This letter is regarding the Timberline Office Park located along the West side of
Timberline Road, south of Lowe Street and north of Caribou Road, City of Fort Collins. I
appreciate your timely response associated with potential requirements to design the
ultimate Timberline Road section. Per your voicemail message, August 25, 2003, you
have had a conversation with Mr. Matt Baker, City of Fort Collins Transportation
Department, and Mr. Baker stated that he is NOT requiring this project to provide any
additional Timberline Road design or supportive information. Once again, thank you for
your prompt response to this issue.

Re: The variance request for modified driveway design for Canyon/Howes Mixed -use (AKA
Cortina)
Dear Ms. Kroetch,
This letter is in response to your request for a variance to the Larimer County Urban Area Street
Standards. The variance requested was for a modified driveway design for the driveway accessing the
underground parking off of Canyon Avenue. This variance has been approved by the City Engineer only
for this project and specifically as shown on the utility plans. One condition of the approval of this variance
is to re -include the cross-section of this driveway as shown on the previous round of review and to add
more detail to the driveway drawing on the detail sheet.
As with all variances to the street standards, the variances granted for this project are based on the
particular situation under design and the judgment that we (the designer and the City) apply to determine
whether there is a public safety concern. The variances for this project in no way set any precedence for
relaxing these standards on other projects without complete analysis and justification.

Dear Ms. Moore:
I am writing this letter to document our conversation on September 16, 2003. We
discussed the centerline of Timberline Road as it relates to an upcoming Project that we
are working on. This Project is in the Northwest corner of Timberline Road and Caribou
Drive. According to sheet 4 of the Timberline Road Plan and Profile dated June 20,
1994, the ultimate centerline of Timberline Road is 1 foot East of the Section Line.
There is an existing 51 foot half Right -Of -Way on Timberline Road. We will use the
aforementioned Centerline to dedicate the half Right -Of -Way for our Timberline Office
Park Plat. Therefore, we will be dedicating a total of 19.50 feet of additional half Right -
Of -Way. This will bring the total Ultimate half Right -Of -Way to 70.50 feet. It was
understood that this approach would be accepted and supported by the City of Fort
Collins. Please Contact me within 10 days if this is not acceptable in any way.
We welcome any questions or comments you may have. Thank you very much for your

southwest corner of Lowe Street and Timberline Road
To Whom It May Concern:
This letter will serve as notice to the City of Fort Collins ("City") that the undersigned, K.
Bi II 'f iley, erroneously executed a Deed of Dedication for Easement ("Deed of Easement") which (if
delivered and recorded) would burden the above referenced property. A copy of the Deed of
Easement, excluding an incomplete attorney certification and description is attached to this
correspondence. Note that the attorney certification of the Deed of Easement has not been completed.
The Deed of Easement is not in the possession of the undersigned and this correspondence will serve
as notice to the City that the undersigned does not intend to deliver the Deed of Easement to the City
and that no other third party is authorized to deliver the Deed of Easement to the City. The property
which is the subject of the Deed of Easement is currently under contract for sale and the granting of
any casement burdening this property would violate the terms of the contract.
In the event the Deed of Easement is delivered to the City, it is requested that the Deed of
Easement be immediately returned to the undersigned at the address indicated above. If you have
