Graese., attomey-in- fact ("Grantee"), whose address is 3030 South College Avenue, Fort Collins, Colorado 80525, WHEREAS, Grantor and Grantee are parties to that certain Grant of Easement (Provincetowne - Ditch) dated November 27, 2002 and recorded January 2, 2003 at Reception No. 2003000226 in the records of the Clerk and Recorder of Larimer County, Colorado (the "Easement"); and WHEREAS, Grantee, as holder of certain rights as set forth in the Easement, wishes to terminate, extinguish, and surrender all of its right, title and interest in and to the Easement; and WHEREAS, the parties wish this Termination be recorded with the Clerk and Recorder of Larimer County, Colorado. NOW, THEREFORE, in consideration of the foregoing recitals and for good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged by the parties, the parties agree as follows: 1. Termination of Easement. Effective as of the date first written above, Grantee hereby forever and irrevocably terminates and grants to Grantor all of its right, title and interest in and to the Easement and all rights associated therewith. 2. Recording. This Termination shall be recorded in the office of the Clerk and Recorder of Larimer County, Colorado. 3. Governing Law, This Termination shall be governed by and construed in accordance with the laws of the State of Colorado.
