Statement of Planning Objectives
The purpose of the proposed Westfield Park Pool is to provide a neighborhood swimming pool
for those persons residing in the adjacent neighborhoods that do not have a neighborhood pool.
The pool membership will draw primarily from the boundary of Harmony Road on the south, Taft
Hill Road on the west, Shields Street on the east and Horsetooth Road on the north. The
neighborhoods within this area do not have a neighborhood pool in which they may partake. The
residents of this area have created a private company that is desiring to develop a pool facility that
will accommodate the residents of this area.
The property for the pool is north of the existing Johnson Elementary School and is located on a
portion of Westfield Park that is being purchased from the city. This location has been chosen
because of its central location to the surrounding neighborhoods an it ties well with the open
atmosphere of the park. It is anticipated that most users of the pool will utilize alternative forms
of transportation to access the facility. A small parking lot has been provided to allow a limited
number of vehicles but the majority of the users will walk or bicycle from the surrounding
neighborhoods.
The pool facility is approximately 1.03 acres in size and includes a lap pool, diving well, wading
area and childrens pool. A club house that houses the mechanical equipment, showers, restrooms
and meeting room is designed to compliment the neighboring residential buildings.
The pool facility will be owned by a private group comprised of the members of the
neighborhood. Those families interested in joining the group have supplied membership dues to
cover the costs of purchasing and developing the pool property. New members may be added as
the surrounding neighborhoods continue to develop.
Most new neighborhoods in Fort Collins, and some older neighborhoods, have pool facilities that
were constructed when the subdivision was developed. The neighborhoods in this area were
developed by several different developers over a number of years. Consequently there has never
been the ability to crate a neighborhood pool facility for this entire area. This facility will allow
residents of the area to enjoy a quality facility without having to travel a significant distance from
their homes. We feel that this addition to the park will create a user friendly setting that will
compliment the uses planned for the city park.

Dear Susan,
This letter will serve as the City's Park Planning and Development intent to pay for the
redesign of the sow:h sidewalk along Westfield Drive. The current plan is to have the sidewalk
attached to the street. Park Planning and Development and the "Pool of Dreams" property
owners would like to have the sidewalk detached as per current City standards.
Park Planning and Development can be billed for the redesign effort needed to detach the south
sidewalk.

The Development Agreement states that you are responsible for making all of the improvements
(including the sidewalk) to Westfield Park Drive. This is a legal and binding contract between you and the
city and one that must be fulfilled as written. Any changes to the original agreement and the original
signed set of plans must be done through the minor amendment process, which you may initiate at any
time. New plans must be submitted showing future phasing of sidewalk improvements and then routed for
approval or denial. However, after speaking with the various departments (Parks, Legal, Planning), it is
not likely that such approval will be given. The City has every legal right to enforce our contract with you
as written and has no interest in changing it at this time. You are, however, always welcome to apply.
It is the City's desire that you honor your agreement and construct the sidewalk as your DA requires. Final
Compliance and Acceptance can not be granted until all improvements are complete as shown on the
plans.

Because of the disagreement about the repay on Westfield Drive, we have
decided to install the curb and gutter only on the south side of Westfield
Drive. The Park department and pool of dreams can install the detached walk
whenever they develop their sites. This way PLS is not out any additional
cost if Pool of Dreams does not develop their site.

Re: Westfield Pool
Gentlemen:
I received a phone call this morning in relation to the groundbreaking ceremony featured in the
Coloradoan which occurred on Sunday, April 7, 2002. I was advised that Sinnett Builders, Inc. was in
violation of the land use code by excavating on site without the project being fully approved and
recorded through the city process. Mr. Newlin seemed quite upset, and relayed so in the call.
In the phone call I responded that what had occurred was only a ceremonial event for the owners
of the project, and that the excavation consisted only of using a small backhoe to.dig a couple of scoops
of dirt for the amusement of the owners and attendees. The owners and attendees also used hand shovels
to start the project in a ceremonial fashion.
Mr. Newlin and I had several conversations about the project in relation to any work that could
be started at this time, and was advised nothing could be done on the site until the approval process was
completed. I had mentioned to Mr. Newlin that the groundbreaking was occurring on that Sunday earlier
in the week, but we did not discuss any specifics about the groundbreaking itself. I was unaware that the
actions for the ceremony would be regarded as starting work or a violation of the land use code. I did
apologize several times during the conversation.
Sinnett Builders, Inc. will not start any actual work until the approval process is completed and
proper permits are obtained. That may not have been apparent when reading the Coloradoan article.
With the assistance of many city departments, we are getting the project moving quite rapidly through
the process, and anticipate being able to start in about a week.
I have always worked very hard to have a positive relationship with the city departments, and I
have always endeavored to ensure our company has been proactive in abiding by the rules, regulations
and processes when doing construction projects in the City of Fort Collins. I truly did not believe such a
groundbreaking ceremony would be deemed as excavation or starting work unlawfully per the land use
code. For that I apologize, specifically to Lance Newlin, and hope we can continue a positive
relationship in the future.
