Re: Landings 3rd Subdivision
As you are aware the fire hydrant elevations in the ?andings 3rd
Subxiivision, are low in relation to the curb and gutter.
It is my understanding that the hydrant elevations (with the exception
of the one at Brpa-kwater and Skysai l) , are from changas in grade on
your Lnol-,eer's part. Concerning the hydrant at Skysail and
Dreakw=3ter, Bill Harding of Kelran Constructors and I discussed
this elevation and decided that due to elevation changes by your
F'ngineers it would be best to not raise this h,.drant until after
the cu-b and cn-itter had b-en placed.
Because of the low hydrants there is a definite fire hazard in
your SLxiivision, and no more building permits can be released
until such time as the situation has been corrected.

Looked over the detention system for Landings Filing One in particular,
i and found everything to be o.k. except the following:
1. The 3-foot curb cut on the west side of Mariner Lane
was not installed.
2. The small channel cut in the berm back of the east
curb does not have adequate slope or width to carry
the water away. A 3-foot wide concrete pan with riprap
g may be the best solution.
7 3. The riprap has not been installed on the spilways from
Pond A on Spinnaker Lane and Pond B on Mariner Lane.

4. The inlet headwalls have not been installed on either
outlet for Ponds A or B.

iceprovements on your Stonehenge and Landings developments. It is
important thnt these tl,p^s of problems and the accompanying conFusion
be eliminated in areas you are currently developing such as I.indings 3rd,
Stoneh.ngc, 6th and bhalers Cove. This can best be accoaplished by
more closely Ohecinq to City ordinances pertaining to the sLlsdivision
of land.
I have enclosed for your reference a copy of that portion of the
ordinance which defines the public improvements which must be
completed prior to the release of building permits and certificates
of occupancy. Please he advised that uormits and certificates will

in all areas you currently have under development.

Pursuant to our meeting this morning, I talked to Joe Frank in
Planning to confirm our thinking on Landings Drive.
The Citv_ sees Landings Drive as having to handle "collector street"
traffic for a considerable time before J.F.K. is dedicated and constructed.
Therefore, we are asking that Landings Drive through "the Ridge" be
designed to collector street standards to withstand this traffic load
as well as to match the existing Landings Drive through the first filings
of The Landings P.U.D.

Dear Mr. Smith:
It is our understanding there is some concern regarding the effluent of
the dewatering system at the above -referenced residence.
The dewatering system is to intercept flows from the irrigation ditch at
the rear of the property and divert these flows around the structure.
These flows are directly related to irrigation, and in general, will
flow only during the summer and fall months. It should be noted that
the flow follows the bedrock formation to the lake north of the prop-
erty. Prior to construction of the residence, free water was flowing in
the cut section south of the roadway. This flow will continue to the
street section in areas where the street grade is below the bedrock
formation.
The water diverted around the residence and directed to the flow line is
an extremely small quantity and is generally continued to the concrete
gutter and pan sections. This flow would, in our opinion, be no dif-
ferent than irrigation water from the lawn reaching the gutter section
or water that will continually flow in the cut section above the roadway.
It would also be our opinion that since the water is generally confined
to the gutter and pan sections that the water would not have a detri-
mental affect on the asphaltic concrete street section. We would recom-
mend, however, that the drain be constructed under the sidewalk and be
installed with a permanent screen to prevent any type of obstruction.

I had Jim draw up three alternatives which I have discussed with
Rick Ensdorff, Mike Herzig and Mauri Rupel.:EtUise was unanimous
that alternative #2 was preferred if money was available. It was
felt that alternative #3 was a good start but should also consist
of a rework of the intersection of Spinnaker Lane and Mariner Lane.
The extra cost would make this alternative non -cost effective.
It was felt, especially by Traffic, that alternative #1 was a
signing of the condition that now exists and would not solve any
problems but would create more. Rick did offer another solution.
This solution would entail the removal of the "Keep Right" signs,
addition of two "Stop" signs at the end of the 20-foot wide Spinnaker
Lane and street striping across these intersections. The cost of this
project would be approximately $200.00. He feels that this proposal
should be done regardless of any decisions to do any other work
and would like to know if you concur as soon possible.
Jim is ready to prepare any additonal graphics that you might
require.

Gentlemen:
This is to advise you that Detention Areas "C" & "E", Stonehenge 4th
Filing, Fort Collins, Colorado, have been graded. Detention Area "E"
has been graded according to the Grading Plan by Cornell Consulting Company
except the outlet weir has not been completed. The pond has the planned
detention capacity and has been landscaped. Detention Area "C" has been
graded to contain the planned detention capacity, however, the outlet
flows over the top of the walk into the South gutter of Stonehenge Drive.
The earth berm has been raised to compensate for the bottom of the pond
being raised. The developer eliminated the pipe in order to construct
a tennis court on Tract "A" near Lots 8 and 18.

TO WHOM IT MAY CONCERN:
It has been brought to my attention that the detention pond adjacent
to Lot 35 and the Larimer Number 2 Canal has not been constructed.
In reviewing the subdivision agreement for Landings 3rd Filing dated
May 24, 1978, all storm drainage improvements were to be completed
prior to the release of 18 building permits and 9 certificates of occupancy.
Currently there are more homes constructed in this area than what was
stipulated in the development agreement. Yet the drainage system has
not been completed. In addition, with the construction of the home
on Lot 35 which is adjacent to Tract E, it appears this would be the
best time to construct the pond and cause the least impact to the
neighborhood.
Please be advised that the City is now requiring the completion of
the drainage system within the Landings 3rd Filing development.
Until such time as these improvements have been completed or a proposed
schedule for the completion of the required improvements has been
submitted and approved by the Storm Drainage Department, no further
building permits will be issued for this development.
I regret the inconvenience this requirement may impose upon you,
however, the number of homes presently constructed in the Landings
3rd Filing warrants the need for the completion of the drainage
improvements.

EXECUTIVE SUMMARY:
On behalf of the owner, the applicant has requested the vacation of
a portion of the rear lot utility easement on Lot 62 of the First
Replat of the Landings, 1st Filing. The Owner is constructing an
addition to the existing deck at the rear of the house as shown on
the attached sketch. The deck encroaches into a portion of the 10
foot wide rear lot utility easement.
All public and private utilities have been notified of the proposed
vacation. The only existing utilities in the easement are
telephone and cable television. These utilities had no objections
to the vacation request since the deck will be more than 2 feet
from the existing telephone pedestal.

Dear Mr, Parsons,
This will confirm our conversation this date, with regard to
submitting final plats and final utility plans on the following
two (2) projects.
1. Stonehenge. We agreed that at this time a final plat for
part of the PUD would be acceptable, along with comparable
final utility plans. These will be submitted as the Fourth
Filing and will consist of Lot# 1 thru Lot# 28 of the total
PUD plan.
2. The Landings - Phase I. We agreed that at this time a final
plat along with final utility plans would be acceptable for
the 36 Cluster Single Family lots, plus 13 Estate Lots as
part of the total Phase I PUD.
In each case this is with the understanding that a complete final
plat and final utility plans will be submitted within a specified
period of time, thus allowing for a conditional utility agreement
to be established at this point in time.

Re: Installation of the Warren trunk line sewer
Gentlemen:
In In a meetin; hold on Nov 25, 1977, the Warren trunk line sewer scheduling,
LOOS, repayment, and construction, u s discussed. Reid Rosenthal explained
to the grouch the scheduling and cos': problems now associated with the Land -
log: prom-ct which could he alleviated with installation of the trunk line
lcwcr. The cost problems involve the construction of an entire second sewer
Iinu on the west side of the Landings proiecL, Phase 1, and the construction
A f a sewer main down IlorsetouL h Road. Purther, the grades required to in-
:urc gravity !low to Lhe manholes at Stover and Ilorsetooth Road necessitates
raising four cul-de-sacs in the Landi-i,gs, Phase 1, by three to six feet.
Iris would necessitate 17,000 yards of compacted fill for the roadways and
an additional 25,000 yards of fill to be placed around the basements of the
homes on these cul-do-sacs.
In addition, a lilt station would have to he i-nstalled to lift sewage from
the eastern Lino to the wetern line for garvity flow to Ilorsctooth Road.
By conservative estimates, the developer could save 1w104,000, or more, by
simoly putting, in one eastern line running along the low points of Phase 1,
crossing; tho inlet ditch to Warren Lake, and then extending eastward through
Phase 11 to L(mavAvenuc where a tic -in could be made with the trunk line
sewer. Besides saving; the developer money, the costly installation and
maintenance of a lift station, and the problems associated therewith, could
be eliminated for both the City and the developer. this simplified plan
would allow all the homes in Phase I to flow eastward to the trunk line,
thereby assisting; the City in its repayment plans for the trunk sewer line.
The problems of coordinating the first occupancies in Phase I of the Land-
ings with a tic -in to the trunk sewer line was also discussed. It was felt
by the developer that the first occupancies would he in November, approxi-
mately ::ix weeks ahead of the January I, 1978, minimum tie-in date proposed
by the City. Roy Bingman, Tom haves and Reid Rosenthal agreed that in the
event of occupancies preceding trunL line sewer tie-in, a properly sized and
enyincered holding* tank could be installed to handle the few units that would
have early occupancy. fhis tank would be located at the proper grade, and
future maintenance for the few months involved would be the sole responsi-
bility of the developer.

Reid Rosenthal explained to Bill Tiley and Bill Day, developers of the
McMurrax farm to the east of the Land�i_pSs project, that his main concern
wns grade point of the trunk tie-in and -not the exact location of the

project, without boring hampered by particular casement locations.
In discussions with Rug Bingman, Tom 1layes and Lloyd McLaughlin, the
developers explained their wish to proceed quickly with the sewer line
cxtcnsion. It was generally Pelt that because of rising costs, poss.i.-
hle delays in development and construction time, and the low water level
of this particular summer, the Projects should proceed as rapidly as
possible.
Roy and Tom explained that their departments were snowed under at this
time and could not possibly proceed with design and construction of the
trunk line sewer with any hopes of maintaining a tight schedule. The
developers agreed that after consulting with the other two landowners
involved, tiny would be willing to proceed with the hiring of a consul-
tant who would design the trunk line sewer and perhaps go as far as
putting the project, to bid by privai^ companies. It was made clear,
however, by the developers, that before work could proceed a repayment
schedule from the City to the developers for work done must be agreed
upon. It was further stated that work should commence only after art
March drew agreements providing for the repayment by the developers
to the City for the costs of the trunk line sewer as hookups were made.
Tiicy and Day explained that design, casement requirements, and bidding
could he accomplished in most cases simultaneously, to speed up the
installati_o°i of the line. In the meantime, City Officials could proceed
with the approvals and annexations necessary to installation.
It was agreed that the developers would call a meeting of the four land-
owner_; involved to establish a specified procedure for getting the neces-
sary wait done. Preliminary *proposals and, perhaps, draftings would be
submitted fo the City by Alonday, junu G, 1977, in Kine for the scheduled
June 9, 1977, meeting, between developers, engineers and the water depart-
ment concerning the next steps to be taken on the trunk line sewer.

This will confirm our meeting 6-21-77 wherein we discussed details
pertaining to approval of Utility Plans. In particular, it was
agreed that curb walk will not be required on the north side of
Spin Drift: Court or on the West Side of Mariner Lane. Lloyd Mc
Laughlin of your office and Paul Deible of the Planning Office
also sat in on this decision and agreed.
Therefore, the Utility plans are being revised to show curb and gutter
only in these two cases.

Dear Mr. McLaughlin:
This letter is in regard to our recent conversation and a preliminary
discussion between Chuck Liquin of the cities Water and Sewer Dept.
and myself, regarding sewer line underdrain requirements.
In view of the fact that test holes have been dry, it was generally
agreed that underdrain gravel could be eliminated provided that we
stay with the city's standard bedding detail for PVC pipe. The only
other condition is that there be a drain line or "french" drain from
the lower end of the line to a surface point to allow accumulated
water to escape.
Should you have any comments or questions regarding this, please

Dear Don:
We are transmitting herewith the final construction plans for
Filing 1 of The Landings.
As you recall, this project has final city council approval
contingent upon your approval of the utility plans. In addi-
tion, you had allowed us to make our initial submittal with
sewer line layout only. This was to allow no time to firm
up an elevation which will allow flow to the Warren Lake Trunk
Sewer. During the past few weeks we have had confirming con-
versations with John Effinger and Chuck Liquin assuring us
that we can design our line for a minimum slope condition
and be confident gravity service is possible. In that light
we have designed our entire main outfall line, using 10 inch
diameter pipe at a slope of 0.28 percent with 0.1 ft. or 0.2
drops only where we have sharp bends or more than a single
line into the manhole. This will minimize any impact upon
the depth of the trunk sewer line.
Therefore, we have proceeded to show both plan and profile
design of the sanitary sewer on this particular set of plans.

Dear Reid:
On May 8, 1979 during the last storm, I drove through your Landings 1st
subdivision to check your detention systems in use.
I observed that neither the outflow on the west side of Mariner or the
inflow at the cross pan on Mariner Drive were working properly.
The storm waters were being detained in the street rather than to the ponds.
On May 10, 1_979 I again inspected the streets throughout this subdivision
and noted nuaierous areas of subgrade failure due to the inadequate drainage
of the detention systems. For this reason the City cannot accept the
streets in The landings subdivision for maintenance until all areas of
street failure have been repaired.
The City must also have a letter from your engineer stating the detention
systems are built and graded per City approved plans, when work on these
ponds is completed.

diffi(nItics was discussed. It was pointed out by Phi_I Robinson
or Stewart if Associates that their preliminary estimates, while not
actually bids, pointed CO the trunk line costing a total OF $990,000 +,
a figtrc in excess of initial projections. Part of this increased
cost was attributed to the increased depth of the sewer across the
southern portion of the Landings project and on Lcmay north of
Warren Lake.
Roger Krempel and Reid Rosenthal discussed the fact that this increase
in depth on Lcmay was due primarily to the depth of the sewer necessary
io serve the northwestern portion of the Landings on Ho'rsetooth Road.
t y further agreed that it would be unfair, despite the agreement
alruNdy in effect, to assess the other developers involved with the
trunk the extra expense of that added depth. John Effinger pointed
out that it was possible to considerably raise the sewer through
the southern part of the Landings and still provide for a proper
depth crossing of College Avenue. This raising would be facilitated
by a drop manhole at the sewer outfall point on Lemay Avenue. The
group agreed that an average of three feet in depth could be saved
through the IS00' length of the southern Landings sewer.
Ilo,.ace Muyurs then brought up the suggestion that a lift sintion Uc
installed near the Warren Lake inlet crossing separating Landings,
Phase I, and Landings, Phase H . The group concurred that this would
solve several basic problems for the City, the Landings, and the other
developers. First, the 700' of trunk sewer on Landings could be lifted
an average of 1.5' with increased .savings in cost and time. Secondly,
the problem of assessing extra costs to any developer or group of
developers for the increased depth of the trunk would be alleviated.
Third, the installation of the lift station would save. the Landings
considerable depth throughout portions of its internal system, and
the cost savings reflected there would out -weigh the extra initial
cost of the lift station itself. Roger Krempel made it clear that the
lift station must have an auxiliary power source in the event of a

Utility Plans
Dear Mr. McLaughlin:
This is in response to our telephone conversation earlier today
regarding changes which were made in the utility plans follow-
ing your earlier review. The original drawings were submitted
to you August 19, 1977 as per letter dated August 17, 1977.
The following are the basic changes made, other than those
requested by your earlier review.
1. Valves were shown on the 6 inch water line loop into
Spindrift Court, where they were thought to have
been overlooked. We now understand that these valves
are not desired, therefore they will be deleted as
per our conversation.
2. The 20 inch valve east of the 20"xl2"tee at Landings
Drive was deleted. This was based on the fact that
water service to the Landings project will be looped
back to Horsetooth Road and ultimately to Harmony Road
and College. The Horsetooth Road tie being anticipated
in a comparable time frame with the tie at College Ave.
and Horsetooth Road.
3. In coorinating our project with other projects on the
north side of Horsetooth Road, we determined the

50"x3l" arch culvert, which was previously designed
as part of the Strachan Project, was much larger than
currently allowed for storm detention release.
Therefore, the arch culvert was deleted. In lieu of
this, the existing 15 inch CMP is being extended rather
than plugged, and the 12 inch pipe extending across
the intersection is being added to complete their
detention discharge arrangement. This culvert is
being shown based on preliminary information provided
by James H. Stewart and Associates relative to their
work on the adjoining project.
4. The street width on Landings Drive has been changed from
54 feet to 44 feet in accordance with earlier discussions
with the city staff.
5. The following changes have been made on a sheet by
sheet basis:
Sheet 2 - Revised the typical fire hydrant detail
for clarification of valving.
- Added storm drain crossing.
- Manhole 12-A will be removed and
relocated to proposed location
under filing No. 2 Utility Plans.
Sheet 3 - Added sidewalk detail on Spindrift
Court, to show transition.
Sheet 4 - Note for clarification in locating
sidewalk transition.
Sheet 5 - Added storm drain crossing.
- Manhole 12-A will be removed and re-
located to proposed location under filing
No. 2 Utility Plans.
Sheet 6 - Adjusted flowline curb profiles between
Station 9 + 75 to 11 + 03.8 to allow

We are enclosing information which represents our final analysis
of the discharge from Phase I of The Landings. This is intended
for your review and relates to your letter to Mr. William Stover
dated July 27, 1977.
In addressing your specific requests for additional information
we are providing the following information:
A topographic map of the subdivision.
--In addition to the 1 ft. contour topographic maps
provided to you August 8, 1977, we also are enclosing
the overlot grading and detention plan sheets.
A map showing hydrological basins.
--A sheet titled The Landings PUD, Detention Plan is
provided to show the total detention plan, including
the individual hydrological basins.
Calculations with hydrology data.
--A computer printout is provided to show a minute -by -minute
development of inflow and discharge from each basin,
including the combined impact on each primary basin
(Basin "B" and Basin "F").
References to specific methods such as the CUHD method
or rational formula.

--As was indicated in the May 26, 1977 report we used
the tables which were included in that report and which
are provided by the City of Fort Collins to obtain the
required detention storage volume. To determine the
release rate allowed for detained water, we are re-
quired by the city again to use the rational formula
based on the two year storm curve, using historic or
undeveloped conditions. (The rainfall intensity
curve was also included).
Design details of the detention basins and outlet
control structures
--This information is provided in the form of four (4)
sheets of the utility plans for Filing I and two (2)
sheets from Filing II.
Lagging of Flows.
--The computer printout data shows the detention storage
accumulation based on controlled inflow and overflow
inflow, and the controlled release and overflow rate
on a minute -by -minute basis. The initial data assumes
the storm to be underway and runoff starts at minute 1.
There is no mention of the impact on the reservoir
itself and flows contributed to the reservoir.
--This information is provided by the Summary of Runoff
Data which is compiled using the information from the
computer printout.
We are very anxious to receive your response. The City of Fort
Collins is holding up approval of our construction drawings until
we have made the results of your review available to them.

Gentlemen:
At a meeting held September 13, 1977, to discuss the installation
of a 20-luch water line along Horsetooth Road to service the
Landings, it was decided that a list of contractors would be
supplied by Lloyd McLaughlin, and that this list would be the one
used for bidding said project.
It was explained to the group by Reid Rosenthal that time was of
the essence. Bid documents would be prepared by Harry Cornell as
quickly as possible, with work hopefully commencing within two
weeks of the meeting date. Fast completion of the project is necessi-
tated by the need for fire protection for structures in their framing
process. Rosenthal's other option is to install a rather costly
temporary pump station in the lake with a line extending to the con-
struction. site. It was agreed that because time is such a critical
factor it this project, that the lowest bid would not necessarily
be the one accepted, although any bids accepted by Reid Rosenthal
would be approved by the City using a comparison of the installation
of 20-inch line on Drake Road by Rex Miller earlier this year.
It was decided that the bid documents would be mailed with Return
Receipt Requested and that the contractor would have one week to
bid the project. The availability of pipe was discussed and Chuck
Liquin suggested that Reid order the materials necessary for the
project and assign them to the contractor awarded the bid in order
to save a week or more of delivery time. Either 50 or 52 ductile
iron would be accepted by the City. harry Cornell commented that
Horsetooth Road would be slightly shifted to save the trees along
the North edge of the Landings project and this might necessitate
a light shift in the water line. In addition, there are S utility
lines now running along the south side of Horsetooth Road including
two gas, two telephone, and one Davis County Water line. Harry
Cornell suggested that these utility lines might also necessitate
a slight shift in the installation, and this was agreed to by all
parties.
Ed Hilgcnberg concurred with Reid in the ordering of necessary
valves from the Denver water board, or other available sources in
order to meet the construction schedule.

As progress has been made in preparation of the Warren Lake Trunk
Sewer Line by James Stewart Consulting Engineers for developers
proposing to utilize the sewer, the cost estimates for the project
are becoming more accurate based on better information. Getting
onto crop land has prevented final plans and final cost estimates.
Nevertheless, Reid Rosenthal representing Landings Limited, who
will hear, the largest cost in the trunk line, desires not to lay
the last or most westerly stretch of sewer 22 to 26 feet deep to
provide a gravity sanitary sewer solely for his Landings Development
and wishes to lay a shallower sewer and lift the sewage with pumps.
The Sewer Utility has steadfastly refused to accept a sewage lift
station in the City system when a gravity sewer can be made
available.
Rosenthal has proposed that the lift station be approved with
conditions that the City is to be totally free from any cost or
responsibility for a lift station in his development.
An agreement setting forth such conditions has been drafted and the
Utility staff approves of the agreement subject to legal and Council
approval. Rosenthal's reasoning for proposing the lift station are
outlined in his letter dated September 14, 1977.

Gentlemen:
This letter is to discuss with you our agreed upon installation of
a lift station tc be located in the Third Filing of Landings and
to be maintained at no City expense for the duration of its existence.
Though lift stations have for the most part been frowned upon by
the City of Port Collins, the topography of this particular piece of
development ground makes the installation of the lift station man-
datory for cost-effective development of both Landings, and of the
Warren Basin trunk sewer line.
Basically, -here is no other piece of land in the Fort Collins area.
with the topographical characteristics of the piece of ground sur-
rounding Warren Lake. Without the lift station, sewer depths could
reach 22-26 feet, thereby creating extra cost for both the City, the
other developers involved in the trunk line, and Landings, itself.
In addition, there could be possible problems with underground water
siphoning from such a deep line from Warren Lake Reservoir. With the
installation of the lift station, with no cost to be born by either
the City or the other developers involved in the trunk Line Project,
a great amount of this depth can be alleviated both in Landings and
in that portion of trunkline in Lcmay. Also, possible water siphoning
from Warren Lake would be eliminated. Maintenance of this lift
station will be completely without City part-icipation, with the
initial cost to be born by the developer and eventually by the home-
owners association. The homeowners association involved in the Landings
will be a large and financially affluent organization. Cross income to
the organization should comnrisc approximately $180,000 per annum at
the project's completion. liven after maintenance of green areas a
very sizeable sun of money will remain in the organization's treasury.
The cost of running the lift station on a monthly basis can be as low
as .$150 per month according to my engineers.

Dear Reid:
I have received a request for engineering clearance of certificates of
occupancy on Spin Drift Court, Landings 1st. A site inspection indicates
that the following public right of way improvements have not been completed:
1) Vertical curb and gutter installed along Horsetooth Road
2) Seven (7') foot meandering concrete sidewalk installed along Horsetooth Road
3) Road base and navement installed on Horsetooth Road
4) Manholes and valve boxes raised to finished grade on Spin Drift and
Iorsetooth Road
5) Seven (71) foot concrete walk installed from Horsetooth Road to Spin Drift
6) Street cleaned of dirt and construction materials
In addition these are many items still incomplete in other areas of the
Landings 1st which you have been made previously aware of but have not yet
taken any action on. These include:
1) Suhnittal of an as -constructed set of engineering drawings showing changes
in the public right of way constructions in the intersection of Horsetooth
Road and Landings Drive, particularly the water main which is directly
beneath the curb and gutter. This water main configuration has not been
approved by the City and may not be.
2) Tnstall a four (4') foot sidewalk along the east side of Landings Drive
as shown on approved utility plans.
3) Complete detention ponds on Mariner Lane to conform with approved utility plans.
4) Grade drainage swales from cul-de-sacs so that water will flow from these
streets into the detention ponds.
5) SuYmit written verification to the City Engineer from your development
engineer that the detention systems (ponds and swales) are constructed
according to approved utility drawings and are to correct grades and capacity.
6) Repair the streets in the subdivision which have deteriorated due to ponding
water as a result of the detention system not being properly graded.
7) Raise manholes to finished grade in the intersection of Horsetooth Road
and Landings Drive.
8) Place rip -rap at the outlet of the drainage pipes at Horsetooth and Landings.
9) Place traffic delineators along the south side of Horsetooth Road on the west
side of Iandings Drive to prevent traffic from going into drainage swale.
10) Clean pipe inlet at southwest corner of landings Drive and Horsetooth Road
to allow complete drainage.

Any possible malfunction of equipment could easily be born by the home-
owners association. Most importantly, all members of the Association are
tied legally to the support of the lift station. This has been accom-
plished through the use of deeds for every piece of ground out there
which are specifically encumbered by the covenants which will be of
record with the Larimer County Courthouse. These covenants, besides
spelling out a strict set of esthetic requirements and organizational
procedures, refer specifically to the maintenance of certain facilities,
namely the lift station, by the homeowners association for perpetuity.
Sets of covenants are given with the sale of every lot and h,.e and also
references( in the contract for that piece of ground and structure.
To make the system as fail-safe as possible, provisions have even been
made for an alternate energy source in case of blackout; namely a
generator unit. The system, in addition to its vast practical,
construction, and economic advantages to both the developers and to
the City will serve one more important function. It will have a decided
economical effect on the consumer. In this developer's professional opinion,
the additional cost of a lot in certain sections of Landings without the
system could be increased as much as $5,000 per lot. Amortized at 90 on
a 30-year basis, means that the eventual cost of not putting in a lift
station to consumers could comprise close to $14,000 over a 30-year period.
It is my feeling that most consumers would rather not be involved in a
front end expense such as this and in addition would rather amortize
their expenses at a rate of ONUS per month for the duration of their
stay in their residence. Fm cially, if homeowners fees were also being
applied to recreational facilities and large park areas. As a matter of
fact, the cost to an individual homeowner in Landings, assuming 1400 units
upon completion of the proiect and a $200 per month operating cost for the
lift station, equates to 14.3t per month for the operation of this lift
station. A small price to pay to live in such an environmentally perfect
location.
I appreciate your consideration in this matter and the concerns you have
expressed over the maintenance and economic factors of the installation.
I feel you have made an excellent decision in ,your approval of the instal-
lation and I thank you for your time as do the other developers involved
in the trunk line.

RE: Seviage Lift Station in the Landings Subdivision'
I became aware recently that a sewerage lift station is being proposed
for the Landings Subdivision. The lift station has been proposed by the
subdivider on 'he basis that it is a less costly alternative than it would
be to provide gravity sewage service through a trunk line extension. It
has been estimated that the cost of installing the sewer trunk line at
sufficient depth to serve this subdivision would be an extra $200,000. The
developer is saying that the cost to the homeowners would be less in the
long run by using a sewage lift station than it would be by expending the
$2.00,000 to se^ve this area through a gravity sewer.
From the standpoint of the sewer utility, the operation of a lift station
is expensive and, generally speaking, a maintenance problem. On this basis,
the Water and Sewer Department has said that they do not wish to accept the
sewage lift station as a maintenance item by the City. The developer then
proposed that -.he Homeowners Association would provide for the maintenance
and cost of operation of the sewage lift station without any City involvement.
I feel that this proposal raises several points which should be addressed
by the City Council:
(1) Even though there will be a stipulation in the deed for each
individual piece of property in the subdivision to cover the
homeowners fee, which will include the cost of operation and
maintenance of the lift station, it seems to me that the average

(2) Even though the Homeowners Association and the property oviners
are legally bound for the maintenance and operation of the lift
station, there is the possibility that in five or ten years, the
Association might question whether the City should have required
the Homeowners Association to be responsible for the operation of
this lift station. It appears to me that a future City Council
could feel that this was an unnecessarily large burden placed
upon the Homeowners Association.

(3) This might set a precedent for other subdividers to avoid the
costs for sewer trunk extensions through the use of lift stations.
(4) There is no guarantee that the cost -savings resulting from the
installation of the lift station will, in fact, be passed on to
the purchasers of property in the subdivision.
(5) The cost of operation and maintenance for the lift station will
increase in the future. Although this expense may be nominal
in the early years of operation, the cost could be substantial
if it is necessary to overhaul or replace expensive pumps and
motors or standby equipment.

Apparently, there was a real communication problem yesterday
concernin, the meeting I mentioned to _you Monday morning, and
of which you. were then unaware.
OJudy, from the City Engineer's office, phoned my office on
October 17, 1977 and asked to set up a meeting with the Warren
Lake Board of Directors in Roger Krempel's office in. the Service
Center on October 26, 1977. This date was out of the question
for the 1,resident of Warren Lake Reservoir Company, and the
meeting was rescheduled for 11:00 A.M., Wednesday, November 2,
1977. We were advised that many of the City staff would be
present. When we arrived, only H. R. Phillips and Chuck Liquin
were present.; but we enjoyed the coffee.
As I understand it, this meeting was in response to my letter,
mailed "certified mail - return receipt requested", to the
Acting City Manager, dated April 8, 1977, and my follow-up
letter of July 27, 1977,
The Board of Directors of Warren Lake is truly concerned with
the continuing development by the City and approval of plats
for development with what we consider to be totally inadequate
recognition of potential flooding problems.
We feel that. it is imperative that the City exercise a cooperative
approach to the problem and be cognizant of the problems and
burdens being placed on the Reservoir Company and the pressures
being applied by the State Engineer's Office.

This is to confirm our conversation during a meeting at Roy
Dingman's office Thursday March 30, 1978.
Due to realignment of L01ay Avenue at the connection with
Breakwater Dr. at the east entrace to Landings Filing 3, our
proposed manhole tie is approximately 100 ft. from a manhole tie
as proposed by the Warren Lake Trunk Sewer design.
Since we only have 0.5 ft. of drop built into the approximate
3,000 lineal feet of ten (10) inch line through Filing 3, we can
ill afford to use up approximately 0.3 ft. of this to make the
100 ft. connection. Thus you agreed to coordinate a change in
the elevation of the proposed manhole elevation for the Trunk
Sewer from 4974.40 to an elevation of 4974.10 , thus not imposing
undue constraints on our design.

The City has been very cooperative and has released certificates of
occupancy within The Landings 1st since May of 1978 even though many
of the required public irprovements for the area were not completed.
We are now at the point, however, where there are few remaining hares
to build in this filing, and there are still many public improvements
not yet installed or correctly completed. For this reason I do not
feel the City can justifiably release further certificates until
such time as all public improvements are capleted as shown on approved
drawings and per your signed utility agreement.

Dear Roy:
This is in reference to our conversation on June 1, 1978 about PVC
pipe in deep trenches.
It has recently come to our attention that the trench width being
excavated on the captioned project is greater than the plans or the
City specifications permit. Cornell Consulting Company takes the
following position in this regard:
1. The pipe should be installed according to the
approved plans.
2. Failure to conform to the specified trench width,
according to our calculations, will result in
pipe deflections exceeding 2%.
3. Enforcement of the contractor's adherance to the
plans and specifications is not within the scope
of Cornell's responsibilities at this time.
It is further our opinion that neither Cornell nor the owner should
be liable for consequences of construction not performed according
to the approved plans.
Please give me a call if you have any questions or would like any
further information.

Below are listed the concerns you voiced on our projects. I have noted
dates on which you may expect completion of the work involved, weather
permitting.
I. Curb $ gutter, sidewalk, and paving on Horsetooth Road.
I believe you have a letter from Sterling Paving saying that they
have been contracted for the work, and it will be done as per the
utility agreement no later than October of 1979. I have talked to
the City Attorney and Roy Bingman and it is their opinion that C/0's
may not he held up due to improvements listed in ,your letter. I
will therefore expect clearance for all C/0 and building permit
requests as soon as possible.
2. Harry Cornell is in the process of submitting an "as constructed"
set of engineering drawings for the intersection of Horsetooth Road
and Landings Drive. I would expect this to be in your office within
the next 5 to 10 days.
3. Install a 4 foot sidewalk on east side of Landings Drive. We have
submitted an application to Council to delete this sidewalk, and to
place it, instead on the west side of Landings Drive at the time
�Iandings Drive is constructed to the John F. Kennedy Parkway.

Cornell is in the process of submitting the written verification you
requested that our detention systems are constructed according
to the utility drawings and are to correct grade and capacity. The
detention systems themselves, including concrete wash basins,

the downstream side of the underdrains, the drain structure for the
larger detention pond below the tennis court, will be finished
within the next 10 days, weather permitting. Traffic delineators,
and cleaning of the pipe inlet of Landings Drive and Horsetooth Road,

Dear Mr. Stringer:
Mr. Reid Rosenthal has asked our office to respond to your letter
addressed to him dated May 10, 1979.
On May 25, 1979 a visual inspection was made at which time a memo
was submitted to Mr. Rosenthal stating those items which should
be completed in order to comply with plans as approved. A copy
of that memo is enclosed for your information.
On May 30, 1979 a second inspection was made during a rain storm
to see if there might be other concerns. From that, I have con-
cluded that by following our recommendations the system will
function properly.
In regard to your comment about subgrade failure -- there has
been some: failure most particularly along the west edge of pave-
ment on Mariner and immediately adjacent to the crosspan gutter
on Mariner. In my opinion, the failure immediately adjacent to
the crosspan is the only one that has any relation to the detention
system problems. Along the west edge of Mariner from Landings
Drive to Spinnaker Lane, the gutter is functioning properly and I
can only conclude that these failures are more closely associated
with another cause such as consolidation of subgrade prior to
placing the pavement section (a yielding subgrade).
These low. spots do tend to follow the water main alignment in
Mariner which may be another consideration.
