Request for Variance - Easements
Susan,
This letter is in regards to the Spanjer Office Building project, and in particular, to request a
variance. Our client for this project is Spanjer Construction Corporation.
The specific area of concern is along the easterly boundary of the project. A 6' sidewalk has been
requested to be installed along the westerly side of the frontage road. Currently, the existing
Right -of -Way is approximately V west of the existing back of curb. There is also an existing 10'
utility easement west of the Right -of -Way line. Therefore, the developer would either need to
dedicate additional Right -of -Way to accommodate the new sidewalk, or he would need to
dedicate a 5' pedestrian access easement on top of the existing utility easement.
Given the unique constraints of the existing site, and the nature of the proposed improvements,
dedication of additional Right -of -Way would be detrimental to the site layout. After some
discussion with City staff, and the affected utilities, the idea of a combined easement was
suggested, and was generally agreed to be a feasible alternative.
Therefore, on behalf of our client, we are requesting a variance to City standards to allow a
pedestrian easement be dedicated within the existing utility easement, instead of dedicating
additional Right -of -Way.
We feeljustitied in requesting the variance. This allows pedestrian and utility access while
optimizing the space of the site. We do not feel that this variance will be detrimental to the public
health, safety or welfare, nor will it cause conflict between the easements.

Dear Roger,
This letter is in response to the variance requests, dated April 18, 2002.
The variance request to Table 7-3, minimum distance between driveway and a street
intersection has been granted. The driveways for lots 90, 108, and 63 may be constructed
as shown.
The variance request to Table 7-3, minimum 12' distance between driveway edges has
been granted. The driveways may have less than the 12' distance between them because
of their cul-de-sac location.
The variance to section 9.4.2 requiring that driveway approaches intersect at 90 degrees,
plus or minus 10 degrees has been granted. The driveway approaches may be
constructed as shown on the plans.
This variance request does not set a precedence or change the application of our design

Ref.: Spanjer Office Building Planning Objectives
Dear City Review Staff,
We are pleased to submit this statement of planning objectives for Spanjer Office Building. The
following information was prepared in compliance with the Submittal Requirements for type I
Project Development Plan Review for commercial sites.
Spanjer Office Building is located at Cameron Drive, adjacent to the College Avenue frontage
road. The property is currently zoned C-commercial and is a vacant lot. The zoning for the
property is to remain commercial.
The total project is approximately .45 acres in size. A 3613 s.f. office building is proposed with a
920 s.f. storage unit The building will be occupied by Spanjer Construction and one other office
tenant. In general, the site slopes from the northwest to the southeast.
The landscaping will be designed to meet a 6% internal landscape requirement and incorporate
xeriscape principles where applicable. The landscape will also serve functional uses such as
screening near property lines or enhancing views into and out of the site. Standard street tree
spacing is used on Cameron Drive but can not be incorporated along the frontage road due to the
existing utility easement.
Parking will be contained within the site and will include nine standard spaces and one handicap
accessible space.
Please see accompanying engineering report for a description of existing and proposed utilities
including sewage disposal, water supply, stormwater facilities, and fire protection. Also see
engineering drainage reports.

The Fort Collins - Loveland Water District and the South Fort Collins Sanitation District have reviewed
the above mentioned request and submit the following comments.
There are District water meter pits located within the easement. The meter pits cannot be located
under the sidewalk or within 10 feet of landscaping, such as trees. The relocation of the meter pits
must be done in accordance with District requirements and standards.

RE: Variance Request for the Spanjer Office Building
Northern Engineering Services Inc., on behalf of the Developer for the Spanjer Office Building project,
has submitted a variance request to the City of Fort Collins design standards. In accordance with detail
7-8F, the Developer is required to dedicate a 9' utility easement from the back of walk. The property in
question is bordered on the east by the College Avenue Frontage Road (a modified Connector Local
street with an attached walk) and the west by Cameron Drive (a Connector Local street). The variance
is for overlapping the existing 10' utility and the proposed 6' attached sidewalk in order to preserve the
platted site layout.
This variance request was routed to the City's Light and Power, Stormwater, and Water/Wastewater
departments, as well as PSCO/Excel, Qwest, AT&T, and the Fort Collins Water District. Only two
utilities returned concerns, AT&T and the FCLWD. AT&T requires that two existing 2" PVC duct lines
along the frontage road be relocated and the FCLWD requires that all District water meter pits be
relocated behind the sidewalk and at least 10 feet away from landscaping, such as trees. Both of these
items will be addressed at the Utility Coordination meeting to be scheduled prior to construction. No
other utility or department had problems or concerns with granting this variance.
It is my opinion that this variance can be supported based on the fact that the Utilities find it acceptable
as long as their requirements are met and granting the overlapping utility easement and sidewalk will not
adversely affect or harm the City of Fort Collins in any way.
