The variance request applies to Section 4.1.18(B)4 of the Larimer County Land Use Code.
This portion of the Code states that no pace) can be used for more than one principal building.
The request is to allow two principal buildings on one parcel located at the northwest corner of
South College Avenue and Trilby Avenue.
WHAT CIRCUMSTANCES JUSTIFY THE PROPOSAL? Please address each of the Review Criteria
listed on front sheet.
The applicant agrees to condominiumize the second principal building which will comply with
the City of Fort Collins code for two buildings on one site when the property gets annexed into
the City. The proximity of the site to the City of Fort Collins and the existing Commercial zoning
surrounding the site are additional factors for the request.

segment of Trilby Road_ There is a stepped, timber retaining

wall adjacent to the eastbound through/right-turn lane. This leg
of Trilby Road is constrained. Widening to the south is not
possible without acquisition of right-of-way and demolition of
the house. The existing condition is substandard by a few
hundred feet, but has been in existence for a number of years.
As reported in the "Eckerd Drug Store Transportation Impact
Study," (Eckerd TIS) March 2003 (Figure 9), the eastbound left -
turn lane will have a forecasted volume of 210 vehicles per hour
(vph) in the morning peak hour and 150 vph in the afternoon peak
(L
hour. It is expected that during all other hours of the day, the
left -turn movement will not exceed these volumes. According to

LCUASS, the eastbound left -turn lane should provide for

deceleration (using the design speed of a minor arterial street -

50 mph) and storage for the highest number of peak hour left

turns. The deceleration portion of the left turn is 4-15-_feet,

which includes a bay taper of 200 feet, for a 12 foot lane. The

storage requirement is 210-290 feet (minimum -desirable). Using

the cited criteria, this lane would need to be 645-725 feet long.

Control Plan Update Report," February 2002. It can be reasonably

concluded that application of the criteria shown in LCUASS,
Figure 8-2 is not intended to be applied universally. If this

were done, then both land use and access aspects of "City Plan"

would not be possible.
In the short range (2006) future, the access to the Eckerd Drug
Store site is intended to allow full turning movements. This is
discussed in the cited Eckerd TIS. This will be a temporary
condition, lasting only until alternative access is gained through the
property that borders the Eckerd site to the west and north. This
alternative access will not likely occur until a development proposal
is put forth on that property. The location of the proposed driveway
to Trilby Road is approximately 275 feet west of the stop bar on
Trilby Road at College Avenue. This distance will allow for storage
of the forecasted eastbound left turns. It is likely that College
Avenue would remain at its current width in the short range future.
Therefore, the stop bar would remain in the location considered in
this analysis. In addition to this left -turn lane, an eastbound left -
turn lane should also be striped on Trilby Road west of the proposed
driveway. This lane will provide storage and deceleration for left -
turning vehicles entering this driveway from the west. West of the
proposed site access, the left -turn lane should extend 300 feet which
includes a bay taper of 140 feet using the posted speed of 35 mph.
Since there will be widening of Trilby Road (to the north) in order to
accommodate the two left -turn lanes, it is recommended that the left -
turn lane approaching College Avenue not have a bay taper. It would
be striped as a continuous left -turn lane from the stop bar at College
Avenue to the proposed driveway. A schematic of the proposed striping
plan is shown in Figure 1. This striping plan will provide for more
than the required storage. The deceleration aspect of the left -turn
lane is not provided. In this regard, the following should be
considered:
1. This; is a temporary condition that will only exist until
the alternative access is gained through the adjacent
property. When this occurs, this access will be changed to
right-in/right-out.
2. There is a signal at the College/Trilby intersection_
College Avenue is the primary street. Analyses indicate
that. >_ 70 percent of the time in a given cycle, Trilby Road
will. have a red signal indication. Therefore, most of the
time eastbound vehicles approaching College Avenue will be
decelerating regardless of whether they are left -turns or
through vehicles. As such, the need for deceleration is
diminished.
3. While staff (County and City) indicates that the
College/Trilby intersection is problematic, with this
development, the cross section of Trilby Road will be
improved. Widening will occur to the north, which will
provide for 12 foot lanes on Trilby Road. This will be a
significant improvement over the existing 9 and 10 foot
lanes. This should improve what is likely the most
problematic aspect of this intersection_
For the above reasons, a temporary variance is requested with
regard to the length of the eastbound left -turn lane on Trilby Road
approaching College Avenue, and a request that this driveway be
allowed to function as a full -movement intersection on an interim
basis until reasonable alternative access is gained through the
adjacent property. This variance is not expected to increase the
maintenance costs for this segment of Trilby Road. In addition, it is
not anticipated that this variance from the standard will compromise
the public health, welfare, and safety. It is respectfully requested
that this variance be granted.

40- This is a Site Plan application for a proposed general retail use within an existing Commercial
zone parcel. The site is located at the northwest comer of College Avenue and Trilby Road
intersection and comprises approximately 4 acres. It is each of the owner's intentions to comply
with the codes and regulations of the Latimer County Land Use Code.
Background
Existing Use
The property is 4.01 acres in size, and it is located at the northwest comer of College Avenue and
Trilby Road. The site generally slopes from south to north and is currently used as a commercial
business (Zoned C). The east and south sides of the property are adjacent to roadways. The north
and west sides of the property are bordered by vacant land.
Proposed Use
The intended use of the site is general retail allowed per the Latimer County Land Use Code
within an area zoned Commercial. The specific use for the site is a single building drug store
occupying '14,000 s.f. with loading and other services located away from College Avenue.
Character
The character of the drug store is to comply with the surrounding neighborhood and work with
future development occurring to the north and west of the site. Additional right-of-way is being
granted to allow for the expansion of College Avenue and Trilby Road.
Access
Access to the property would be via College Avenue (right in/right out) and "trilby Road (full
turn). The full turn movement on Trilby will become a right in/right out access upon the
development of the property to the west, which wraps the site. The property to the west will have
a full turn movement upon which the drug store site will use this access for full turn movement.
Utilities
The Fort Collins/Loveland Water and South Fort Collins Sanitation District will serve the
property with water and sewer. Existing services are located in College and Trilby Avenues.
Land Use'Designation
The property is located within the Growth Management Area (GMA) thus subject to review by
Latimer County and City of Fort Collins. At this time, the property shall not be annexed but in
accordance with Section 4.2.1 (D)(9) of the Larimer County Land Use Code, the developer
agrees to a voluntary annexation once the property becomes eligible.

Project Description/Bac'k-round:
]'his is a proposed 14,000 sf retail/drugstore located at the northwest corner of S. College (287) & Trilby Road
(CR 34).
The project site lies within the City of Fort Collins Urban Growth Area and will therefore need to comply with the
requirements contained in the Intergovernmental Agreement (IGA) between Latimer County and the City of Fort
Collins.
Purpose:
The purpose of this memo is to document a discussion held on 8Ju103 with Tess Jones, CDOT, Tom Reiff & Sheri
Wamhoff. City of Fort Collins, Lisa Dunn, County Engineering, and Matt Lafferty, County Planning. This
discussion was mainly concerning traffic issues and adjacent road construction.
Geometry o 'rril v west of S. College:
1. Before staff can approve a decreased left -turn lane width (from 12' as required in the Larimer Countv Urban
Area Street Standards, to 9'), the applicant needs to provide more information regarding the existing and
future geometry at this intersection, especially in regards to matching the existing and future geometry of
Trilby east of S. College.
2. The applicant may wish to investigate the LCUASS in regards to allowable offset of lanes through
intersections.
3. If a bike lane or wide shoulder exists currently on Trilby, the development cannot eliminate the bike
lane/wide shoulder to provide asphalt needed for adjacent road improvements or tum lanes into the project.
Bike Lane:
1. The applicant needs to ensure that a bike lane will be striped on Trilby adjacent to the site.
2. Staff would like the applicant to investigate the possibility of continuing the bike lane further west on Trilby.
If this would require only re -striping (i.e. enough pavement is present to permit a bike lane), staff would
request this be a requirement of this applicant.
Transportation Impact Study:

1. The transportation impact study (TIS) needs to be modified with a letter from the traffic engineer. This letter
should discuss the impact from the proposed use with this current site plan, and remove the traffic generated
by future office use from the TIS.
Channelized Design of RI/RO on S. College:
1. The design of the right-in/nght-out on S. College needs to be approved by CDOT staff.
2. With the new TIS. as discussed above, the traffic generated by this site will likely not cause the need for
accel/decel lanes to be built on S. College. However, based on Section 1.9.3 of the Laniner County Urban
Area Street Standards (LCUASS), adjacent road improvements are required. This requires the applicant to
improve the portion of S. College (and appropriate transitions) that is adjacent to the site to the to Urban
Standards from the centerline of the road west (including bike lane, curb and gutter, sidewalks, etc.). Staff
believes that these adjacent road improvements will include accel/decel lanes on S. College to allow for the
channelized RURO. Please provide engineering plans to address this issue.
3. A bike lane needs to be striped north of the site to aid in the transition to its final location between the travel
lanes and accel/decel lanes adjacent to the site.
Right-of-Mlav Dedications:
1. The project will is adjacent to Trilby Road, which has been classified as a Minor Arterial, requiring an 84-foot
right-of-way (42-foot half right-of-way). However, staff would like the applicant to dedicate an additional 3.5
feet of right-of-way to accommodate a total 7' raised median (which will match the 4-lane Arterial east of this
intersection).
2. In order to accommodate the Trilby eastbound left -turn lane accessing the site, the applicant may need to
begin negotiations with the property owner west of this property.
3. In order to accommodate the S. College accel/decel lane, the applicant may need to provide right-of-way
above and beyond the stated right-of-way needs in the previous memo. The applicant may also need to begin
negotiations with the property owner north of this property in order to accommodate the S. College
accel/decel lane.
Other Issues:
1. The close proximity of the internal circulation drive to S. College remains unresolved.
2. CDOT's Hydraulic Engineer must review and accept this plan.
3. Issues regarding the signal pole relocation at the NW comer of Trilby and S. College remain unresolved.

They look good. I only have a few minor comments
Choice City letter - I believe in item number 2 under Airpark & SH 14/Frontage Road Intersections and
item number 1 under Link Lane & SH 14 Intersection it should be the westbound left turn lane not the
eastbound left turn lane that they need to look at.
Eckards Drugstore letter - Under the bikelane section it maybe worth mentioning that where a bike lane or
shoulder area does exist on Trilby Rd that they can not eliminate that. Looking at the aerial photo, there is
some shoulder in some of that area before the corner.
It would be an additional 3.5 feet that would be needed for the median (1/2 of the 7 foot median width).
We didn't discuss it but do we also need to tell them how much row needs to be dedicated on College? I
figured they needed to provided a half row of 82.5 feet (70.5 feet (1/2 of 141) + 12 feet for the right turn
lane that was shown to be needed in the traffic study).

associated with the ditch After cordwthg the m erviews requested by the North Louden Ditch
company, they issued the following letter.
Based on this letter we intend to cap the pipe running under College Avenue and adjust our on -site
dete,dion and SMing to account for any water that may "dMiD!' through the ditch by brmgmg the
Trilby Road pipe into our site.

Gentiemen:
North Loudon Ditch Company has been asked to determine the
status of a small lateral ditch at the above lo:ation that
terminates into a siphon under south College Avenue just north
of Trilby Road. (the "subject ditch")
The subject ditch was used solely by the Lynz Farm. The
Lynn Farm was developed many years ago (possiblt prior to
1975). we have no records of water being deliv3red through
that diten since it was developed. Mrs Lynn wh3 survived
Mr. Lynn sold her share(s) of North Louden Uitc1 Company
many years ago (we believe her shares were sold between 1970
and 19,80). Since the time her shares were sold we have had
no one wha•owned shares and who owned property north of Trilby Road
and east of South College Avenue.

abandoned for more than 20 years. A visual ilncaectioa of the
ditch shows that it is in extreme disrepair an6 may be plugged
on the east side at South College Avenue.

Dear Sheri:
The following is a request for variance from Table 7-5 — General Design Elements — Minimum
Curve Length in the "Larimer County Urban Area Street Standards, March 2001 ". This variance
is requested to allow portions of Trilby Road to be widened with horizontal curves in the north
flowlinc shorter than the standards.
The curves are located at the east end of Trilby Road approaching the intersection with College
Avenue. At this location near the intersection, the travel speeds will be low therefore a lower K-
value curve would not interfere with the comfort or safety of the vehicular traffic. To
accommodate the criteria, a large portion of Trilby Road would need to be reconstructed at a
lower elevation. this world be detrimental to the landowners adjacent to the south side of Trilby
that are already considerably higher than the existing elevations in Trilby Road. Also, the
lowering of Trilby Road would have a detrimental effect on the existing 8" and 24" waterlines in
Trilby by removing the required cover over these lines.
This variance from the above Standards will not be detrimental to the public health, safety and
wcl fare.

intersection will function alright.

In the very near future, the Colorado Department of Transportation (CDOT) will be issuing the State Highway Access
Permit for highway modifications and access changes related to the Eckerd store development. This letter commits CDOT
to that access permit #403119. Feel free to provide this letter to your lending facility or others who are concerned about
the status of permitting with CDOT's access unit.
As you know, I have been working with your engineers, the City of Fort Collins staff, and the Larimer County staff regarding
this development plan and highway changes. Some minor plan modifications are required - related to the pavement
markings and pedestrial pole at the Trilby intersection. I expect questions to be resolved early next week, and will then
receive revised plans. I will issue the Access Permit and Notice to Proceed at that time. (A separate Utility permit covers
all utility work for that development.)
I have received a copy of the legal documents initialed by the property owner (Front Range Ltd. Partnership/ Mr. Jeff
Timan) stating agreement to a shared access for the existing single family residence. This access permit will remove the
existing access for that portion of the Timan property, as well as an access into the redeveloping portion of the property
where the Eckerd site is being built.

If the appropriate amount of row does not already exist on College Ave and Trilby Road
they need to be dedicated with this project. From the Section line or center of the road a
minimum of 42.5 feet of row is needed on Trilby Road. From the Section line of center
of the roadway 82.5 feet (70.5 feet + 12 feet for the right turn lane that is shown to be
needed in the traffic study) of row is needed on College Ave.
Access onto College needs to be designed and built as a right -in right -out access point in
a form acceptable to CDOT, the County and the City. What has been shown does not
provide acceptable right -in right -out control.
CDOT approval is needed on all design and construction work on College Ave and any
work outside of the row that would affect the design or function of the State Highway.
No additional drainage can be added to the State Highway system (i.e. drainage from the
site or Trilby Road can not be directed onto the State Highway). An access permit will
need to be obtained from CDOT for the access point onto College Ave. No work can
occur within the State row until the access permit is issued.
May need to remove and relocate the curb and gutter on College Ave in order to provide
the room necessary to accommodate the right turn lane and the bike lanes needed on
College Ave for the interim situation.
Sidewalk should be installed along the frontage of the property at the back of the new
row line.
Design and install improvements to Trilby Road along the frontage of the property
including curb, gutter and sidewalk. Need to include intersection design and information
to show that the intersection will align and function acceptably.
All accesses need to provide adequate and appropriate turn lanes designed and built to
standards whether that be CDOT standards or LCUASS. It should be noted that the
access drive on Trilby will become a right -in right -out only access point in the future.
Any additional row that is needed (on -site or off -site) to accommodate the design and
installation of the turn lanes to standards whether it be the right turn lane on College Ave
or the left turn lame on Trilby Road will need to be provided with this project.
Site needs to be designed so that access to the surrounding parcels can be accomplished
in the future.
Off -site easements are needed for any work outside of the property boundaries

I need to run a quick question by someone from the City about a
variance request for the above, concerning the length of the left-hand
storage. I just wanted to know the City's position on it. Would this be
you, or someone else from your office?
This project has not been submitted for site plan review yet, but
should be within the next month or so.
Basically, it is concerning the left hand turn -lane on Trilby, turning
north onto College. Currently, there is a 140' storage, with 70' bay
taper.
Due to site constraints, they are requesting a variance from the
LCUASS. They will lengthen the lane to 160', plus 11 T taper (total
273'). If improvements are necessary on college, the lane will be 157',
plus 96' taper (total 253'). LCUASS states that 300' total is needed
(160' storage, 140' taper).
The current count is 186/hr in the morning. The site will add 5 peak
hour trips in the morning (Total 191). Matt Delich's year 2006 shows
210/hr in the morning. Using the rule of thumb that you need about one
foot per vehicle per hour of storage, the morning count is already over
with the new geometry.
Current count is 120/hr in the afternoon, with site adding 20 (Total
140).
I'd like to give them a general direction in the next week or so. My
thoughts, are that I would be willing to look at the 27' variance.
However, I'd be more likely to not support the 47' variance.
Would this be best to set up a meeting to discuss?

Project Description/Background:
This is a proposed 10,000 sf drugstore located at the northwest corner of S. College (287) & Trilby Road (CR 34).
The proposal has not yet been submitted for formal site plan review. However, the applicant has requested an
"initial reaction" to a variance request concerning the left-hand tum-lane from Trilby heading north on S. College.
This rcqucsl was discussed at a meeting held 5Feb03 with the applicant and consultants, along with County Staff.
The project site lies within the City of Fort Collins Urban Growth Area and will therefore need to comply with the
rcquiraments contained in the Intergovernmental Agreement (IGA) between Larimer County and the City of Fort
Collins.
Existim( Conditions:
Currently, the left-hand turn -lane from 7iilby heading north on S. College has 140' of storage and a 70' bay taper.
Variance Request:
The applicant has proposed to lengthen the existing left-hand turn -lane to 177' of storage and a 96' taper.
According to Matt Delich, consulting transportation engineer, this would result in a variance request of 27' from
the total length required at this location. If the adjacent improvements on S. College are built with this site plan,
the variance request would increase to 47'.
City Comments:
Sheri Wamhoff of the City of Fort Collins Engineering Department reviewed this proposal at County Staff's
request. She presented the information and proposal to the City's transportation coordination meeting on 6Feb03,
and provided the following response: "The intersection of Trilby and College is already problematic and we don't
want to make it any worse .... In general, we do not support the variance to the left turn lane design without seeing
any design or additional information for the intersection."
Staff Comments:
Engineering Staff has reviewed the request, and believes that a full -movement access at the proposed location
does not make sense, especially in light of the intersection concerns. Storage should not be compromised at an

already troublesome location, especially in consideration of the large amount of traffic that will be generated by
this development.
Before variances are considered. as a general policy, the County asks the applicant to pursue all avenues of
circumventing a variance request. Staff believes that the adjacent parcel can provide alternate full -movement
access. This may include building a private driveway on an access easement. Even though this access may be
temporary in nature. it can provide the drugstore needed full -movement access until the adjacent parcel is
developed (which may not occur for several years).
Even though the County's current functional classification of Trilby at that location is of a major collector, the
County should make every effort to ensure the road meets the design standards of the City's functional
classification (2-lane arterial). This includes recommended access spacing design criteria, and adjacent
construction improvements.
Staff Recommendation:
With the information as provided, the Engineering Staff can not recommend approval of the future proposed
variance at this time.
Next Step:
For a formal review of a variance request, the applicant should submit information at detailed in Section 1.9.4 of
the Larimer County Urban Area Street Standards.
If the Local Entity Engineer denies the variance request, the applicant has the right to appeal the decision to first
the Public Works Director, and then the Local Entity Goveming Body (in Larimer County, the Board of County
Commissioners).
