EXISTING LANDSCAPING IS DIFFERENT THAN THAT APPROVED WITH THE ORIGINAL VANWORKS SUBDIVISION SECOND FILING, HOWEVER THIS MINOR AMENDMENT PROPOSES A DIFFERENT LANDSCAPING CONFIGURATION FROM WHAT WAS ORIGINALLY APPROVED. THE PROPOSED MINOR AMENDMENT LANDSCAPING COMPLIES WITH FORT COLLINS LAND USE CODE LANDSCAPING REQUIREMENTS. 5. PROPOSED LANDSCAPING SHOWN ON THIS DRAWING IS TO BE CONSTRUCTED AS PART OF THE IMPLIMENTATION OF THIS MINOR AMENDMENT. 6. THE MINOR AMENDMENT PROPOSES 1000 SQUARE FEET OF ADDITIONAL IMPERVIOUS AREA IN THE FORM OF ADDDITIONAL PAVED AREAS ON THE ENTRY AND EXIT FOR THE PROPOSED TRUCK SCALE. THE TRUCK SCALE RESTS IN A SUNKEN PIT RECESSED INTO THE GROUND, AND RAIN WATERS SEEPS OFF THE SURFACE OF THE SCALE DIRECTLY TO THE GROUND BENIETH IT, FUNCTIONALLY MAIKING THE TRUCK SCALE ACT AS A PERVIOUS SURFACE. 7. CONCURRENTLY WITH THIS MINOR AMENDMENT APPLICATION, WE HAVE SUBMITTED AN APPLICATION FOR A MODIFIATION TO SECTION 3.8.1 1(C) OF THE LAND USE CODE WHERE FRONT YARD FENCES ARE LIMITED TO NO MORE THAN 4 FEET. WE ARE PROPOSING SCREENING FENCING TALLER THAN 4 FEET LOCATED CLOSER TO THE STREET THAN THE FRONT FACADE OF THE EXISTING BUILDING. 8. IT IS HEREBY ACKNOWLEDGED THAT THE PROPOSED FENCING ENCROACHES OVER PORTIONS OF UTILITY EASEMENTS, AND IT IS UNDERSTOOD THAT IN THE EVENT THAT UTILITY PROVIDERS NEED TO REMOVE SAID FENCE WITHIN EASEMENTS TO MAINTAIN OR INSTALL UTILITIES, THE UTILITY PROVIDER IS NOT OBLIGATED TO REPAIR THE FENCING.
