Dear Cam McNair,
This is a request for a variance in the proposed Discount Tire development of
Commercial Envelope `B" of the Fossil Creek Meadows Subdivision First Filing. The
request pertains to the speed used to calculate the Sight Distance. Our distance is only
critical in the westerly direction for vehicles exiting the Discount Tire parking lot onto
Fossil Creek Parkway, which is classified as a major collector. City Standards require the
use of the design speed for sight distance calculations, which in this case is 40 mph, and
creates a minimum sight distance of 660 feet. The variance is for a sight distance of 347
feet, which corresponds to a speed of 31 mph.
The point of first sight in the Eastbound lane of Fossil Creek Parkway for the said
scenario is 127' feet from the roadway of S. College (US 287) which is a stoplight
intersection. Said point is also at the beginning of a 220 foot centerline radius curve.
Said centerline curve radius is 80' less than the standard minimum for a collector. Given
these two factors, the speed of travel should be much lower than the 40 mph design
speed. Consequently, a sight distance of 347 feet will accomplish the purpose of the City
Standards.

The location of the Snead Dr. tie-in to Fossil Creek Parkway does not allow the
entrance to Discount tire to move any farther to the East to increase the sight distance.
The 100-yr Flood Plain of Fossil Creek prevents moving the building to the south to
increase the sight distance. The maximum sight distance available for this site is
approximately 450', so the 660' requirement is not feasible. Additionally, if the
AASHTO 2001 "A Policy on Geometric Design" Equation 9-1 pertaining to intersection
sight design is used to calculate the sight distance at 40 mph, the resulting 441' is
substantially lower than the 660' called for by City Standards.

Due to the floodplain restrictions, the floor elevation of the building must be
approximately 5 — 8 feet below the street grades at the South College Avenue /
Fossil Creek Parkway intersection. If the building were located within the "build
to" line, retaining walls would be required between the sidewalk and the building.
With the current building location, a 4:1 slope can be used along Fossil Creek
Parkway, which is both safer and more aesthetically pleasing.

Thanks for your e-mail, they do need to accommodate the 6' bikelane between the right turn lane (if it's
required) and the through lane. If the right turn lane is not required, then they just need to provide an 8'

Hello,
I'm trying to get a few issues resolved on this project before the 2nd round comments are due on the 18th.
The issues have to do with the right turn lane on College adjacent to the site. There is an existing right
turn lane there now, but with the ultimate widening of College, this lane will become the through lane.
Eric, do the numbers in the TIS warrant an exclusive right turn lane here in the future, after the ultimate
widening?
Kathleen, how will the bike lane project on College affect this site? Do they need to widen out the existing
turn lane to accomodate the bike lane between the through and turn lanes?
Are there any other issues I should be aware of?

Dear Cam McNair,
This is a request for vacation of right-of-way along both Fossil Creek Parkway
and South College Avenue as they border Fossil Creek Meadows Commercial Envelopes
"A" and " B". This is a follow-up to a previous request for vacation solely along South
College. New boundary corners have been calculated based on both the approved plans
for the Fossil Creek Parkway improvements and for county guidelines for a six -lane
arterial with deceleration lane.
The land requested for vacation is the difference between said required right-of-
way and the existing boundaries. Simultaneously, Mr. Paul Heffron, the owner of said
commercial envelopes, is dedicating by replat any ground required for said rights -of -way
that is currently within said boundary lines. Mr. Heffron is dedicating 980.7 square feet
along Fossil Creek Parkway, and is requesting 1475.3 and 12653.4 along Fossil Creek
Parkway and South College respectively. Additionally, 20538.6 square feet is being
dedicated from the existing South College Frontage Road to South College by this
request. Since the new calculated boundary provides all required rights -of -way, the City
of Fort Collins and C.D.O.T. will no longer need the land being requested. At the same
time, said land will increase the functional use of said commercial envelopes.

1) Building Massing. To satisfy the " variation in massing" requirements in 3.5.3(B) the
pilasters on the north and south elevations are to protrude out by 6" from the building.

B) Main Discussion itcrrIs:
The main discussion items were:
I) Coordination of the bike lane on CoIlc�,e Avenue.
The alienmcnt of the R.O.W. was submitted to Katic at this time, and was approved. The City is
planning a Bike Lane project to stretch from Harmony Rd. South to Carpenter Rd. The current City
Street Standards for South College include an S' hike lane, to he narrowed to a 6' lane at the existing
right-hand turn lane, while maintainin(I a I'_' turn lane not including -utter width. At the time of the
mcetin�,. Stewart and Associates were not sure if the existing sniping and road width would allow for
the bike lane or not. Transportation stated that if necessary. the existing curh and gutter would have
to be moved to allow Ior said bike lane. Once the curb and gutter was rcali-ned, the next issue is
w,hcthcr the placement of the interim sidewalk tic. not ultimate design) would allow for the existing
crosswalk across Fossil Creek Parkway would he sufficient, or whether a pedestrian refuge would be
requircd at this time.
In addition, Transportation require that the westbound bike lane on Fossil Creek Parkway be striped
LIP to the intersection. Currently the lane that was striped during the Fossil Creek Improvements
stops before the single tl'uu lane becomes a thru lane and a dedicated turning lane. This should not
pose any problems.
2) Fossil Creek Trail and pedestrian connectivity
Park Planning, did not have any additional concerns. However, due to the refiguring of the onsite
storm drainage facilities. additional room became available at the Southwest corner of the site. This
helped clear up the concerns of having a connection from our site to the future Fossil Creek Regional
Trail. Additional Public trail access casement space will be given to allow for connection from the
South C011cgc sidewalk to the proposed trail.
It was N-ought to Transportations attention that placement of the sidewalk for ultimate design is not
practical at the south end of our site's Irontase. This is partly due to the fact that the bridge has not
been widened yet, and partly because of the large amount of fill that will be required. It was pointed
out that if the sidewalk was built to the end of the property, it would be 10' above the existing ground,
which does not help any pedestrian. Both Engineering. specifically Matt Baker, and Transportation
that for this project the sidewalk shall be built up to a point that is easily connectable to the future
Fossil Creel: Trail. This way, if the trail is built prior to South College widening, the sidewalk
requircd to be built by us will already he in place. Engineering stated that they would work with
Stewart and Associates to come up with an escrow amount to cover the remaining sidewalk
construction.
Since the meeting. I have determined that the cun'ent striping on Colle_c will not allow for a hikc
lane to he placed without mov in- the existing curh and '-Iutter back. I)owevOr. this poses a problem
hCaUsC there a three cxisling Lill lities within the area that is to become the tight -hand turn I:me.
Thcrc is a PVRGA power pole. NJ ('I WorldCOm communication lines. and a cum inlet with piping
dovan to Fossil Geck F'pon consultation with engineers in the office. and Keith the client. I am u-ying
to work out an additional escrM� agreement. This would allow for the hike lane project to happen all
al the same time This is beneficial hecausc the project kill have full cooperation with the 3 utilities
mentioned. and %vill already have the required crews in the area. No agreement has been made at this
time.
3) Retainina wall
Also at the meeting, the client agreed that we should move the retaining wall hack to the edge of the

B) Main Discussion items:
The main discussion items were:
1) Coordination of the bike lane on College Avenue.
The alignment of the R.O.W. was submitted to Katie at this time, and was approved. The City is
planning a Bike Lane project to stretch from Harmony Rd. South to Carpenter Rd. The current City
Street Standards for South College include an 8' bike lane, to be narrowed to a 6' lane at the existing
right-hand turn lane, while maintaining a 12' turn lane not including gutter width. At the time of the
meeting, Stewart and Associates were not sure if the existing striping and road width would allow for
the bike lane or not. Transportation stated that if necessary, the existing curb and gutter would have
to be moved to allow for the bike lane. Once the curb and gutter was realigned, the next issue is
whether the placement of the interim sidewalk (ie. not ultimate design) would allow for the existing
crosswalk across Fossil Creek Parkway to be sufficient, or whether a pedestrian refuge would be
required at this time.
In addition, Transportation will require that the westbound bike lane on Fossil Creek Parkway be
striped up to the intersection. Currently the lane that was striped during the Fossil Creek
Improvements stops before the single thru lane becomes a thru lane and a dedicated turning lane.
This should not pose any problems.
2) Fossil Creek Trail and pedestrian connectivity
Park Planning did not have any additional concerns. However, due to the refiguring of the onsite
storm drainage facilities, additional room became available at the Southwest corner of the site. This
helped clear up the concerns of having a connection from our site to the future Fossil Creek Regional
`Dail. An additional Public Trail Access easement will be given to allow for connection from the
South College sidewalk to the proposed trail.
It was brought to Transportation's attention that placement of the sidewalk for ultimate design is not
practical at the south end of our site's frontage. This is partly due to the fact that the bridge has not
been widened yet, and partly because of the large amount of fill that will be required. It was pointed
out that if the sidewalk was built to the end of the property, it would be 10' above the existing ground,
which does allow the pedestrian movement. Both Street Improvements and Transportation agreed that
for this project the sidewalk shall be built up to a point that is easily connectable to the future Fossil
Creek Trail. This way, if the trail is built prior to South College widening, the sidewalk required
along South College will already be in place. Street Improvements stated that they would work with
Stewart and Associates to come up with an escrow amount to cover the remaining South College
sidewalk construction.

Please find attached a variance request from Stewart Engineering addressing the City's
concern as it relates to the driveway location for a proposed Discount Tire facility on
Fossil Creek Parkway.
After reviewing the submitted data and the requested additional information of an
abbreviated gap study. 1 agree that the location of the driveway will provide sufficient
_time for vehicles to exit onto Fossil Creek Parkway without adversejy affecting the safe_
travel of vehicle's headed east on Fossil Creek Parkway. In addition, the proposed
driveway location will align with the intersection of Snead Drive when it is constructed in
the future.

Since the meeting, Stewart and Associates have determined that the current striping on College will
not allow for a bike lane to be placed without moving the existing curb and gutter back. However,
this poses a problenn because there a three existing utilities within Tile area that is to become the right-
hand turn lane. There is a PVREA power pole, MCI WorldCom communication lines, and a curb
inlet with piping down to Fossil Creek. Upon consultation with engineers in the office, and with the
client, Stewart and Associates are trying to work out an additional escrow agreement. This would
allow for the bike lane project to happen all at the same time. This is beneficial because the project
will have full cooperation with the 3 utilities mentioned, and will already have the required crews in
the area. No agreement has been made at this time.
3) Retaining wall
Also at the meeting, the client agreed that we should move the retaining wall back to the edge of the
architectural columns along the western side of the building. This will allow for additional room
within the 15' utility easement, and will decrease the wall height and allow for better visual access
from South College into the showroom windows.

Dear Mr- Jones,
I am writing on behalf of the Fossil Creek Meadows Homeowners Association
(FCMHOA) in regards to a proposed easement in Tract A of Fossil Creek Meadows, first
Filing. This proposed easement would allow the proposed Discount Tire development of
Commercial Envelope B to install a storm drainage outlet to nearby Fossil Creek.
Stewail & Associates has initiated discussions with the FCMHOA for this
easement. We have reviewed the easement location, legal descriptions, and easement
language. Throughout the discussions Stewart and Associates has been responsive to our
questions and requests.
This letter serves as a "letter of intent' from the FCMHOA that the proposed
eascmcnt appears acceptable. We have yet to review the documents with our legal

This is a request for variance in the proposed Discount Tire development at Fossil
Creek Parkway. This request pertains to LCUASS Table 7-3, specifically the centerline
radius of Snead Drive, which is classified as Local Commercial. The original alignment
of Snead Dr. did not meet LCUASS 8.2.3 which requires a maximum intersection angle
of 110' /80'. In order to place the entrance drive for our project and maintain continuity
at the intersection of Fossil Creek Parkway, Snead Dr. was required to be realigned
while maintaining current LCUASS standards.
The alignment is constrained by the required sight distance for cars exiting our
proposed project to see oncoming traffic from the west, and by the 100' tangent length of
Snead Dr. called. for in Table 7-3. The decision to hold the tangent length and decrease
the turning radios was chosen. The standard centerline turning radius in Table 7-3 for a
Local Commercial street is 275.00'. The actual centerline turning radius used is 166.42'.
By maintaining the tangent length, this design allows for traffic to have sufficient straight
roadway to come to a complete stop at the intersection with Fossil Creek Parkway.
Additionally, Snead Dr. is approaching a T intersection and traffic will be slowing to less
than the design speed used to determine the Table 7-3 standards. This variance to the
alignment of Snead Dr. will not be a detriment to the public health, safety, or welfare,
will not reduce the design life, and will not cause any additional maintenance costs to the
City of Fort Collins. Please note that Snead Dr. will not be built with this development.

RE: Variance Requests for Discount Tire at Fossil Creek
Stewart and Associates, on behalf of the Developer for the Discount Tire at Fossil Creek project, has
submitted variance requests to the Larimer County Urban Area Street Standards. The variances are for
minimum centerline radius on a local street and curb return radius for a driveway. The centerline radius
is requested to be smaller (166.42 feet) as opposed to the standard centerline radius of 275 feet on a
commercial local street. The curb return radius is requested to be larger (30 feet) as opposed to the
standard 15 foot curb return radius for a driveway intersecting a collector street.
Typically, the City requires that the standard centerline radius of a commercial local street be a minimum
of 275 feet for drivability. The engineer proposes centerline radius of 166.42 feet on Snead Drive, and
believes that this variance can be supported due to the fact that the tangent length at the intersection
with Fossil Creek was kept at the standard 100 feet, and that traffic will be slow due to the proximity of
the curve to the T intersection with Fossil Creek Parkway. Additionally, the engineer feels that this
variance will not be a detriment to the public health, safety, or welfare, will not reduce the design life,
and will not cause any additional maintenance costs to the City.
It is my opinion that this variance can be supported based on the engineer's arguments above, as well as
the fact that the distance from the stub of the existing Snead Drive (to the north of this development) to
Fossil Creek Parkway is only 400 feet, and the angle at which the existing Snead Drive intersects the
property line to the north combined with the need for the road to intersect Fossil Creek Parkway at 90-
degrees (+/- 10 degrees) severely limits the design options for this remaining portion of Snead Drive.
The engineer also requested a variance regarding the curb return radius for a driveway intersecting a
collector street. Typically, the City requires that radii in this case must be 15 feet to slow vehicles
entering and exiting the driveway. The engineer proposes the standard 15 foot radius on the east side of
the driveway, but a 30 foot radius on the west side, and feels that this variance can be supported
because of the single -axle delivery trucks using the access for tire delivery and removal. The engineer
further states that this variance will not be a detriment to the public health, safety, or welfare, will not
reduce the design life, and will not cause any additional maintenance costs to the City.
It is my opinion that this variance can be supported based on the engineer's arguments above.

8.2.9 calls for a radius of 15'. The 15' radius is used for the eastern curb return, but a 30'

The reasoning for the increased radius is that single -axle delivery trucks will
require access to the site for tire delivery and removal. It is important to note that the
access drive connects with Fossil Creek Parkway at an 80' angle, as allowed in LCUASS
8.2.3. This variance will not be detrimental to the public health, safety, or welfare, will
increase the design life of said improvements, and will not increase the maintenance costs
to the City of Fort Collins. This variance will provide better service to the public than if
the standard 15' curb return radius were used. We feel these combined factors justify the
increased curb return radius.

I checked out the requested easement location with one other board member last
Saturday. I don't think the board will have a problem with granting the easement under the
following conditions:
1) stormwater and other runoff from the property is conveyed to Fossil Creek in a manner
that precludes erosion of the creek banks
2) your client assumes responsibility for obtaining any necessary permits associated with
routing stormwater to the creek (i.e. NPDES permit, if required) and stormwater from
your client's property does not degrade the water quality in Fossil Creek
3) your client ensures that Fossil Creek Meadows Homeowners Association is not held
liable for any maintenance associated with the stormwater conveyance for which the
easement is granted

This variance requested is to have a vertical curve length of 160 feet.
COMPARING TO STANDARDS:
There will be no impact on capital or maintenance requirements, or costs.
JUSTIFICATION:
I _) The designed vertical curve is between two curb inlets that are 180 feet apart which restrict
the length of the curve, and in order to meet the City requirement of 0.5% grade into the inlet, a
shorter vertical curve is required.
2 ) This curb location is an interim location.

This letter is in :response to your request to vacate portions of the frontage road adjacent
to Commercial envelopes `B" and "C"in the above referenced development. After
submitting your request to the interested parties and utility companies, the only entity
expressing concern with this vacation is the Fort Collins/ Loveland Water District. Mr.
Terry Farrill has indicated the district needs the right of way as access for maintenance of
their facilities. 1 suggest your firm contact Mr. Farrill and see if his concerns can be
addressed in some other fashion. Until such time as the City obtains consensus from the
water district we can not move forward with the vacation of the right of way.

Modification Request
Discount Tire at Fossil Creek PDP
July 18, 2002
This request is for a modification to the "build -to" line requirements as outlined in the
City of Fort Collins Land Use Code. The modification being requested is from section
3.5.3 (B)(2)(a) and (b), Relationship of Buildings to Streets, Walkways and Parking. This
regulation reads as follows:
and;
(a) To establish "build -to" lines, buildings shall be located and designed to
align or approximately align with any previously established
building/sidewalk relationships that are consistent with this standard.
Accordingly, at least thirty (30) percent of the total length of the building
along the street shall be extended to the build -to line area. If a parcel, lot
or tract has multiple streets, then the building shall be built to at least two
(2,1 of them according to (b) through (d) below, i.e. to a street corner.
(b) Buildings shall be located no more than fifteen (15) feet from the right-of-
way of adjoining street if the street is smaller than a full arterial or has
on -street parking.
Project Description
Discount Tire is proposing a new 8,480 sq. ft. building at the southeast corner of South
College Avenue and Fossil Creek Parkway. The main access to the site has been located
to align with the future extension of Snead Drive, to the north across from Fossil Creek
Parkway. The proposed building is located in the northwest comer of the site, outside of
the 100-year floodplain and parking for the facility is located south of the building.

Modification
The west side of the building is located approximately 23 feet from the South College
Avenue right-of-way line, meeting the "build -to" line standard for an arterial street.
Fossil Creek Parkway curves to the southeast from the intersection with South College
Avenue, creating a sight distanc8 triangle along the southern edge of the street, which
prevents the bui [ding from being placed within the "build -to" line standards.
The result is that the setback along Fossil Creek Parkway varies from 39.5 feet at the
northwest corner to 26.5 feet at the northeast corner of the building. Therefore, the north
side of the building does not meet the required 15-foot setback for 30% of its length. In
order to meet this requirement the building would have to be designed with a curved wall
to match the curve in Fossil Creek Parkway and an angled wall to align with the site
distance triangle.
The request is for a modification to allow a greater setback along Fossil Creek
Parkway that varies from 26.5 feet to 39.5 feet, but is not 15 feet for 30% of it's
length.
Justification
Ajustification for this request per the Modification Criteria (Section 2.8 2(H) (1) is that
the proposed plan will serve the standard equally well or better than would a plan which
complies with the standard. We believe the proposed project meets this criterion in the
following ways:
1. Setting the building back an additional 24.5 feet allows for more landscaping in
front of the building, creating a more attractive streetscape.
2. Setting the building back an additional 24.5 feet would help it fit into the context
of the established neighborhood where most building setbacks exceed 50 feet.
3. A connecting walkway is provided in the most convenient location to allow
pedestrians to enter the building without crossing driveways or parking lots.
Another justification per the Modification Criteria (Section 2.8.2(H) (3) is the physical
conditions of the; site due to the curve of Fossil Creek Parkway and the resulting site
distance easement.
The north wall of the building complies with the intent of the 15-foot build -to
line. It is only because of the curvature of the street that the setback technically
does not meet the standard.
