The City has received the proposed building plans for the car wash building at the northwest corner of your property. In approving this site for the car wash - service station, it is my understanding that the City Council included the stipulation that the curb and gutter and paving be installed on Mason Street adjacent to the length of your property. Before we issue the building permit, we should have a utility plan for 'this curbiug and paving to confirm the City Council's requirement. Sincerely, Boy A. There is a provision on the above mentioned plat which reads as follows: This plat to be known as ��nd do hereby . . dedicate and convey foreve erea by the streets and alleys as laid out and designated on the plat and do also hereby dedicate perpetual easements for the installation and main- tenance of underground utilities as laid out upon this plat, except that the street on Drake Road is not dedicated hereby and said street is hereby reserved for a period of twenty years from the date hereof. The condition of the reservation is that, if at anytime during said twenty years the City of Fort Collins as its sole determination finds it necessary to widen Drake Road, so much of said area as needed for the installation of street, curb, gutter and sidewalk and lights shall thereupon be deemed dedicated for such purpose. Any portion not used after twenty years shall revert to the then owner of the adjoining land free of this reservation. There is no sidewalk on the south side of Drake Road, and with the advent of K--Mart this sidewalk will be needed. Perhaps the City Council should determine that this additional 20 feet is needed and that a line be painted clown for separation of the parking area from the sidewalk area. This is particularly important since Frank Ghent did literally blackmail us for $250 for the privilege of putting in a power pole in this area last summer. We paid the $250 because it was cheaper to pay him than it was to take him to court and involve our contractor in the delay. 7. To Cbff
