HomeMy WebLinkAboutTHUNDERBIRD ESTATES NINTH - Filed OA-OTHER AGREEMENTS - 2004-08-26RESOLUTION 85- 141 OF THE COUNCIL OF THE CITY OF FORT COLLINS MAKING FINDINGS RELATING TO THE APPEAL OF THE J. T. ROSE'S AUTOMOBILE BATH PUD, PRELIMINARY AND FINAL WHEREAS, on the 22nd day of July, 1985, the Planning and Zoning Board of the City of Fort Collins denied preliminary and final approval of the J.T. Rose's Automobile Bath PUD; and WHEREAS, that decision of the Planning and Zoning Board was appealed to the City Council by the applicant; and WHEREAS, the City Council met on the 20th day of August, 1985, considered the appeal of the J.T. Rose's Automobile Bath PUD Preliminary and Final and voted to reverse the decision of the Planning and Zoning Board. NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF FORT COLLINS as follows: 1. The proposed J.T. Rose's Automobile Bath PUD represents an acceptable infill development project which is in compliance with the elements of the Comprehensive Plan of the City of Fort Collins. 2. Traffic flow has been fully evaluated and has been determined to be acceptable both on and off the site. 3. Commercial use has been anticipated for the site as evidenced by the existing H-B, Highway Business zoning. 4. The concerns of the affected property owners relative to pedestrian and vehicular safety are valid, and the City should continue to work on a pedestrian crossing of Remington Street, and to work with the property owner to the south on safety measures for their driveway and parking area (Remington Street extended). 5. Sound levels from the proposed use should be monitored. 6. The decision of the Planning and Zoning Board to deny preliminary and final approval of the J.T. Rose's Automobile Bath PUD is hereby reversed and approval of said preliminary and final plans is hereby granted. Passed and adopted at a regular meeting of the Council of the City of Fort Collins held this 3rd day of September, A.D. 1985. ATTEST: City Clerk
