And we are willing to coordinate with the Bank, as was outlined in my previous letter, Cody. The major items to coordinate are: (a) easement for full movement access, (b) easement for a major entrance off Lemay including necessary variance approval, and (c) internal projects' street alignments. On further reflection, I feel that it is imperative to proceed with all of these items now, not at a later date by means of minor amendment or otherwise. The additional incremental amount of planning and engineering work necessary for widening the Lemay access road considerably and adding an island is minimal and if Northstar and VF Ripley move aggressively forward, I am sure this all can be accomplished without adding much if any delay to the approval process. Cody, several thoughts primarily for you: 1. If we proceed as I have suggested, it is likely you will save both time and money. It is more efficient to take care of these matters, which are really details, now rather than having to reinitiate an approval process at a later date to accomplish them with a minor amendment. 2. 1 am confident that you and I can sit down and put together the necessary agreement between us in one week or less. March 16, 2004 Katie Moore City of Fort Collins Engineering PO Box 580 Port Collins, Colorado 80522 Re: Bank of Colorado — Northeast Corner of Lincoln and Lemay Request for Variance C — Driveway Spacing Proj: 170-01 Dear Katie: The following is a request for variance from Table 7-3 — Fort Collins Technical Design Standards — 4-Lane Arterial — Distance Between Driveway Edges and Distance Between Driveways and Street Intersections in the "Larimer County Urban Area Street Standards, October 2002". This variance is also requested to allow the proposed drive into the site on Lemay to be closer to the Lemay and Lincoln intersection than the 460' minimum dimension specified in the Standards. The drive is proposed to be located 325' north of the intersection (centerline to centerline). This drive entrance will be restricted to a right -in, right -out configuration by installation of a temporary median in Lemay. This restriction will provide additional safety for traffic movements entering and exiting the entrance. Because of the installation of the medina, it is not anticipated that this variance from the above Standards will compromise the public health, safety and welfare. As you may recall they were proposing to take access off of Lincoln several hundred feet east of the intersection. Evidently, they are having trouble getting the easement for this access and they now are proposing an access from Lincoln at approximately 240 feet, centerline to centerline, from the intersection. ( This is the same location as what was being proposed on their first submittal). At that time the City was requiring a median to be built for access control as a right in/right out Is this still the case? Any other thoughts/requirements that need to be addressed? Trisha wants to schedule a meeting with me soon ( naturally) to discuss the revision so I would appreciate your input as soon as possible. If this project goes forth with this design then you will need to provide cross sections with elevations, street elevations and etc. Limits of mill and in lay and any appropriate details for this interim median section. Transportation Planning has asked about a ped refuge, Since this proposed median width is only 4 feet, please contact Tom Reiff regarding this issue. For documentation purposes I will paraphrase your desire. As I understand your request, you are asking the City to require the Bank of Colorado to share their enter way off of Lemay Avenue with a future development project to the north. In addition, you would like the City to require the bank project to dedicate the drive entry as public right-of-way in the fixture. The intent of this right-of- way would be to provide street access to the north for future development. Unless, I am mistaken I believed this is what you proposed to us and the bank some months ago. In fact the City was under the impression that the bank and yourself were in agreement with this concept. Evidently, issues have arisen that we are not aware of; consequently, you are trying to put us in the middle of a civil dispute. Unfortunately, the City can not do as you have requested. Since there is not an application in our system for this northern project, showing the intent, density, layout or design we will not require a shared drive or dedication of right-of-way. The City does not have legal standing to accommodate your request. This item of discussion is better suited as discussions between the owners of the north property and the bank. I suggest working and cooperating with the bank will accomplish both your needs and theirs. If you wish to pursue your desires with the bank project, it should be done quickly. They are in the Final Compliance stage of the City's process and will soon have approval to proceed with construction of their facility. The left turn lane on Lincoln Avenue currently does not meet these standards. Assuming a speed of 35 mph, the required approach taper is 245 feet. Currently, the approach taper is approximately 75' and the full width bay of approximately 200'. It is proposed to maintain this existing configuration. This variance is requested to allow a sub -standard taper on the proposed auxiliary lane in order to maximize the storage for the left turn lane. This is proposed as an interim condition because the ultimate alignment of Lincoln Avenue is not currently known. It is not logical to bring this left turn bay into compliance when the final alignment of Lincoln Avenue will likely cause that improvement to be removed and reconstructed. The current left turn bay appears to function adequately for the interim condition. It is not anticipated that this variance from the above Standards will compromise the public health, safety and welfare. Discussion: Interim stormwater improvements to Lincoln Avenue limit the design options adjacent to the proposed Bank of Colorado project at the Northeast corner of Lincoln and Lemay Avenues. The City is requiring this project to provide a stormwater retention pond, which is required to be of much greater capacity then the normal detention pond, due to the lack of an adequate out fall system down stream of this project. Consequently, the retention pond size is substantially larger when compared to the normal detention pond size when an outfall system is in place. The required retention pond is currently located as far south and is located as centrally as possible to the east west property lines as practical for this project.. With the enlarged pond and a possible future right turn lane there is not sufficient room to provide for a detached sidewalk should the future Lincoln Avenue be constructed at it's current location. In order to accommodate the pond sizing and a future right turn lane this project is proposing a 7 foot wide sidewalk adjacent to the property line to compensate for the lack of a parkway ^_H I North College Avenue • PO. The attached sidewalk condition will only occur if the current Lincoln /Lemay Avenue configuration remains as is. Furthermore, the future of the existing Lincoln Avenue is uncertain at this time. The East Mulberry Corridor plan indicates some changes will most likely occur when Lincoln Avenue to the east. It is projected as shifting in a more northerly alignment to connect with a future 2 lane arterial (International) street. The portion of Lincoln Avenue from the future connection to Lemay is shown in the plan as a 4 lane arterial which will require extensive intersection reconfiguration improvements which may impact any existing improvements previously installed by this and existing developments. Recommendation: Since the ultimate final design or construction timing for Lincoln and Lemay avenues is not within the near future, and the final intersection alignment has not been determined it is likely that changes to the existing streets will occur. Based upon the fact that the Bank One Development is not being required to make an ultimate Lincoln Avenue improvements except for the si ewalk installation it seems realistic to not be concerned with the proposed sidewalk location being an attached or detached sidewalk at this time. The sidewalk as proposed may become an attached walk in the future, yet allows for a detached sidewalk if the future alignment is modified to a different configuration then what is envisioned today. Therefore, staff supports the sidewalk configuration and location as shown on the City approved Final Development Plan Documents. The ultimate design of Lincoln Avenue will require a right turn lane which will widen the street to the north adjacent to the Bank of Colorado site. The proposed development has a requirement to provide retention in the interim condition which will -onvcrt to detention once a downstream outfall cone ance is rovided. The retention requirement increases t e area that is dedicated to ponding. This creates a hardship and the owner has requested that we pursue the following variance. This variance is requested to allow 7' wide attached walks rather than the standard 6' detached walks (shown on Figure 7-2F). At the east eeedge of the property, the walk would begin to transition to a detached walk and wou re tn mt the criteria.
