Dear Mike:
This letter is to summarize the agreement between Paragon Point Partners and the City of
Fort Collins pertaining to the interim (temporary) paving of Trilby Road. Based on recent
meetings and phone conversations, we have the following understanding:
1. The developer of Paragon Point, Phase 2 (Paragon Point Partners) will be required
to construct a 36' wide asphalt pavement section on the existing grade of Trilby Road
adjacent to the Development. This construction shall be completed and accepted by
the City prior to the issuance of the first Certificate of Occupancy for Phase 2 of
Paragon Point P.U.D.
2- The asphalt section shall be to a 5-year design for an arterial street. The approximate
length of Trilby Road to be paved is 2,400 L.F. Empire Laboratories, Inc. has
proposed a 3" asphalt section with no additional subbase over the existing 24' wide
roadway. The 6' bike lanes on each side of the existing roadway will require 3" of
asphalt over 4" of new Base Course. A small amount of additional fill (2,000 C.Y.)
is required to widen the existing roadway to 36' (See attached letter from Empire
Labs).
3. The 36' wide section will narrow to 24' to 26' over the existing Fossil Creek
Crossing. This will require the installation of guard rails.

4. The developer will provide construction plans for the interim paving for City
approval. The level of detail of design will be commensurate with a "temporary"
road and may not meet all the City criteria as far as design detail (i.e. double flowline
profile vs. centerline profile). The construction plans for the interim paving may be
submitted as a part of the Phase 2 construction plans or may be submitted at a future
date prior to construction of the Trilby Road paving as a separate document. The
latter of these options will not delay approval of the Phase 2 plans.
The developer is financially responsible for the cost associated with a 30' wide asphalt
section based on a 5-year residential design. This would equate to 1.5" of asphalt
with no additional subbase over the existing 24' wide roadway. The single 6' bike
lane (or 2-3' lanes) would require 1.5" of asphalt over 4" of new base course. The
majority of the fill, required on the south side of the road for the 36' wide section,
would not be required.
6. The developer will be credited for any earthwork (cut or fill) activities associated with
this interim paving towards his required escrow account for the construction of the
ultimated improvements to Trilby Road. This credit will be in the amount of
$4.50/C.Y. as verified by field surveys. Construction costs associated with the
earthwork therefore, are not included in the cost estimates.
7. The City of Fort Collins will participate in the additional cost (the oversizing of a 30'
residential to a 36' arterial). Reimbursement will be made at the time of acceptance
by the City of Fort Collins.
8. The following is an estimate of construction costs based on recent bids for similar
work submitted to the developer. Any adjustment required based on actual bid prices
will be made to the following estimates at the time of reimbursement.

TST, Inc. Consulting Engineers is requesting a variance for Falcon Ridge Court to have a
design grade of 8.67%. The City of Fort Collins standard is a maximum grade of 8.0% as
shown in Table 2, Page T-2 of the City of Fort Collins Design Criteria and Standards for
Streets.
The proposed extension of Southridge Greens Boulevard from north to south, ending at
Trilby Road, must cross a section of the site which slopes east to west. In order to minimize
the cut and fill requirements and keep disturbance of the natural terrain at a minimum, the
8 % maximum design grade required by the City of Fort Collins standards has been
exceeded.
At present the east end of Falcon Ridge Court is in a five foot cut while the downstream or
west end is in a four foot fill. Any less grade would increase the required fill material,
which would have more impact on the natural terrain near Fossil Creek. The grade at the
end of Falcon Ridge Court is within City of Fort Collins criteria for intersections and cul-de-
sacs. The street is also west facing so icing should not be a problem during the winter
months. Therefore, we do not see any potential problems with public safety due to the
increased grades. This is an almost identical situation to Eagle Ridge Court in Phase 1
which was granted a variance earlier this year.
