Department feels that the intersection of Timberwood Drive and Corbett Drive will
operate safely and therefore will grant your request to vary the tangent length.

Mr. Stringer:
On behalf of LGT Real Estate Advisors, we are requesting a variance in the Preston Center
Development. The variance from City design criteria is related to the tangent length of
Timberwood Drive approaching the intersection with Corbett Drive. The minimum allowable
tangent length stated in the City of Fort Collins Design and Construction Criteria is 150' and we
are proposing a tangent length of approximately 25'. The layout that is currently shown was
approved with the Preliminary P.U.D. (which provides approval of layout and density) and the
property to the south of Timberwood was sold based on this preliminary approval. Requiring a
revision to the layout at this point in the process would create a hardship for both owners of the
adjacent properties and require considerable revisions to the site plan that was approved with the
Preliminary P.U.D.
