Dear Mr. Flynn:
This letter is in response to our telephone conversations and the letter that was received from you,
dated September 10, 1996. In those correspondences you asked if the City has any plans to
obtain right-of-way on Horsetooth Road and/or Manhattan Avenue adjacent to the Park South
Commercial Plaza Minor Subdivision.
The City has no plans, at this time, to obtain title to any part of the Park South Commercial Plaza
Minor Subdivision for right-of-way by eminent domain or condemnation proceedings. At the time
lots 2 and 3 are developed and come through the City review process the parcels will be looked at
with the uses proposed to determine if additional ROW is needed for road widening, right -turn
lanes or other such improvements that may be necessary.

Dear Ms. Wamhoff:
This letter is intended to confirm our telephone conversation
of this date.
I represent the owner of the land upon which the above -
referenced movie theatre is situated. My client leases the land to
the Carmike Cinemas under a long term lease. The theatre opened
for business in December 1995.
The Property has direct frontage on West Horsetooth Road and
access by way, of a private access drive easement to Manhattan
Avenue, which access drive lies between two presently undeveloped
lots ("Out Parcels").
On behalf of my client, I inquired as to whether the City of
Fort Collins had any plan to obtain title to any part of the
Property by eminent domain or condemnation proceeding. You
indicated that the City had no such plan. You noted that at such
time as development of the Out Parcels occurred, the City would
determine if additional right-of-way was necessary from such Out
Parcels for street widening or turn lanes. I assume that even if
additional right-of-way dedication is necessary in connection with
the development of the Out Parcels, the Property's access to
Manhattan Avenue by way of the private access drive should not he
affected.

Dear Ms. Ashbeck
This is to request that you initiate the vacation of the existing sewer easement in Lot 1, Park South
Commercial Plaza Minor Subdivision. The easement will have to be vacated to allow the
construction of the above referenced project. The sanitary sewer will be re-routed around the west
side of the proposed theatre. The utility plans have been approved and signed by Roger Buffington
foi the Water/Waste Utility.
The legal description of the proposed vacation and a plat of the vacation are enclosed. If you have
any questions regarding the above, or need additional information, please do not hesitate to contact
