Re: Broken Sidewalk at 1124 Paragon Place
Dear Mr. Ray:
Some weeks ago I was asked by one of your superintendents (Dean) to
look at the damaged sidewalk at 1124 Paragon Place to try and
determine what caused the breakage to occur. As I visually
inspected this sidewalk, curb and gutter I found several items
which lead me to believe that the cracking was a result of external
over loading of the sidewalk. However, I felt it important to
obtain a second opinion and research my theories, before passing
this information on to you. The following observations and
comments are based upon my on site analysis and discussions with
Mr. Tom Baland of Kiefer Concrete and reviewing Concrete
Construction and American Concrete Institute publications.
1. In my observation I found a longitudinal crack approximately 40
feet in length and 1.5 mm or greater in width. This crack extends
from the north side of the driveway parallel to the gutter north to
about the property line.
2. From the main crack there are several cracks at about a 45
degree angle from the perpendicular control joints and starting
approximately 2 feet in from the back of the sidewalk.
3. Some hairline ( less then .10 mm ) "D" type cracks at the back
edge of the sidewalk.
4. There is some elevation difference between the edges of the
main line crack, with the back of sidewalk edge being slightly
higher then the curb side edge.
5. I observed very little dirt or debris in the cracks indicating
they are relatively new and have not been exposed to much
weathering.

Through researching several publications dealing with concrete
cracking, using what I saw at the site and drawing upon my years of
experience in the concrete industry as well as my current position.
It is my belief that the cracking can be attributed to an
overloading of the sidewalk surface. Consequently, the concrete
compressive and tensile strengths were exceeded, resulting in the
sidewalk cracks. This is especially evident in the areas which
exhibit the 45 degree or "D" type cracking pattern.
Prior to the City accepting a developers construction of public
improvements they are required to repair all items damaged by their
construction. However, these repairs do not account for those
items which may be damaged after the initial inspection. For this
reason the City requires all damaged sidewalk, curbs and gutters
and street damage be repaired prior to releasing certificates of
occupancies. It is our position not to determine who or what
created the damage but to insure that it is repaired.
In this case, I understand the City released the certificate
occupancy for this home with the understanding that the damaged
sidewalk would be repaired. At this point it is the city's desire
to have the sidewalk repaired. Unfortunately, it is up to you to
decide if the damage was a result of the home building construction
or was damaged prior to the start of the building. Hopefully, a
site inventory was perform before the lot was purchased which will
certainly make it easier to determine who is responsible for the
damage repair.

This letter .is to inform you that the asphalt patch placed on Lemay
Ave. at Hawkeye St. has deteriorated to an unacceptable condition
and will need to be removed an re -patched.
Please be informed that this patch is still under warranty.
Due to the :severity of the raveling on this patch and the high
volume of traffic on Lemay Ave. I would ask for your cooperation in
getting this repair done A.S.A.P.

developer or contractors of any liability with regard to any other
items that remain under warranty.
