• BRYANT called HAMDEN to discuss the 06110/2004 review comments, as provided by Peter BARNES (Zoning
Administrator, City of Fort Collins) for the above noted project (reference: "Approval Items for MA04002" last
dated 06/11/2004).
COMMENT: Please discuss in the report what measures are being used to prevent erosion from coming off
the site during construction?
o BRYANT noted that a section was added to the May 27, 2004 revised Stormwater Management Report
letter that addressed this comment SPECIFICALLY.
■ HAMDEN was okay with the added section and recommended noting in the resubmittal letter that this
information was previously provided.
COMMENT: Please also provide erosion control talcs in the report.
o BRYANT noted that this was a very small site that would have large amounts of exposed subsurface
materials -- especially since the site is currently paved.
■ HAMDEN recognized this and recommended noting in the resubmittal letter that erosion control
calculations are not necessary due to the nature and minimal size of the redevelopment.
COMMENT: Area covered by water quality pond should be dedicated as a drainage easement.
o BRYANT gluestioned the (1) configuration of the easement, and (2) whether completion and dedication of
the easement could be predicated on issuance of the final certificate of occupancy rather than HAMDEN's
approval.
■ HAMDEN recommended that the easement should be to the back -of -curb / sidewalk edge around the
water quality pond, and should extend out along the pipe that connects to the existing storm
drainage system. HAMDEN is OKAY with completion and dedication of the easement prior to
issuance of the final certificate of occupancy, as long as the linework is shown on the plans.

repeat comment.

include the entire sidewalk along South College Avenue (reference: drawings C-2, "Grading & Drainage Plan" and C-3,

RI We acknowledge that a drainage easement will be required for the stormwater quality pond. Per our discussions with Mr.
Basil Hamden (Civil Engineer Il, City of Fort Collins Utilities: Stormwater Management), the easement will "surround" the

piping system (reference: Telephone Conversation Memo between BRYANT and HAMDEN dated June 15, 2004 and

MEETING DATE: November 18, 2002
APPLICANT: Mrs. Lisa Lucero, McDonald's Corporation, 5251 D.T.C.
Parkway, Suite 30, Englewood, CO. 80111.
LAND USE DATA: Request to demolish the existing restaurant and rebuild a new
restaurant featuring a drive -through lane with dual entrances and dual menu boards. The
new restaurant would be constructed within the existing building envelope with as little
disturbance to surrounding public improvements as possible. An outdoor patio would be
added to the west side of the building.
Comments:
1. The site is zoned C, Commercial which permits drive -through restaurants. The
proposed demolition and rebuild could be processed as a Minor Amendment. The
demolition and rebuild would be permitted, however, as a Minor Amendment
only so long as the new development plan complies with the Land Use
Code, at
least to the extent of its original compliance (so as to preclude any greater
deviation. from the standards of the Land Use Code). There are no minimum
parking requirements but maximum limitations so no additional parking can be
added over what is currently provided.
2. The build -to line standard requires that the building along South College be
setback between ten and 25 feet from property line. This means the building
cannot be shifted any further back from College Avenue than the current location
as this would be a greater deviation from the standard. There must be a direct
connecting walkway linking the public walk on to the building entrance without
crossing, a parking lot drive. The parking lot must be landscaped, especially along
the property lines. If any Modifications of Standards are needed, then the request
must be forwarded to the Planning and Zoning Board either as a stand-alone
Modification or in conjunction with the Project Development Plan (P.D.P).
Modifications cannot be processed as part of a Minor Amendment.
3. Two menu boards are not allowed. The only way a second menu board would be
permitted would be if the board is not visible from a public street or property line.
I f this cannot be accomplished, then the second board is permitted only by a
variance granted from the Zoning Board ofAppeals. (It may help if the menu
board is screened to the maximum extent feasible.) For further information

4. There is a large ahove-ground electrical facility that feeds the shopping center and
College Avemie streetlights. This facility would he very expensive for the
developer to relocate so it is advised that it not be moved. This facility should
protected from excavation and construction. Lines feeding this facility are about
3)6 inches deep and lines going out are about 24 inches deep.
5. If the existing is transformer is to be relocated, then this too will be at the
developers expense. Be sure that the transformer is within ten feet of hard
surface for emergency change out. Ifthe existing panel size is insufficient, then
the net incremental increase is subject to all normal development charges. A
Commercial One (" C-I-) Form must be completed by a licensed electrical
contractor. Please refer to the hand-out, available from Light and Power,
describing the development fees and charges. Street trees in the parkway strip
must he kept 40 feet from streetlights. Ornamental trees must be kept 15 feet

6. There are 6-inch diameter water and sewer lines on the west edge of the property.
These lines should be located prior to construction. If there is an increase in tap
size, then the plant investment fees arc based on the net incremental increase with
credit given for the existing services. For further information, please contact

7. The site will be served by the Poudre Fire Authority. The address must be clearly
visible from South College Avenue. A fire protection system is required for the
hood and duct system. All portions of the exterior of the building must be within
150 feet of the private access drives. (Poudre Fire does not consider South
College Avenue an appropriate roadway for fire -fighting.) Any internal fire
access roadway must be dedicated as a public emergency access easement, with
pavement markings and curbs painted red. if this cannot be accomplished, then
an automatic fire extinguishing system must be installed. For further information_

�. This site is in the Spring Creek drainage basin where the new development fee is
$2,175/acre which would be applicable if there is an increase in imperviousness
greater than 350 square feet. The site is on Stormwater inventory map #7P. A
copy of the map can be obtained from the Utilities office at 700 Wood Street.
The drainage and erosion control report will need to address the inperviousness
and drainage patterns. They need to be maintained unless there is a problem that
needs to be corrected. The report and grading plan must be prepared by a
Professional engineer registered in Colorado. Extended detention is the
recommended method to treat the runoff and is required for redevelopment of a

9. Wherever new sidewalk ramps are constructed, they should be "directional."
10. Staff has met with Tess Jones, CDOT Region Four Access Administrator. A
CDOT permit will not be needed since all the work is being done outside the
public right-of-way.
i t . The sidewalk on College Avenue must be seven feet wide.
12. There may be a sight distance easement for pedestrians due to the existing tree.
This may require the tree to be trimmed.
13. Please contact Matt Baker, 221-6605, to determine whether or not the Street
Oversizing Fee and the Larimer County Road Fee will apply. Since these fees are
based on building square footage, the fee would only apply to the net increase
over existing square footage.
14. An engineering variance will be needed for the northern exit curb return radius
which is beyond standard. Also, an engineering variance will be needed due to
the parking stalls being within 100 feet of the flowline of College Avenue. (Since
the engineering code is silent on whether these stalls are on an in -bound or out-
bound drive aisle, a variance is stilt required.) Both variances are administrative
and will likely be supported.
15. Public improvements shall comply with Latimer County Urban Area Street
Standards. One of these requirements is that the first parking stall must be
setback from Elizabeth Street by 100 feet as measured from face of curb. This
engineering standard may be varied in accordance with the administrative
procedures. As such, this type of variance is processed at the Staff level and does
not go to the Zoning Board of Appeals or the Planning and Zoning Board.
16. The total right of way for South College Avenue is 141 feet. The dedication of
right-of-way for this project must be such that there is 57.5 feet of half -width as
measured from centerline to property line.
17. Utility Plans will be needed at the time of submittal. A Development Agreement
will be required prior to recording final documents. A Development Construction
permit will be required prior to beginning site work. For further information,

18. Be sure to provide bike parking near the customer entrance.
19. The construction phase will require a Fugitive Dust Permit from the Larimer
County Health Department if the property is under construction for over a certain

suggestions, and recommendations offered by your team:
CURRENT PLANNING (PER TED SHEPARD)
• To the greatest extent possible, the existing trees between the proposed building and College Avenue will be protected
and saved (particularly around the large evergreen tree).
• A full-size (24"x36") Site Lighting Plan is provided within the attached Minor Amendment Plan set.
• All site lighting fixtures will be "sharp cut-off" and "down directional".
ENGINEERING DEVELOPMENT (PER SUSAN JOY)
• The Utility Construction Plans are now presented in full size, 24"x36" format.
• The Utility Construction Plans consist of a cover sheet, grading plan, utility plan, and detail sheets, only.
• Please reference the attached Drainage Letter (addressed to Basil Hamden) and Traffic Impact Analysis Letter
(addressed to Mr. Stanford).
• Please reference the attached Appendix E-4, "Requirements of Utility Plans".
• The easements that are presented on the Utility Construction Plans were dedicated via original platting. Reference: "Plat

LIGHT & POWER ENGINEERING (PER DOUG MARTINE)
• Per our discussions with Mr. Martine, the existing transformers (there are two existing antiquated transformers that
current feed the existing facility) will be removed and replaced with a single wye-transformer capable of providing three-
phase,120-208 volt, 800 amp power.
STORMWATER ENGINEERING (PER BASIL HAMDEN)
• Please reference the attached Drainage Letter (addressed to Basil Hamden), which addresses the concerns expressed.
TRANSPORTATION PLANNING (PER UNKNOWN REVIEWER. NO NAME PROVIDED) To w, l`?,W-
• All of the new sidewalk along College Avenue is shown as seven -feet wide. There is a portion of existing sidewalk in the
northeast comer of the site that is less than seven -feet wide; however, this sidewalk connects to the existing "off -site"
sidewalk that is also less than seven -feet wide. As such, this small piece of sidewalk will not be widened.
• The sidewalk ramps were modified so that they are aligned directly cross driveways.
WWW-ENGINEERING (PER JEFF HILL)
• The specific requirements for water and sewer construction and abandonment are clearly defined on the attached Utility
Construction Drawings.
• The required landscape/utility, separation distances are maintained on the landscape plan.
ZONING (_PER PETER BARNES)
• Two additional handicap accessible parking spaces are provided near the northeast comer, adjacent to the building
without the necessity to cross travel lanes. The existing handicap accessible space will remain in the northeast comer of
the parking lot, but is not a required space.
