Dear Les,
The purpose of this letter is to clarify the difficulties which the City
staff has with the street configuration which was proposed for the Lake
Street Townhome P.U.D.
The issue in question is that of the curves in the central area of the
P.U.D. It is felt by the engineering and traffic staff that the curves
create a hazardous situation. According to our background data, these
curves are adequate for vehicular speeds up to only 10 miles per hour.
Beyond this speed, drivers will tend to drive through the middle of the
street area or even on the wrong side of the street. This speed constraint,
coupled with the limited visibility at the curves creates an unsafe condition
that would be difficult to correct after the project was built.
At our meeting with you on April 26, everyone present agreed that the street
configuration was not desirable, and several of us felt that it was unsafe,
or that it could lead to vehicular conflicts resulting in accidents. We feel
the safety concerns are more important to address and correct than the concerns
about through traffic using the street as a short cut.
Mr. Brad Smith presented a plan with revised curves. We have reviewed this
plan and find it to be a significant improvement, in that it allows for a
reasonable speed, with better sight distance through the curves.
Our preference is still that the street be private, rather than a dedicated
public street„ because of parking configuration and overall layout of the
P.U.D. To help differentiate between the existing portion of Summer Street
and the P.U.D.. we suggest "necking" the street as shown in the attached
sketch.
We hope that this answers the concerns you expressed on behalf of your clients.

I hope you can forgive me for delaying so long in answering your request to
give you my interpretation of the sequence of events which led to the delays
in approving the subject subdivision utility drawings.
We, in Engineering, first saw this project at Conceptual Review on December 4, 1978.
At this review, I expressed the opinion that the proposed street connecting west
Lake Street with SURnLr Street should be a public local street designed as such.
It was, and is my opinion that university students will use the street as a short
cut going to and from the university and points to the southwest in the city.
The project went to P&Z Board on January 8, 1979 even though I objected, in writing,
to the Planning office about the layout of the street. In fact, I was not aware
that it was going to the board with a recomTendation of approval. Without my
knowledge, the Planning office met with the Traffic Engineer and worked out
what was reported as an acceptable design. I had not seen this design prior
to the board meeting and after a quick look, I expressed to the Director of
Planning and Development that the redesign still was not, in my opinion, acceptable.
The project went to Council as a preliminary on February 6, 1979 even though we,
in Engineering, continued to express our strong objections to the street design.
Bear in mind that the preliminary plans did not have dimensions of sufficient
detail to ascertain if the design curve data, sight distances and/or drainage
and water and sewer locations as sketched could work. Since I did not receive
a "packet" of the Council agenda, I assumed that our objections would be presented
to Council and that the project would be reccmTended for denial. Imagine my
surprise when Council approved the preliminary plan.
Utility drawings were received in Engineering on March 30, 1979 at which time
eight subdivisions preceeded this one in the review process. Review comments
from the various City departments and utility companies were received as follows:
Light and Power 4-5-79
Water and Sewer 4-12-79
Public Service 4-12-79
Mountain Bell 4-16-79
On April 6, 1979, I replied to the Planning office, in writing, that the proposed
street design was unacceptable.

Dear Mr. Waido,
On behalf of the partners of the Lake Street Townhouse P.U.D.,
we wish to request two 6-month extensions of said P.U.D.
E_ The partners were never informed by anyone at the City or by
anyone doing work on the project that the P.U.D. had an expiration
date. Ignorance is not a basis for requesting the extension, but
if any one of us had known that the P.U.D. would expire, we obviously
would have applied for the necessary extensions.
