RE: Paragon Point Sidewalk Construction
Dear Bret:
I have reviewed your request to reduce the escrow account for
Lemay Avenue by the amount of sidewalk constructed.
The amount of sidewalk along Lemay Avenue constructed to final
design standards may be deducted from the estimate for Trilby and
Lemay dated February 12, 1992, which was used to calculate the
escrow amount.
Using the information in your letter of February 15, 1993, I will
reduce the total amount of escrow required for Lemay Avenue by
$12,678.00.
In accordance with Paragraph II Special Conditions D. (1) (a) of
the Development Agreement for Paragon Point P.U.D., the amount of
$49,393.00 ($62,071.00 - $12,678.00) will be required for the
second half of escrow for Lemay Avenue improvements prior to
construction in Tract "D" of the development.

RE: Lemay Avenue Sidewalk Construction

Dear Matt:
This letter is in regard to the construction of sidewalk along Lemay Avenue, associated with
Paragon Point P.U.D.
As you know, the developer, Paragon Point Partners, has negotiated an escrow account for
the future widening of Lemay Avenue. Part of the future improvements to Lemay Avenue
would be a 5' wide detached sidewalk. The City of Fort Collins is requesting that the
developer install this walk from the north property line, abutting SouthRidge Greens Golf
Course, along Lemay to the existing bridge at Stone Creek and Lemay Avenue.
The design of the sidewalk along with horizontal and vertical alignment will be taken from
Sheets 8 and 9 of 33 of the approved Lemay Avenue SID plans. If the developer installs this
sidewalk to final design horizontal and vertical alignment, we would request a credit toward
the required escrow account accordingly. Cost of the sidewalk will be based on the revised
estimate for Trilby & Lemay which you provided for me on February 12, 1992, and which
was used for purposes of defining the escrow account.
Based on this estimate, a cost of $9.00/L.F. plus 10% for surveying will be used for
sidewalk construction. 1280 L.F. of sidewalk will be installed which totals $11,520.00, and
construction staking will be $1,158.00. The total which we would request to be credited to
the developers escrow account therefore, would be $12,678.00.
We would appreciate verification from your office that a credit of $9.90 per lineal foot of
5' side detached sidewalk would be acceptable by your office at your earliest convenience.

This letter is to inform you that the City of Fort Collins is satisfied with the
elevation of the sanitary sewer manhole rings and covers as they relate to the
asphalt street surface in the Paragon Point Development. Therefore, the City
will not hold the water district responsible for any further adjustment.

Dear Mr. Collins:
The intent of this letter is to inform you that the public improvements on the
City right-of-way have been inspected and initially accepted by the City of Fort
Collins pending the normal contractors warranty period with the exception of the
punch list items listed below.
Please be informed that this letter of acceptance does not relieve the developer
or the contractors, lot owners, or their contractors of their responsibilities
for the repair of any damage which may occur as a result of the building
construction.
Punch List Items:
1. Clean tack off of curbs, gutters and sidewalks.
2. Repair two locations of curb, gutter and walk.
3. Repair asphalt where A-Z Rental off loaded equipment.

RE: Variance Request for Street Grades Within Paragon Point P.U.D. Phase 1
Project No. 10-695-004
Dear Mike:
TST, Inc. Consulting Engineers is requesting a variance for Eagle Ridge Court and Cactus
Court to have a design grade of 8.5% and 8.19% respectively. The City of Fort Collins
standard is a maximum grade of 8.0% as shown in Table 2, Page T-2 of the City of Fort
Collins Design Criteria and Standards for Streets.
The proposed extension of Southridge Greens Boulevard from north to south, ending at
Trilby Road, must cross a section of the site which slopes east to west. In order to
minimize the cut and fill requirements and keep disturbance of the natural terrain at a
minimum, the 8 % maximum design grade required by the City of Fort Collins standards has
been exceeded.
At present the east end of both Cactus Court and Eagle Ridge Court are in a three foot to
six foot cut while; the downstream or west end is in a four foot to six foot fill. Any less
grade would increase the required fill material, which would have more impact on the
natural terrain near Fossil Creek. The grades at both ends of Cactus Court and Eagle
Ridge Court are within City of Fort Collins criteria for intersections and cul-de-sacs. Both
streets are also west facing so icing should not be a problem during the winter months.
Therefore, we do not see any potential problems with public safety due to the increased
grades.
