Planning Objectives for In -Situ - Project Development Plan (PDP)
Dear Ted:
In -Situ PDP is located on 4.0 acres on the south side of East Lincoln Avenue
between Team Petroleum and Hydro Construction, Inc. The Poudre River is
located south of the property. The site is currently zoned C-C-R, Community
Commercial — Poudre River District, which allows office and custom small
industry as permitted uses.
Background
In -Situ Inc. is a premier manufacturer of surface and ground water quality
monitoring equipment. Around the world, water quality is fast becoming a primary
environmental concern for industrialized and developing nations alike. The
expertise of professionals is required to protect and ensure the safety of ground
water and surface water resources. In-Situ's mission is to provide these experts
with the tools they need for reliable, accurate assessment of site conditions,
specifically for surface and ground water monitoring.
The company, owned and operated by brothers Craig and Christopher McKee,
was originally established in Laramie, Wyoming in 1978. The present facility
occupies several historic buildings in downtown Laramie and employs 65 people.
The McKee brothers want to design a new facility that will not only enhance their
current operation but will provide them with expansion capability. In addition, the
move will bring them closer to vendors they work with and customers they serve
and ultimately make them more competitive in the market place.
In -Situ has relationships with numerous vendors along the Front Range that
provide the actual manufactured parts per design specifications that are used in
the monitoring Instruments. Approximately 40% of the company's space is
devoted to light assembly of parts, while the remaining space is essentially office
space used for research and development, software, sales, administration and
meetings.

Isn't this project breaking ground on currently undeveloped property? I realize the public improvements
are minimal, but the DCP is intended to permit the work on the private property as well as the work in the
street. I would prefer that you use the DCP form, and just waive the coordination meeting if it's not
necessary or if there's such a rush that you can't take time to have the meeting. You can also reduce the
permit fee to the same as the Excavation Permit ($25) since a lot of the $300 DCP fee is to cover staff
time at the coordination meeting.

They have a street cut for water and sewer on Lincoln and that is the extent of public improvements. We
can do the DCP format but 1 gues it isn't necessary with such a small project.

I just came back from the City Managers office regarding the proposed
In -Situ development project. It was very clear that this project is to
go smoothly through the review process. I'm asking for your cooperation
by asking that the review comments be in the DTS system prior to the due
date of November 26th. If there are any issues please get in touch with
the engineer and start working on getting them resolved. They will have
their design team at next weeks Wednesday staff review meeting (This is
the first item on the agenda) to hear our comments and respond. This
project is on a short timeline so they have committed to getting revised
plans back to us quickly. Also, be prepared to give me any development
agreement language
shortly after next weeks meeting. From my point of view this is a
pretty simple project that shouldn't have any surprise issues, if I'm
mistaken please let me know.
The City has committed to issuing a Footing and Foundation permit right
after the mylars and development agreement have been signed. Since this
project has minimal impact for infasturucture improvements, there will
not be a DCP issued. We will assess inspection fees, Letter of Credit
and etc. with an excavation permit.

Dave,
According to the proposed plan, the sidewalk connection to the Buckingham neighborhood is already
shown along the east side of the proposed driveway, which also aligns with 2nd Street. Therefore, the only
thing necessary for the City to do would be to determine if this ped crossing should be striped. I will leave
that decision up to Traffic.
The crosswalk would also benefit transit riders that need to cross the street to get to the stop located on
the south side of Lincoln. 1 have mentioned this to Garold and he will consider relocating the existing stop
to the far side of the intersection. If the stop is moved it would be able to serve, not only the Buckingham
neighborhood, but also employees of In -Situ.

site and connecting with the existing trail.
As to getting some form of contribution for the future Lincoln Street improvements that's already in mind.
What those costs will be or how we will address them are unknown at this time. I don't believe we should
accept a contribution in aid since the timing of the improvements is so far in the future today's dollars won't
be worth much. We can not accept a letter of credit unless the improvements will be made within the next
7 years. The City Code requires the frontage improvements, so if the project is built as a Capital Project/
Special Improvement District the property can be assessed its share of the costs associated with their
frontage. Be assured that however we decide to address the Lincoln Street improvements it will be
incorporated into the Development Agreement.

I spoke with Tom Reiff today about LOS issues concerning the In Situ development proposal. Tom & I
feel we've found a way to satisfy In Situ's Ped LOS requirements without building sidewalk connectivity all
the way from Lincoln to Mountain. They can achieve their LOS by connecting their internal sidewalks to
the Poudre River Trail and to the 2nd St. intersection. This will allow them to make a connection with the
Buckingham area sidewalk system (such as it is).
In light of the fact that In Situ won't be required to make improvements to their frontage at this time
however, we do feel it is important to explore getting some form of aid in contribution to help fund future
improvements in this area. We just don't want to come up short when it does become time to make the
necessary improvements to this part of Lincoln.
Please let Tom or me know if you have any questions on this project or if you would like to discuss our
thoughts further. Thanks and have a great Thanksgiving.

Lincoln Avenue was recently reconstructed by pavement management to 36 foot wide asphalt section
without curb, gutter or sidewalks. There is not any other improvements along the south side of the street
from the river east. In order to bring this street up to City standards it will require a Capital Improvement
or Special Improvement District, since it's use is minimal and there are other priority needs, the timing of
future improvements is not on the radar screen, After discussions at our Transportation Coordination
meeting we believed it best to not require improvements at this time. To do so would create an island of
curb, gutter and walk that would not function and may not be in the ultimate location when Lincoln is
designed for the future.

Estimate for Lincoln Avenue Engineering Design
Quantities for "Local Street Share" of Lincoln Avenue
Dear Dave:
North Star Design is pleased to provide this estimate for the final design of Lincoln Avenue adjacent to
the proposed In -Situ Facility and the preliminary design of 1,000 feet of roadway east and west of the site
(105 last Lincoln). Attached please find a spreadsheet with quantities that represent the "Local Street"
equivalent for the Lincoln Avenue frontage.
The scope of services for the design would be as follow:
Provide a topographic survey of Lincoln Avenue from the existing Poudre River Bridge to the Fort
Collins Monument and Stone site. The survey would be approximately 140' in width. Because the
majority of the survey is for preliminary design, no boundary research would be done to determine the
existing right of way (except adjacent to the site). 8stimated fee: $1,300.
Provide a preliminary 4-Lane Arterial Road design from the existing Poudre River Bridge to the Fort
Collins Monument and Stone site. This design will include the horizontal layout of the road, right of way
requirements, a preliminary centerline profile and spot elevations at existing defined streets and drives.
Preliminary cross sections would be provided at 100' intervals. Variances would not be requested, as the
plans would not be for construction.
Estimated fee: 51.900.
Provide final 4-Lane Arterial Road design plans for the 370' of frontage. The plans would include a
cover and notes sheet, centerline and flowline horizontal layout and profiles, cross sections at 50'
intervals, striping plans and details. Estimated fee: $2,500
The total estimated fee for Lincoln Avenue design is $5,700. This would not include direct expenses
such as mileage or prints or the procurement or preparation of any easement documents.
The attached quantities arc for the City's use; please add the City's standard unit costs. Please contact
Scan Rogers or Doug Dohn at Dohn Construction (490-1855) regarding the coordination and timing of
any escrow requirements on this project.

The site is attractive to In -Situ because it is located along the River and because
of its proximity to Old Town. Since In -Situ is an environmental company, the
owners would like to create a facility that demonstrates environmentally
responsible design and development.
Explanation of (Modification Requests
On February 4, 2003, the City approved two Modification of Standards
Requests. One to allow encroachment into the 300-foot buffer zone beyond the
20% allowed by the LUC. The other was to allow the proposed building to be
wider than 125 fret parallel to the River. Both Modifications were approved
unanimously by the Planning and Zoning Board. A subsequent Appeal to City
Council resulted in the Approval being upheld. The Modifications are valid for one
year. However, once a Phase One PDP has been approved, the Modification
approval becomes the same as the vested rights for the PDP. After Phase One
is constructed, the approval extends for the life of the project. Meaning that
Phase Two will be able to extend into the buffer zone as originally allowed, even
if Phase Two is not constructed for ten years or more.
Neighborhood Meeting
A neighborhood meeting was held on October 23, 2003 at the Old Belgium
Brewery.
The main questions, concerns and comments included the impacts of future
traffic and road widening along Lincoln Avenue, the operations of the new facility,
the construction process, specifically the fill dirt required, dust and noise control,
the location of the proposed building and parking lot in relation to the buffer area,
and pedestrian and bike activity and connections.
The traffic issues, including the road widening on Lincoln Avenue are addressed
in a traffic memorandum, prepared by Matt Delich, which is part of the submittal.
Other items were; addressed at the meeting, by In -Situ, consultants and Dohn
Construction, the; general contractor.
Project Description
The site is in the Poudre River drainage basin. The southern part of the site lies
within the 100-year floodplain and floodway (see plans).
The Site Plan shows the layout for the ultimate build -out for the site. Both the
parking lot and building, including the future expansion, are located within the
approved development area and building envelope as approved in the

finding letter stating that Preble's meadow jumping mouse are not located or will be
impacted by the project from the U.S. Fish and Wildlife Services.
Attached is a copy of a letter from the Fish and Wildlife confirming that
the Preble's meadow jumping mouse is not likely to be present within the
subject area.

Land Use Code 3.4.1 (N)(1)
(1) Limits of Development. The applicant shall propose, and the Director shall
establish on the project development plan, a "limits of development' ("LOD") line(s)
to establish the boundary of the project outside of which no land disturbance
activities will occur during the construction of the project. The purpose of the LOD
lines shall be to protect natural habitats and features and their associated buffer
zones from inadvertent damage during site construction activities. The location of
the LOD shall be designed to preserve significant ecological characteristics of the
affected natural habitat or feature that could not reasonably be restored if disturbed
by construction activities associated with the project. The LOD shall also be
designed to accommodate the practical needs of approved construction activity in
terms of ingress and egress to the developed project and necessary staging and
operational areas.
The Limits of Development are shown on all plan sheets.

stabilization, native vegetation shall be utilized for such purpose, and engineered
stabilization techniques such as exposed rip rap shall be avoided, to the maximum
extent feasible. The use of native vegetation shall be the principal means of
streambank stabilization, and the use of rip -rap for streambank stabilization shall be
restricted to locations where the use of vegetation techniques is not reasonably
feasible.

1. There is a Ilot of work being done in the floodway. The lack of existing
detailed topo makes it difficult to ensure that there is no fill being placed in the
floodway, as required by the Poudre River floodplain regulations. Please
provide better existing topographic data. Suggest providing existing spot

elevations at same locations as proposed spot elevations. Please call to
discuss other options.
A cut and fill map has been added to the back of the drainage report so
that design cuts can be seen. Adding this information to the
construction plans would be confusing to the contractor and surveyor.
2. A no -rise certification is required because of the work being done in the
floodway. This must be completed by a registered professional engineer.
This certification should take into account the landscaping including plantings,
parking areas, detention ponds, bike paths, etc.
The certification is included in the drainage report.
Please include a detail with a cross-section of the bike path to make sure the
contractor understands that there must be excavation in order to place the
base and asphalt, so as to not have fill in the floodway.
The detail requested has been added.
4. As -built elevations in the floodway will need to be certified as part of the
drainage certification to certify that there was no fill placed in the floodway.
A note has been added to the plans — elevations will be surveyed with
the drainage certification for the site.
5. Phase 2 of the building is right at the edge of the floodway. There needs to
be room to provide slope away from the building without placing fill in the
floodway. The southwest corner of the building will need to be pulled back
away from the floodway.
It is acknowledged by the owner that when Phase 2 is built, the south
foundation wall will need to extend to existing ground and no fill will be
allowed in the floodway.
6. Please add a note to the plans (Sheet 5) and to the drainage report
addressing the requirement that no floatable materials are allowed to be
stored overnight in the floodplain without being secured. Please include a
note that all picnic tables, chairs, benches in the floodplain will be bolted. Also
note that any overnight parking must be outside of the floodplain.

Modification Request. The first phase of the project will ultimately accommodate
150 employees.
The project is planned to be built in two phases. Phase One includes the majority
of the parking lot with a total of 111 spaces and a 29,300 square foot, two- story
building. Phase two includes 30 parking spaces, located at the south end of the
proposed parking lot, and future 30,000 square foot, two-story expansion. Phase
One is expected to begin by the early part of next year and Phase Two is
expected to be built within three to five years.
The site plan shows two access drives, which provide access to Lincoln Avenue.
The two-way drives facilitate safe access for employees and visitors and also
provides convenient safe access for semi -trucks. The easternmost drive aligns
with Second Street to the north.
Being located along the Poudre bike trail and in close proximity to Old Town are
positive aspects for employees. The owners are hopeful that many of their
employees will bike to work rather than drive their cars. The bike trail provides
convenient access to Old Town and creates opportunities for employees to do
errands, shop arid/ or eat lunch without having to drive. On site, the
pedestrian/bike :system provides easy access to the Poudre River Trail and will
be constructed with crusher fines, a material sympathetic with the character of
the native landscape within the buffer zone. A bike parking area is located in the
south corner of the parking lot, which will accommodate a total of 20 bikes. The
paths within the buffer area have been designed to provide access for employees
and visitors to enjoy the landscape area and to view the two proposed well sites.
The wells are used to demonstrate the monitoring equipment that In Situ
provides to it's customers.
The design goal of In -Situ and the McKee brothers is to provide an attractive
building that is well integrated with the Poudre River setting by using natural
materials and appropriate colors. The site also provides an opportunity to replace
the existing non-native vegetation and weedy species with a native Colorado
landscape that will include a variety of plant species and wildlife habitats.
The architectural character of this facility will be of an orthogonally composed
building punctuated by contrasting angular elements to create visual interest both
form the interior and exterior.
The overall design concept will emphasize the following elements:
1. Relationship of the building to the site, climate, and the greater
natural context of the Front Range and Cache LaPoudre River.
2. Appropriateness of materials for their use.
3. Building form and character shall be of an appropriate scale.
Design considerations shall include the mass and proportion of the
structure including roof screens, walls and openings.
4. All elevations will be detailed to create a building with four 'front'
elevations.
The landscape plan incorporates plants from the "Fort Collins Native Plant List"
as well as non-native plant species. Within the buffer area all plantings are native
to Fort Collins and are used to enhance wildlife habitat adjacent to the river.
Plantings adjacent to the building and within the parking lot will also enhance the
natural character of the site. Deciduous and evergreen shrubs and trees are
used to screen the parking lot and provide an attractive streetscape along Lincoln
Avenue. In addition, plants and berms will be used to enhance the architecture,
main entry area and patio and provide an attractive relaxing area with shade and
seasonal interest for visitors and employees. Two existing cottonwood trees will
be retained.
City Plan Principles and policies achieved by the proposed plan include:
PRINCIPLE LU-2: The city will maintain and enhance its character and
sense of place as defined by its neighborhoods, districts, corridors, and
edges.
Policy LU-2.1 City —Wide Structure.
The building use compliments the surrounding area and provides a compact
development well -served by all modes of travel.
Policy LU-2.2 Urban Design.
The project will greatly enhance the existing site and contribute positively
to the surrounding neighborhood and Poudre River Corridor Sub -District.
PRINCIPLE T-4:113icycling will serve as a viable alternative to automobile
use for all trip purposes.
Policy 4.1 Bicycle Facilities.
Policy 4.2 System Design.
The project has bike parking for up to 20 bikes and bicycle connections to the
existing Poudre River Trial, Lincoln Avenue and the surrounding neighborhood.
PRINCIPLE T-5: The city will acknowledge pedestrian travel as a viable
transportation mode and elevate it in importance to be in balance with
other modes. Direct pedestrian connections will be provided and
encouraged from place of residence to transit, schools, activity centers,
work and public facilities.
Policy T- 5.2 Connections.
The building will be clearly visible from the street and accessible from
the surrounding development. A sidewalk adjacent to the eastern most drive
provides pedestrian access to Second Street and the existing transit
bus stop on Lincoln Avenue.
Policy T-7: The City will encourage the development of comfortable and
attractive pedestrian facilities and settings to create an interesting
pedestrian network.
Policy T-7.1 Pedestrian Facilities.
The project provides pedestrian sidewalks and path connections to the
surrounding neighborhood. Paths and sidewalk materials will be used to
compliment the surroundings. The paths within the buffer area will be constructed
in crusher fines rather an concrete to compliment the native character and
plantings in the buffer area.
Policy T-9: Private automobiles will continue to be an important means of
transportation.
Policy T- 9.2 New and Existing Roadways.
The proposed In -Situ access drives will be designed and constructed to ensure
an acceptable level of service onto Lincoln Avenue.
PRINCIPLE CAD — 3: Commercial developments create a powerful
impression of the city, both individually and taken together as a whole.
While corporate franchises and chain stores will remain vital and
recognizable, commercial developments will be designed to contribute to
Fort Collins' district visual quality and uniqueness.

The proposed building has been designed to provide visually interesting fagades
while contributing positively to the character of the local context. Natural
materials will be used 'soften' the elevations to blend with the context and very
intentionally not appear as a stark industrial facility.

Policy ENV — 3.3 Water demand management Policy.
The proposed landscape plan for the project will utilize the following xeriscape
principles:
Plant material with low to moderate water requirements.
Limited turf areas.
Effective use of soil amendments and mulches.
An efficient irrigation system.
Appropriate maintenance.
Policy ENV-5: Natural habitat/ ecosystems (wildlife, wetlands, and riparian
areas) will be protected and enhanced within the developed landscape of
Fort Collins.
Policy ENV-5.1 Protection and Enhancement.
Policy ENV- 5.2 Floodplains.
The ecological character of the buffer zone, including the 100-year floodplain, will
be greatly enhanced over what exists today. The non-native and annual weedy
species will be replaced with a variety of native trees, shrubs and groundcovers
that will not only buffer the river corridor, but create wildlife habitat where
currently none exists. The applicant commits to working closely with City Staff on
this enhancement program.
Policy ENV-7: The City will minimize potentially hazardous conditions
associated with flooding, recognize and manage for the preservation of
floodplain values, adhere to all City mandated codes, policies, and goals,
and comply with all State and Federally mandated laws and regulations
related to the management of activities in flood prone areas.
The project will comply with the policies within this section
Downtown District
Principle DD-1: The Downtown will provide a balanced mix of land use
activities. While encouraging a mix of land uses throughout the Downtown,
the predominant land use character of each sub -district will be maintained.
Land use intensity should decrease as distance from the center of each
sub -district increases — establishing a transition between urban uses and
adjacent neighborhoods. A mix of housing types for all income levels,
family types, and age groups, with a variety of prices and rent levels, will
be encouraged.
Policy DD-1.1 Land Use.

The project is compatible with the surrounding land uses and will enhance the
existing Downtown uses and character. The buffer area will be enhanced and

Re: In -Situ Subdivision - Request for Variance A — Driveway Spacing
Proj: 174-02
Dear Dave:
The following is a request for variance from Table 7-3 — Fort Collins Technical Design Standards — 4-
Lane Arterial — Distance Between Driveway Edges in the "Larimer County Urban Area Street
Standards, October 2002". The proposed project will dedicate the proper right of way for future
improvements to Lincoln Avenue, but no improvements or ultimate design will be done at this time. Two
driveways are proposed into this commercial project.
This variance is requested to allow the two proposed drives to be located 165' apart rather that the 460'
minimum required in the Standards. The proposed east drive lines up with 2"d Street to the north. This
leaves little room between the driveway and the proposed building, which will have a drive in door. To
help with circulation and because of the proximity of the east drive to the building, the second drive has
been proposed on the west side of the site. Justifications for this variance are as follow:
• The existing residential drives to the north are not well defined. The west drive has been placed as
far away from the east drive and 2nd Street as possible. With the drives on the north only serving
single-family homes, having drives that are not aligned should not be a problem and maximizing
the spacing on the south side of Lincoln was determined to be more appropriate.
• For the required drive spacing to work, a network of streets is really needed with collector and
local streets branching off of arterials at proper spacing and serving sites. The Poudre River
bounds this site and all neighboring properties on the south and there is not any room (because of
floodplains, floodways, and environmental buffers) to get a new street that could serve the
properties and have the required separation between intersections.
• In the future, when Lincoln Avenue is widened to four lanes, a median will be constructed. This
median will definitely block the west drive making it right -in / right -out and may also block the
drive at 2"d Street. Two drives with full turn movements is a temporary condition.
• I laving defined drives as proposed (even with substandard separation) will be better than many of
the adjacent properties which completely abut Lincoln with gravel yards and have no control of
where traffic enters or leaves the sites.
It is not anticipated that this variance from the above Standards will compromise the public health, safety
and welfare. Please call me with any questi ns or additional information that you may need for the
approval of this variance.
