RESOLUTION NO. PZ95-21
OF THE PLANNING AND ZONING BOARD
OF THE CITY OF FORT COLLINS
VACATING A PORTION OF THE 10 FOOT WIDE
DRAINAGE AND UTILITY EASEMENT LOCATED ON LOT 9 OF
CLARENDON HILLS SUBDIVISION, 5th FILING
WHEREAS, Section 2-353 (4) of the Code of the City of Fort Collins authorizes the
Planking and Zoning Board to vacate certain easements and rights -of -way, by resolution or by
approval ofreplats containing notation of such vacation; and
WHEREAS, the Owner of Lot 9 of Clarendon IIills Subdivision, 5th Filing has requested
the vacation of a portion of the 10 foot wide drainage and utility easement more particularly
described on Exhibit "A", attached hereto and incorporated herewith by this reference; and
WHEREAS, ¢he house constructed on Lot 9 encroaches into a portion of the drainage
and utility easement as described on Exhibit "A"; and
WHEREAS, by vacation of the portion of the easement described on Exhibit "A" the
encroachment will be eliminated and the Owner will be able to obtain title insurance; and
WHEREAS, all public and private utility agencies have been notified of the vacation
request and report no objections.
NOW, THEREFORE, be it resolved by the Planning and Zoning Board of the City of
Fort Collins that the easement area more particularly described on Exhibit "A", attached hereto
and incorporated herewith by this reference, be and is hereby vacated.
Passed and adopted at a regular meeting of the Planning and Zoning Board of the City of
Fort Collins held this 23rd day of October, A.D. 1995.
