A site inspection made by our firm recently at the above -referenced
project indicates the site is suitable for the proposed construction.
Preliminary soil tests have been made in the area and it is emphasized
that dewatering systems should be installed as recommended. After the
areas have been dewatered, all organic material and topsoil should be
removed from the site and filled with a granular -type material. The
excavation of all fill should be verified and inspected and field density
tests taken under the direct supervision of a geotechnical engineer.

We recommend that a comprehensive soil study be made for the proposed
building site after all fill placement has been made. It would appear
that the site would require several feet of granular imported material
to bring building pads and parking areas to grade. In view of this, we
see no problems with construction in the area. However, all foundation,
street sections, and parking areas should be designed for the specific
subsurface conditions after fill placement.

RE: Off -site drainage for Greenbriar P.U.D.
As the City approaches a limit in its ability to provide adequate
Public service for its urban area, the frequency of new development occurring
adjacent to existing subdivisions increases. Often, such existing sub-
divisions were designed and constructed in accordance with standards and
specifications less stringent than those presently in use. This is true
in the case of urban storm drainage, particularly as it relates to surface
runoff. At its August 24th meeting, the Storm Drainage Board discussed
an example of the problems associated with this type of situation.
The Second Filing of Evergreen Park Subdivision, which is presently under
construction, was designed to handle its own runoff, assuming that upstream
historical runoff would flow around Evergreen Park to the east. Greenbriar
P.U.D., a proposed development directly north of Evergreen Park 2nd, has
discovered in the course of a preliminary drainage analysis that routing
their drainage around rather than through Evergreen Park 2nd will require
extensive additional design as well as increasing the cost of developing
their site.
Part of the problem at this point is determing the most economical
engineering solution, but the main issue is to determine an equitable
distribution of the financial responsibilities associated with these
solutions. To date, the City has required development to pay its own way,
relieving the City of any substantial responsibility. There are basically
three alternatives in dealing with these situations:
(1) Require the developer to pay for the complete drainage system which will
channel his storm runoff to a suitable outlet. Depending on the location
of the development, such an outlet may be either on- or off -site.
(2) Require the City to participate directly in the costs of these drainage
systems.
(3) Establish a fee based upon the estimated costs of construction which
allows those costs to be distributed among the affected properties.

A combination of the second and third alternatives seems to be the
most equitable and feasible. Preliminary cost estimates for the Creenbriar
drainage system range between $48,000 and $98,000 depending upon which
design solution is finally accepted. The fees for this system could be
assigned in conjunction with the subdivision improvement agreements for
the developments within the area.
Due to the time constraints associated with this development, it is
recommended that. the City take immediate action to retain a consultant
to prepare a design for this drainage system. The expense of the consultant
will be distributed within the fees for the project.

checked the referenced subdivisions on Tuesday, January 2,
1979, for monwnentation of the exterior boundaries in accord-
ance with CRS 38-51-101.
We were unable to find permanent monuments in accordance with
the statutes. Please advise this office when monumentation
of the boundaries is completed so that we may sign the plats
prior to recording.

for the development in terms of the necessary drainage improvements. Hope-

Please type in the nacre of your partnership, corporation, or venture in the
first paragraph of all three executory copies. If the agreement is
acceptable, please affix your corporate seal and have an officer (president
or vice-president) sign each copy.

During construction of the 24" water main on the above referenced project,
the contractor installing the utilities encountered a swampy, low-lying area.
The area that I am concerned about is in the northwest sector of the
sLiAivi.sion, under Willox Tame from approximately Station 22+00 to 28+00 (sheet
7 and 8 of 22 on the approved utility drawings).
A test hole dug by the contractor on January 23, 1980 indicated a soil
profile of:
0.0 to 1.5 ft.
1.5 to 6.5 ft.
6.5 to 7.5 ft.
Belay 7.5 ft.
Groundwater 4 ft. from surface
Decoriposing organic material
Brown silt with some very fine sand
Brown heavy clay
White silt
This soil profile is radically different from any boring logs in the
soils report submitted for this project.
A visual examination seems to indicate a rather poor soil for engineering
purposos. Therefore, the City is asking that additional siLsurface soil investi-
gations be carried out to classify the soil and deterrune the limits of this
swampy area, including groundwater determination if measurable and, if necessary,
a structural redesign of the collector and residential streets in this area
should be submitted to this office for approval.

Enclosed with this letter is a print of an alternate drainage plan
for Puebla Vista Estates. This plan provides twice the detention
volume of the original plan dated June 27, 1978, and has the added
advantage of being located more closely to the natural low point than
the original plan.
The detention volume of over 1 ac-ft of water is well in excess of
that required by either the City of County for this site. The
majority of the discharge from the site results from passage of
upstream Dater and not from development of this site.
The culvert sizes shown have been adjusted to allow passage of the
two year storm without street overtopping.
If you have any further questions concerning drainage at Puebla
Vista Estates please contact our office.

Dear Bob:
At the drainage board meeting on January 23rd of this year, it was
suggested that the outfall storm sewer system for the Greenbriar east
detention pond be constructed through Evergreen Park Second Filing
and through the property to the southeast of the Lake Canal, north of
Alta Vista, and west of North Lemay Avenue. I have since made a
preliminary evaluation of said alternative and find that it would not
be advantageous from an economic standpoint for the following reasons:
1. Due to the 12" sanitary sewer along the north boundary of
Evergreen Park Second Filing, the 27" City of Greeley water
main in Foxtail Street, the 24" ELCO water main in Conifer
Street„ and the Lake Canal, a minimum of 3 inverted siphons
,could be necessary. The inverted siphon below the 27" and
24" wai.er mains would be a minimum of 150' longer than with
the alternatives presented at the meeting.
2. Conflicts with existing utilities would be increased compared
to the alternatives presented at the drainage board meeting.
Construction of the storm se,aer along the back lot lines of
Lots 1'l through 18, Block 2 would conflict with the underground_
telephone and cable television cables. Construction along
the front of said lots, in Coulter Street, would obviously
conflict with water, sewer, gas, and electricity.
3. Whether the storm sewer were constructed in front of or in
the back of the lots mentioned above, additional asphalt and
curb and gutter would be removed and replaced compared to the
alternatives presented at the drainage board meeting.
4. Due to the extent of residential development which has already
taken place, additionalshrubs, fences, sod, and miscellaneous
structures would be removed and replaced compared with the
alternatives presented.

5. The existing residences on the south side of the Lake Canal would
undoubtedly create various obstructions which would conflict with
the construction of the storm server system.
6. Land acquisition through Evergreen Park 2nd Filing and the
developed lots just south of the Lake Canal would he more difficult
and much more costly compared to the alternatives presented.
7. The came vertical limitations, if not more severe, would exist due
to the flowline elevations of the Greenbriar and Evergreen Park
ponds relative to the flowline elevations in Dry Creek.

this letter, or if you have any questions or comments, please advise.

I am enclosing a letter and a xerox copy of a drainage plan for Puebla Vista
Estates. This subdivision lies to the north of the Eaton Ditch in the
Evergreen Park area and if my memory serves me correctly, is right in the
area where you propose to flume the ditch. Inasmuch as this does influence
and affect the drainage proposals that you have discussed with us, I am
sending them to you for your consideration. We will not approve the
alternative design until you have had an opportunity to review them and have
talked with us about it.
Again, we appreciate the efforts of the City of Fort Collins to work with
us on this big ditch. In looking at the breach of the reservoir over in
Weld County, in became apparent that the water flowing through the breach
probably was only two or three times greater than the volume of water that
would flow from the Eaton Ditch if there were a breach. Fortunately, the
water coming out of the ditch would only last for approximately three hours
from the time that we stop the flow of water at the head gate. Of course if
there is a substantial amount of storm drainage coming on us from the north,
it could last longer and it could increase the quantity and velocity of
the water.
We appreciate your foresight in trying to work with us in resolving the
future problems.

Hvolboll-Johnson Construction and Development Company,
Inc., currently owns and is in the process of developing
Greenbriar. Greenbriar is a planned unit development
located in. the North 1/2 of the Northeast 1/4 of Section
1, Township % North, Range 69 West of the Sixth P.M., City
of Ft. Collins. On March 30, 1979, we entered into a
Subdivision Agreement with the City of Ft. Collins, a
portion of which restricts the issuance of building per-
mits until certain drainage facilities are designed, funded,
and constructed.
At present, construction of the off -sites is in progress
with construction of the housing units to start imme-
diately thereafter. We are very concerned about the
progress of the drainage studies and implementation plans
for the out -fall systems from the Greenbriar Development.
It is our understanding that an engineering study has
been completed for the east side out -fall only, however,
it has neither been approved by the City nor has a means
of funding been established. In accordance with the Sub-
division Agreement, we are limited to 22 permits within the
easterly drainage shed and 2 permits within the westerly
drainage shed until suitable drainage facilities are in-
stalled. Such facilities are related to the impacts of
area -wide developments and are not solely the responsibility
of the Greenbriar Subdivision. We are, however, agreeable
to contribute a reasonable share of the expense associated
with the drainage facilities.

At the time the Subdivision Agreement was executed, it
was our understanding that the required drainage studies
would be completed without delay and that the limitations
imposed on the issuance of building permits would not
threaten t'lle viability of the Greenbriar Development. It
now appears that we may be placed in a position of having
expended a large amount of funds to install off -site im-
provements, in accordance with the Subdivision Agreement,
and unable to recoup these expenses due to a limited supply
of building permits. Furthermore, we have recently sub-
mitted an application for 240 condominiums on the west
side of Greenbriar and find that a drainage study has
not even been initiated and may not be for at least
another year.
I would appreciate a detailed analysis of the progress
to date and planned schedule for completing the drainage
studies, funding procedure, and construction of the east
and west basins. If there are specific reasons for the
lack of progress please identify. It is in the best
interests of the City of Ft. Collins and future residents
of this development that arrangements be made to expedite
the completion of the drainage systems. I urge you to
take all necessary action to comply with the arrangements
agreed to on Page 5, Item f. of the Subdivision Agreement.

Dear Richard:
This is to inform you on Thursday, December 4, 1980 your superintendent,
Jim Walters, and I checked all manhole rims and valve box elevations
in the (,reenbriar Subdivision. These measurements were made with a
four (4) foot carpenters level and a tape measure. These elevations
were verified by checking the engineer's (Stewart Engineering) grade
stakes to the rim elevations at each manhole and valve box location.
At this time all elevations were found to be within 0.05+ feet.
It should also be noted that at this time I found all manhole rings
and covers and water valve boxes to be in goad repair.

Curt and I discussed the improvements to Lemay Avenue that would be required
as a result of -improvements to lots abutting Lemay Avenue in the Greenbrier
P.U.D.
As you are aware the developer is expected to improve a street to its ultimate
design (as indicated on the Master Street Plan) at the time he improves the
property abutting that street. His responsibility is for a local street
standard with provision for his receiving reimbursement for oversizing that
street to collector or arterial standards.
Often times a developer desires to develop property at the far end of his
property first, as opposed to developing property adjacent to existing im-
provements; this is the situation you have proposed. You propose to sell,
for development, only two such lots and it would appear ridiculous to require
improving Lemay Avenue all the way back to Lincoln for just two houses.
However, if we allowed every developer to ignore these requirements we would
soon have whole developments creating traffic problems on undersized streets
(as we now have in many instances). Therefore, we attempt to write an agree-
ment with the prospective developer that allows him to proceed while at the
same time assuring the City that the street will be built with the developer
assuming his share of that street and not causing a burden on the City as
a whole.
We would suggest, therefore, that an escrow account be established which
would amount to 150 percent of the cost of one-half of a local street (includ-
ing c0rb, gutter, and four foot wide sidewalk) for the length of the lots
and access abutting Lemay Avenue (190 l.f.). The costs should be determined
from a written estimate prepared by a contractor specializing in such work
and should be based on assuming that a reasonable length of the street would
be done at a given time, not just the 190 feet.

Needless to say, my answer was not welcomed with open arms. Apparently,
the bank wants to close on the sale to the City on August I5th. This
allows them to save carrying charges for another month and get on with
the formation of an SID. When the bank does a title search, the utility
easements show up on the property description. I don't know if the
utilities are ours, Mountain Bells, or PSCos; but TJG wants to close
on 3/1S. Bill Brown is his attorney working on the problem. Can we
work with Bill to put a package together?

On behalf of Mr. Tom Dougherty and Greenbriar Inc., I am requesting that
they be allowed to fill in a small portion of the East detention pond at
Greenbriar. The portion they want to fill in is the narrow finger running
North between Lots 67 thru 70 and Lemay Avenue. It is a rather deep narrow
channel which will be hard to maintain. The volume of detention lost is
0.25 acre feet. As you know, the runoff to the detention pond was reduced
when the City bought the 21 acre park site and Greenbriar was replatted.
The pond is existing and so was not reduced at the time of the r2platting.
It seems this revision of the pond is justified for asthetic and mainte-
nance reasons since the required detention was reduced.
The original drainage report was done by Resource Consultants and is prob-
ably in your files. The nronosed channe is shorm on the enclosed Sheet
14 of 22 Sheets of the o ri-1 -I Greenbriar utility plans.

As the City approaches a limit in its ability to provide adequate
public service for its urban area, the frequency of new development occurring
adjacent to existing subdivisions increases. Often, such existing sub-
divisions were designed and constructed in accordance with standards and
specifications less stringent than those presently in use. This is true
in the case of urban storm drainage, particularly as it relates to surface
runoff. At its August 24th meeting, the Storm Drainage Board discussed
an example of the problems associated with this type of situation.
The Second Filing of Evergreen Park Subdivision, which is presently under
construction, was apparently approved without requiring that adequate
provisions be made to allow for the passage of historical drainage through
the site. Such provisions have become critical in view of the City's
present policy of directing storm runoff toward natural drainageways.
Greenbriar P.U.D., a proposed development directly north of Evergreen
Park 2nd, has discovered in the course of a preliminary drainage analysis
that this presents a serious problem with regard to the discharge of its
storm runoff. The direction of the historical drainage for this area is
generally southerly, through both Greenbriar and Evergreen Park toward
Dry Creek. The development of Evergreen Park 2nd has essentially blocked
the natural flow of surface runoff.
This problem may be corrected by means of a number of engineering solutions.
The real issue is to determine an equitable distribution of the financial
responsibilities associated with these solutions. To date, the City has
required development to pay its own clay, relieving the City of any sub-
stantial responsibility. There are basically three alternatives in dealing
with these situations:
(1) Require the developer to pay for the complete drainage system which will
channel his storm runoff to a suitable outlet. Depending on the location
of the development, such an outlet may be either on- or off -site.
(2) Require the City to participate directly in the costs of these drainage
systems.

(3) Establish a fee based upon the estimated costs of construction
which allows those costs to be_distributed among the affected
properties.
The third alternative appears to be the most equitable and feasible.
Preliminary cost estimates for the Greenbriar drainage system range
between $48,000 and $98,000 depending upon which design solution is
finally accepted. The fees for this system could be assigned in con-
junction with the subdivision improvement agreements for the developments
within the area.
Due to the time constraints associated with this develoianent, it is
recommended that the City take inniediate action to retain a consultant
to prepare a design for this drainage system. The expense of the consultant
will be distributed within the fees for the project.

Attached is a memorandum from the Engineering Office regarding
a storm drainage situation which has evolved in the northTast
part of the City between the Evergreen Park area and the new
Greenbriar PUD.
The problem is to find an equitable way to distribute the cost
of storm drainage improvements to two or more developing sub-
divisions. The most reasonable solution is to establish a
storm drainage fee, as we indicated in our "Storm Drainage
Program and Financing Plan".
Because of the amount of storm drainage analysis required,
we do not have sufficient staff time to complete the studies
we need. Because of this, we are recommending the use of a
consulting engineer to complete this study. The cost is
estimated to be less than $10,000, which could be includa3
in the final fee and for the most part recovered as development
occurs.
The Storm Drainage Board has considered this question and
recommends use of a consulting engineer to complete the design
