Here is the legal description of the dentention pond tract east of Parkwood

The following is in response to our conversation regarding the ditch
wash -out over the storm sewer along the most easterly boundary of
Edora Park. This storm sewer was installed to serve the Parkwood East 2nd
development by transporting storm runoff to Spring Creek.
Because the direct responsibility for this wash -out is hard to establish,
it is understood that three entities, the City of Fort Collins,
Mr. Calvin Johnson, and Everitt Enterprises, Inc. would participate
toward the correction of this problem. The City of Fort Collins and
Mr. Calvin Johnson agree to furnish both the manpower and equipment
to correct the problem, while Everitt Enterprises would participate in
a monitary sense not to exceed $2,000.00. For example, this monitary
participation could go toward the reimbursement of fuel used for the
project.
We would like to start the project as soon as possible and have
tentatively scheduled to start on Monday, April 5, 1982.
If you have no major concerns with the proposed, please initial this
correspondence representing your approval and return it to me.
I would like to thank you for your cooperation in resolving this problem
and am looking forward to working with you on the project and in the future.

Last fall Everitt Enterprises was contacted concerning the necessity of
relocating or stablizing the Eastern most fire hydrant on Stuart Street
in the Parlaw)cd East 2nd Filing Subdivision.
It appears your consulting engineer did not take into account the need
for adequate soils support at this hydrant in the design of the storm
drainage facilities. When the storm drainage system was constructed
a large quantity of earth was removed at the hydrant location. This
resulted in a potentially hazzardous situation for the Fire Departmeni;
or other authorized persons who operate this fire hydrant. Therefore,
your company needs to correct this situation.
Two possible alternatives are relocate this hydrant to a location where
adequate soil support can be obtained or construct an earthen berm of
adequate height and density for support behind the hydrant.

241.2 Rollingwood. As you know, it was necessary for us to replace 90 of the
walk which had originally been installed. This was due to the fact that the
original walk had been only 3"-4" thick. Enclosed is a copy of the bill we
received for replacing the walk.
Until we hear from you, this remains an open item. We would ,greatly
appreciate hearing from you directly so we can close the matter out.

The City has received your letter_ dated June 29, 1982 which addresses
the sidewalk repairs at 2412 Rollingwood Drive.
In your letter it was indicated that the sidewalk thickness varied from
three (3) to four (4) inches. The past and present City Criteria for
sidewalk thickness is four (4) inches. However, as you are aware there
are tiiK-s when this standard is not rant which intivertently will cause
additional costs to the property owner at some future date. It is
unfortunate that these types of situations do occur but until the City
is able to have full-time inspectors on each job during its progression
faith must to put in a contractor's workmanship.
I regret to inform you that the City will not reirburse Your firm for
the added costs encountered due to the sidewalk breakage.
Chapter 95 Article 37 of the Code of the City of Fort Collins delegates
the re_ponsi-b;_li.ty of maintenance to the property owner.
Again, I do svmnathize with your situation. The Construction Ins3Dection
Division does do its best to try and eliminate this type of prd.�l rn.
However, there are times when construction errors are macle and never
corrected.
One possible alternative for your firm is to contact the original. developers
of this subdivision, Fveritt Enterprises. Perhaps when the F rolblem is
presented to them they would be willing to reimburse the costs to you.

Dear Earl:
Our office has recently been contacted by the property owners on
Rollingwood Drive regarding the extensive sidewalk cracking adjacent
to their property.
Large quantities of the sidewalk are exhibiting longitudinal and
transverse cracks which vary in width from 1/2-inch to hairline,
with some minor elevation difference.
Several years ago when this filing was under development, a City
Construction Inspector advised the contractor not to place the
concrete curb, gutter and sidewalk due to unstable subgrade conditions.
In lieu of not placing the concrete, the contractor and Everitts
elected to extend the warranty period for a period of three (3) years.
It now is quite apparent that the extended warranty was not adequate.
In addition, the possibility exists that there is subgrade problem
which was not considered in 1976. This possibility is based upon the fact
that several _feet of sidewalk has been replaced yet, has cracked in the
same manner as the original walk.
The City Engineer's office feels the problem is significant enough to
warrant a thorough subgrade investigation.
The City is not obligated to the homeowners or Everitts to conduct
or pay for the costs of a soils investigation and the associated
corrective measures which may be needed to satisfy the problem.

The water and sewer main installations on Barnwood Drive, Barnwood Ct.,
Keywood Ct., Rushwood Ct., and Eastwood Dr., in the Parkwood East sub-
division have been inspected and approved by City Engineering Inspectors.
I would appreciate it if you would schedule all remaining water taps for
these streets at the first availability of your tapping crew. Most of
the tap locations have already been staked, and it will take less than
an hour to complete staking. I would need only about one half -day notice
to have trenches dug ahead of your crew.
I will be contacting you either in person or by phone to confirm this

Dear Pat:
The intent of this letter is to restate the City's position regarding the con-
crete curbs, gutters and sidewalks in a part of the Parkwood 1st filing. More
specifically those area's on Keywood, Barnwood Courts, Barnwood and Eastwood
Drives which exhibit longitudinal cracking along the curb face and mid width
of the sidewalk.
As you recall, Mr. Kent Early of Martin Marrietta indicated that this cracking,
in his opinion, is, a shallow surface type (shrinkage cracks) and does not create
any form of structural deficiency to the concrete member itself. However, there
is some potential for surface deterioration in the form of spalling or scaling
from the Winter freeze/thaw cycles common to our area. Mr. Earlys' recommenda-
tion was to leave the concrete in place to give the numerous freeze/thaw cycles
of this Winter time to react with the concrete.
At this time during our discussion, I informed you of the City's decision not
to accept those portions of sidewalk or curbs and gutters which are cracked.
In addition, it is Flatirons responsibility to convince the City of the concretes
integrity and durability. Any arrangements which are made betweer. your firm and
the developer are your concern and in no manner shall the City be obligated to
either party.
Again, let me restate the City's position in this matter. We will not accept
the defective concrete work in the area's mentioned previously. It is our
contention that this concrete as it presently exists will become a maintenance
problem in the future. Therefore, we will not accept the burden of added
maintenance costs to the future homeowners.
I would appreciate a written response from you addressing what course of action
Flatiron intends to take regarding this situation. Also, please indicate what
agreements your firm and the developer have made regarding possible replacement,
perpetual maintenance responsibilities, etc.

As you know the engineers we asked to examine the cracks in
the roll curb/walk in Parkwood East both concurred that they are
plastic shrinkage cracks. They stated that a plastic shrinkage
crack is a surface defect and does not effect the structural
integrity of the product. Mr. Kent Early of Martin Marrietta
stated that the only potential problem was spalling due to mois-
ture infiltration and subsequent freeze -thaw cycles. Mr. Early
went on to state that since these defects occur in the roll
portion of the product the potential for this freeze -thaw attack
is dramatically reduced. Mr. Early further stated that the poten-
tial for spalling to occur is further reduced in machine placed
concrete due to the minimal finishing required and the resulting
high surface density of the product.
Since our last meeting I have also contacted the American
Society for Concrete Construction seeking their advice on what
specific actions to pursue as regards the defects that exist as
well as how to prevent them in the future. ASCC concures that
the potential for spalling is small, but that if it does occur
it will probably happen within the first year since the surface
will tend to seal with fines. Our previous experience with this
phenomenon on Centennial five years ago tends to support this
conclusion.
As ,you stated in your letter dated October 13, 1983, it is
our responsibility to prove the integrity and durability of the
product in question. At this point we have solicited the advice
of qualified individuals and organizations that deal with concrete
and trouble shoot problems that occur with the product. It is
the consensus of opinion that the potential for problems is small,
but if problems do occur they will become evident within the first
year since concrete tends to seal with fine particles and become

less vulnerable to moisture or chemical attack. Plastic shrinkage
cracks are not uncommon and our own experience as well as industry
experience indicates that the potential for problems is greatly
reduced after the first year.
Certainly the best test of any product is its ability to per-
form over a period of time under actual field conditions. This
particular product is at its most vulnerable state and will re-
ceive its harshest test over the next two years while subject to
heavy construction traffic. Available opinion and evidence indi-
cate that if problems do not occur within the warranty period
there is no reason to assume they will occur in the future as the
potential for problems reduces with time. While the professsionals
we have contacted felt that sealing these cracks was unnecessary,
we are continuing to pursue the possibility. It is our feeling
that; the warranty period should be utilized to determine whether
or not the product has been adversely effected, as there is no
test more adequate or severe than actual field conditions.
It is certainly not in the best interest of this company
or any other parties involved to accept a product that will
become problematic. We are not asking for unconditional accept-
ance of the product but are suggesting close monitoring through
the warranty period to determine if the expert opinions we have
received are correct.

Dear Pat:
In response to your letter dated December 6, 1983, it is not the City's
intention to require the removal and replacement of the concrete curbs
and gutters in question, but, rather to place the responsibility for
determining the integrity and durability of the concrete product upon your firm.
You have stated numerous times that outside sources have been contacted and all
are in agreement that the cracking, if it will deteriorate, will most likely
occur during the first year of its life.
In addition, you suggest we monitor the cracking throughout the warranty period.
Presently, this alternative is agreeable to the City. My intentions are to
photograph the individual cracks and measure their length and width, with depth
measurements wherever possible.
We, too, feel the monitoring of these cracks is essential to determine the
concrete durability. However, one aspect of the City Engineer's office is
to insure the citizens of this community a quality product. This is especially
important for that portion of the street system which becomes their responsibility
for maintenance.
Please be informed that should any property owner desire replacement of his
curb, gutter and walk, during the warranty period due to this cracking,
we will demand its replacement regardless of the monitoring results.
At this time the City will not make any commitment towards the acceptance of those
portions of curb, gutter and walk in question, other than what's been stated in
this letter. We reserve the right to make a final decision after the monitoring
results are known but, prior to the expiration of the Contractor's warranty period.
The documentation and measuring of the cracking will start as soon as time permits.
Probably within the week of December 26, 1983.

The City Water and Sewer Department has made a final inspection of their
utilities in the Parkwood East Subdivision.
Following is a list of items which need to be corrected prior to the City
accepting, this system for perpetual maintenance:
- Manhole No. 31 on Barnwood is low, needs to be raised and regrouted.
- Manhole at Barnwood and Barnwood Court is low, needs to be raised and grouted.
- ?Manhole at west end of Rushwood is low, needs to he raised and grouted.
- Fire hydrant valve box at Barnwood and Barnwood Court needs to be raised.
- Main line valve at Barnwood and Barnwood Court needs to be raised.
- Manhole No. 16 is high, needs to be lowered.
- Manhole No. 11 is low, needs to be raised.
Please notify me prior to beginning this work, and thank you in advance
for correcting these problems.

Dear Mr. Stafford,
Several weeks ago I met with Bob Zakely at the site of the outlet
from the detention facility for Parkwood Fast subdivision. lie discussed
the need for some type of structure at the south end of the siphon under
Drake; I sent a sketch of a junction box to Phil Robinson, and we have
now received a drawing which we are reviewing.
We still have several concerns regarding the outlet to this pond.
First, there anpear to be some discrepancies between the elevations for
the outlet works shown on the utility drawings and the actual field
elevations. At the earliest opportunity, would you please provide us
with a complete profile of the outlet works from the pond to the
proposed junction box? We will need to review this information before we
can accept the detention facility for City maintenence.
In addition, I am very concerned about the present situation re-
garding the disposal of groundwater from the subdivision by pumping
from a sump into the storm drain. This arrangement is not in conformance
with the approved utility drawings, and the storm sewer has not been
sized to adequately account for these flows. Please be advised that the
use of the storm sewer as an outfall for groundwater flows pumped to the
surface cannot be approved. I am sure you are aware that the outfall
for this drainage system via the Meadows East pond is already undersized,
and the introduction of additional groundwater flows into the system
would have an adverse effect. Another suitable outlet for the groundwater
flows will have to be developed.

I have reviewed the profile information you provided for the
portion of T na glewood between Rollingwood and Cree .
The attached drawing —is a comparison o t e profiles:
one, as designed, from the utility drawings; the other,
as constructed, from your notes. Please note that in preparing
this drawing for comparison, I assumed that the elevation
of the existing P.T. at Rollingwood and Tanglewood was the
same in both cases - this should be verified on the as -
constructed drawing.
As you can see, the section between Rollingwood and the
triple catch basin is considerably flatter than designed;
in fact, the slope is less than the minimum grade required
for curb and gutter. Also, there is apparently a discrepancy
between the designed elevation at Tanglewood and Creekwood
and the constructed elevation.
While the improvements as constructed are considerably different
than the design and may result in future maintenance problems
for the City, requiring you to remove and reconstruct the
improvements according to the original design is probably not
economically justifiable. Tn accepting the improvements as
constructed, however, T feel the City should make two conditions.

First, before the improvements can be accepted, please
submit a set: of as -constructed drawings for the improvements
on Tanglewood, Creekwood and any other streets which have
been affected by these field changes. Second, please
forward a letter to Dave Stringer agreeing to extend the
warranty periods for the street and concrete improvements
on Tanglewood between Rollingwood and Creekwood one year
beyond their normal warranty periods.
We have all run into situations on construction sites which
require some field adjustment of the original design.
However, this example illustrates the fact that such field
adjustments can sometimes produce undesirable, even unacceptable
results. Hopefully, coordinating these field changes through
the City's inspectors or engineers will reduce the chances
of this happening. T trust we can rely on you and your
engineers to make certain this type of situation does not
occur again..

Dear Phil:
I have just received from Marc Enqemoen his letter concerning the curb
and gutter installation on Tanglewood Drive between Rollingwood and
Creekwood. I have enclosed a copy for your reference.
I would like you to immediately prepare the as -constructed drawings
requested in the first paragraph, page two of Marc's letter for sub-
mittal to Marc, copy to me.
Also, I do not feel the request for an extended guarantee period is
unreasonable, when compared to the cost of removal and replacement
of that whole section of Tanglewood Drive. Please be advised that
because the curb and gutter at that location was installed to lines
and grades staked by your company, any reconstruction required by the
City during this guarantee period (two years for asphalt, three years
for concrete) caused by the flat grade will be at the expense of James
Stewart and Associates.

Persuant to our telephone conversation this date, I submit
this letter of guarantee:

Creekwood Drive in th arkwo']co "Fas first Fi ing we hereby
guarantee that, upon termination of our use o ese homes
as models, we will lower the sewer access located in the
cul-de-sac at the above location and replace all pavement
in accordance with the specifications of the City of Fort
Collins. All such compliance shall be done entirely at
the expense of KEM Homes, Inc., and shall be completed
prior to the use of any of the above five dwelling units
as permanent residences.
For reference, Encroachment Permit No. 63, dated August 14,
1980 is on file in your offices, stating an anticipated life
of the encroachments described to be three years from the
date of said permit.
