Eckerd Drug PDP

The proposed Eckerd Drug Store at College and Drake is an infill project that
will replace an existing hotel and two other buildings. The proposed drug store
is located adjacent to the Frontage Road creating high visibility from College
Avenue. A landscape buffer is designed along the east property line to screen
the loading area and shield headlight glare from the adjacent residential
neighborhood. The project is proposing a shared parking agreement with the
Moot House since peak hours of operation for each business occur at different
hours. Vehicular traffic will have access to the site from the Frontage Road,
Thunderbird Drive and Drake Road. Sidewalks are being added to continue
pedestrian connectivity from the south and College Avenue. The building
architecture will be a brick fagade that will work well with existing buildings
in the area.
The store will have a manager, two to three assistant managers, one or two
pharmacists and several store clerks, the number depending upon store hours
and the business volume of the store. The store will contain a large variety of
goods, from prescription and over the counter drugs to seasonal items
including suntan lotion and Christmas items. Hours of operation will vary due
to municipal rules and market demand.
The intended use is compatible with the C-Commercial zoning designation.
The site does not contain any natural areas or hazardous materials.
Construction on the site is planned for mid -to -late spring with the opening of
the store occurring in late summer to early fall.

no longer wishes to construct the project after the easements have been dedicated and the plans have been
filed. According to the City of Fort Collins Land Use Code, the approved plans for the Eckerd Project may
be abandoned if no one wishes to use them any longer and the criteria for approving the abandonment are
met (LUC 2. L4(A)2 and 2.1.4 (C) 1&2).
In order to abandon the approved plans, a Major Amendment abandoning those plans must be submitted to
the City and approved by the Planning and Zoning Board. The Planning and Zoning Board would also be
the body that would approve the vacations of the easements dedicated with the project. City staff foresees
no problems with completing the abandonment of the project and vacation of the easements, should Eckerd
fail to proceed with the project. This abandonment would have the effect of canceling any easements
dedicated for the Eckerd Project.

Dear Mr. Oberlander,
This letter is in response to your request for a variance to the Larimer County Urban Area Street
Standards. The variance requested was for locating two sidewalk culverts within the curb returns of the
driveway access onto Drake Road. This variance has been approved by the City Engineer only for this
project and specifically as shown on the utility plans. The sidewalk culverts should infringe on the curb
returns by no more than the 2.9' stated in the request.
As with all variances to the street standards, the variances granted for this project are based on the
particular situation under design and thejudgment that we (the designer and the City) apply to determine
whether there is a public safety concern. The variances for this project in no way set any precedence for
relaxing these standards on other projects without complete analysis and justification.

Re: Eckerd at College & Drake — Request for Variance 4 — Sidewalk Culvert in curb return.

Dear Katie:
The following is a request for variance from Section 7.7.4 — Sidewalk Culvert (Chases) in the
"Latimer County Urban Area Street Standards, October 2002". This variance is requested for
two sidewalk culverts located on either side of the access from Drake Road into the site (within
the outside edges of the curb returns).
Section 7.7.4 states that `A sidewalk culvert shall not be located with a curb ramp, curb cut or
driveway.' "These two culverts are considered within the driveway. The sidewalk culverts are
required to prevent runoff from the site from flowing over the sidewalk.
The west sidewalk culvert is located to prevent destruction of the existing pavers, street tree and
tree grate. It was attempted to move this culvert further west but this reduced the volume in the
water quality pond to less than is allowed by the variance previously granted by Stormwater. It
was also attempted to flow the water to the east side of the entrance and eliminate this sidewalk
culvert. Due to the grades on the access, this was not feasible. The culvert infringes on the curb
return by 3 feet but does to interfere with the walk, ramp, or travel path into the drive.
The east sidewalk culvert is located at the eastern edge of this property. The sidewalk culvert
cannot be moved further east without infringing on the adjacent property. The culvert infringes
on the curb return by 2.9 feet but does to interfere with the walk, ramp, or travel path into the
drive.
For the above reasons, a variance is requested to allow the two sidewalk culverts to be located
within the curb returns. The culverts do not interfere with pedestrian, bike, or vehicular uses and
are needed to meet the Standard that disallows drainage over sidewalks. It is not anticipated that
this variance from the above Standard will compromise the public health, safety and welfare.

Dear Ted;
Thank you for assembling the staff for our last meeting. It was valuable to me for hear
the logic behind staffs comments concerning this project.
In response to comments made by engineering concerning sidewalks during the meeting,
I understand that pedestrian connectivity is an important goal of the City of Fort Collins.
Connectivity along a street such as College Avenue is especially important. Landscape
buffers are another important design goal of the community. Green space tends to break
up hardscape and buildings and adds visual interest to any development.
This project, being an infili development, presents challenges to provide both green space
and pedestrian connectivity per City of Fort Collins code requirement's. I have enclosed
photographs of the'sidewalks adjacent to the Moot House. They were designed and built
prior to the current emphasis on connectivity. The building is built quite close to the
sidewalk taxing our ability to provide a wide,' spacious sidewalk and yet buffer the hard
vertical surfaces of the building with landscaping. Handicap parking and access is not
compromised. An enclosed site plan shows the proximity of the handicap parking and
access to the Moot House:

As you may notice in the enclosed pictures, the owners of the Moot House have done an
admirable job providing a very attractive landscape with a minimal amount of land. If we
were to widen the sidewalk along the south side of the building, we would lose the
ability to provide almost any landscape.
I would propose to leave the south side of the building and sidewalk as it is and add
sidewalk extending out (west) into the fronthge road to provide additional sidewalk for
pedestrians traversing north and south along College Avenue. This', would allow the
Moot House to maintain the existing green space and provide additional pedestrian
facilities.
We will be submitting plans incorporating staff comments shortly. Your input on this
matter would be reflected in the drawings.

Dear Katie:
The following is a request for variance from Drawing 19-6 - Minimum Oft' Street Parking
Setback Distance in the "Larimer County Urban Area Street Standards, October 2002". This
variance is requested for 2 drives off the frontage road located along the west boundary of this
site. The parking in this area is existing and is owned by the Moot House. The improvements
proposed are intended to better define the entries but not intended to reconstruct this parking lot.
Drawing 19-6 shows that the minimum distance from the street flowline to the first off street
parking space is to be 40' for a local street (the frontage road) with traffic between 100 and 750
ADT and driveway traffic between 100 and 750 ADT. It is proposed that the parking setback be
reduced to 15' on one side of each of these driveways.
The parking on the north side of the north entry is designated as handicap parking and will have
very low use. The first available (non designated) parking stall is located approximately 55' from
the flowline of the frontage road. Because the first three parking stalls are reserved for special
use, they will have very low turnover and will not interfere with traffic entering the site from the
frontage road. The parking on the south side of the north entry is located 15' from the flowline of
the frontage road.
The parking on the south side of the south entry is located approximately 55' from the flowline of
the frontage road and meets the criteria stated above. The parking on the north side of the south
entry is located 15' from the flowline of the frontage road.
It is anticipated that the volume of traffic on the frontage road in this area will be low (much less
than the 750 ADT in the traffic range) because the road becomes one way after the north entry
and does not extend through to College Avenue. This modification and elimination of the
connection to College will allow the frontage road to act as an entry into the parking lot between
the Fckerd and the Moot House and not a through road. It is also anticipated that the speed of the
traffic on the frontage road, both northbound and southbound, will be low because the frontage
road is serving only the parking lot. The southbound traffic will be primarily from the drive
through which constitutes approximately 2% of the overall traffic volume for Fckerd.

For the above reasons, a variance is requested to allow two drives to have a 15' parking setback
Irani the frontage road. Because of the low speeds anticipated on the frontage road, it is not
anticipated that this variance from the above Standard will compromise the public health, safety
and welt -are.

The following is a request for variance from Table 7-3 — Technical Design Criteria — Minimum
Distance Between Driveway Edges and Minimum Distance Between High Volume
Driveways and Intersections in the "Larimer County Urban Area Street Standards, October
2002". These variances are requested to allow the existing driveway location on Drake Road to
be used.
The existing drive entrance is located 302 feet from the intersection of College Avenue and Drake
Road. The criterion for the distance between high volume driveways and intersections on a 4-
lanc arterial with a raised median is 460 to 660'.
The drive is located 55 feet from a driveway on the west (entrance into the Sinclair gas station)
and 30 feet from a driveway on the east (entrance into a small office building). The criterion for
the distance between driveway edges on a 4-lane arterial with a raised median is 460' to 660'.
All of the existing entrances are restricted to right in — right out by the existing median in Drake.
Each driveway services different properties and the parking areas are not interconnected. It was
suggested to consolidate our drive with one of the adjacent driveways. This was explored and it
was found that by using the drive on the east, all traffic would be required (because of the
location of the existing building) to make two 90-degree turns to get into the parking area. This
would slow down traffic leaving Drake and make the drive entry very unsafe. Using the drive on
the west would require the traffic to drive over existing gas storage tanks and would encumber
this property and prevent redevelopment as is currently proposed. We believe that the existing
location of the driveway is the best alternative for access to this site.
This variance from the above Standards will not be detrimental to the public health, safety and
welfare. Please ca any questions or additional information that you may need for the

I have been informed that there are some concerns regarding the dedication of easements for the Eckerd
at College and Drake Project, and what could be done if the development proposal "falls through" and
Eckerd no longer wishes to construct the project after the easements have been dedicated and tbp ,pplI se
have been filed. According to the City of Fort Collins Land Use Code, the approved plans for th p ect
may be abandoned if no one wishes to use them any longer and the criteria for approving the
abandonment are met (LUC 2.1.4(A)2 and 2.1.4 (C) 1&2)1?ln order to abandon the approved plans, a
Major Amendment abandoning those plans must be submitted to the City and approved by the Planning
and Zoning Board. The Planning and Zoning Board would also be the body that would approve the
vacations of the easements dedicated with the project. City staff foresees no problems with completing
the abandonment of the project and vacation of the easements, should
