MEMORANDUM

RE: Termination of Active Status for Inactive Development Proposals
There is a need to clear our official records of various development and
zoning items that have been officially started. At the present time these
items are listed in the Planning and City Clerk's offices as items pending
final City Council action. We on the staff feel that once a subdivision has
been initiated and reviewed in preliminary form before the Council, or a
zoning petition requested, the Council minutes should indicate that these
items are terminated.
Enclosed is a memorandum from our Planning Department with regard to the
following three items:
1. Lake Sherwood Subdivision, Fourth Filing, Final Plat. This plan was
approved by the City Council on March 2, 1976, conditioned on staff
approval of the utility plan. Utility plans were never submitted and
the proposal is no longer being pursued by the applicant.
2. Amendment to Harvard Subdivision, First Filing, PUD. This site plan
was reviewed by the Planning and Zoning Board on October 4, 1976, and
given a recommendation for conditional approval. These conditions
were never met because the proposal is no longer being pursued by the
applicant.
3. Replat of Lot 4, Tennyson Heights. At the March 14, 1977, meeting, the
Planning and Zoning Board recommended denial of the replat and explained
to the applicant that the replat could not be approved because it did
not meet the requirements of the subdivision ordinance. The staff also
explained that replatting would not accomplish the applicant's objectives
anyway. The applicant has subsequently requested that the replat be
withdrawn from consideration.
Recommendation: The Administration recommends that the City Council 1) officially
deny the Final Plat of the Lake Sherwood Subdivision, Fourth Filing, 2) deny
the Amendment to Harvard Subdivision, First Filing, PUD, and 3) accept the
withdrawal of the Replat to Lot 4, Tennyson Heights.

RE: Certificate of Occupancies, Sherwood Shores, Fort Collins, Colorado
Dear Mr. Bingman:
Monday, November 12, 1973, an inspection was made by the inspection
department City of Fort Collins, at our project. This inspection was made
on curb and gutter. Due to circumstances beyond our control, there has been
a certain amount of settlement, which has created cracks and some uneveness
in the curb line. We are taking immediate action to rectify these curbs,
and see that they meet the standards of the City of Fort Collins. However,
we're presently trying to secure certificates of occupancies, so that the
owner may take over the project in order to sell the units that are finished.
I respectfully request that since the curbs did not pass inspection, that
this curb inspection be waved temporarily so that we may secure certificate
of occupancies. I will give you any assurance that you may require that this
work will be done and will meet the City of Fort Collins specifications and
standards. Your help in this matter will be greatly appreciated.

Dear Dennis:
It has come i=o my attention some of the paved areas in the Lake Sherwood,
3rd Filing, are showing signs of premature deterioration. As these streets
were raved in June of 1979 they are still under your contractor's warranty
period.
Please be informed before the city will accept the streets in this sub-
division for maintenance, the necessary repair cork will have to be
completed.

During a recent visit to Lake Sherwood, 3rd Filing, I noticed that the
street repairs required before City acceptance had not been started.
In a letter to you dated April 24, 1980, I notified you of premature
deterioration of some areas in this subdivision. In May of 1980, I
met with Skip Jodvin of your cony on the site and marked the
deficient areas.
I feel that nine months fran written notification is far too long to
wait for warranty repairs. However, because of the time of year and
the weather, I realize that repairs can not be made until the 1981
construction season begins.
In order for me to consider possible courses of action pursuant to
Section 95 of the Code of the City of Fort Collins, I would like to
have written notification of your canpaxiy's intent to perform the
necessary street repairs. I would also appreciate it if you would
specify a date that repairs will be canpleted by. If I do not receive
written notice, I will conclude that your company is unwilling to
canplete these repairs,
If I can be of any further assistance, or if you would like me to re-
mark the deficient street sections, please do not hesitate to call me
at 484-4220, Extension 728.

and gutter we wish to be used in Lake Sherwood Subdivision, Third
filing, It was agreed in our conversation that the standard drive -over
curb, gutter and walk and drive -over curb and gutter could be used
in all areas of this subdivision at the developer's option in lieu of the
vertical curb and gutter as indicated on the utility plans.
