P.O. Box 578 Fort Collins, CO 80522 (303) 482-4861 RE: Develonmenr Agreement for Greenbriar Subdivision Dear Bonnie: ,jIE-CEI V ED 19 1985 ;d.FNNING 1EvFAHTMENT Earlier this morning I delivered to your office the signed Development Agreement. Because of the short time period we were given to sign this agreement prior to the deadline today, and because of the delay that would result from any attempt to negotiate the agreement, we have signed the agreement as a result of information provided by you which has alleviated certain concerns I had with the agreement. My primary concern was that our responsibility as "the Developer" might remain with the bank if we were to sell the project prior to completion. I recommended that we sign the agreement based on your comment that if we sold the project it would be possible for us to transfer responsibility by filing a formal request with your department. I was also concerned with the developers responsibility to maintain the landscaping in the first phase until the entire project was completed if we placed phase two on hold should circumstances dictate. It is my understanding that you would consider a request for the city to take over maintenance of the completed portions which have been approved by the city if development ceased on the remainder of the project. Thank you for taking the time to explain these points Lome. It is standard policy for the City of Fort Collins to accept for perpetual maintenance those public right-of-way constructions which have been approved by the City and which have passed all required guarantee periods. This includes the water main, sanitary sewer mains, storm sewer lines and facilities, street pavements, street lights, and street signs.
