THIS AGREEMENT, made and entered into this 21st da,r
1967, by and between the undersigned owners as more fully
below, WITNESISETH:
THAT WHEREAS, on the 28th day of February, 1924, A, 1:.
conveyed by Warranty Deed Lots 1, 2, 3, 4, 7 and 8 in Block I .
Scott -Sherwood Addition to the City of Fort- Collins, to I-vin
which Deed was recorded on February 28th, 1924 in Boots 480,r.':
of the records of The Larimer County Clerk and Recordez•; ai,
WHEREAS, said Deed contained, inter alia, the fills>r;ii
restriction:
. the grantee herein expressly promises
and agrees that the residence or residence:;
to be erected on said lots by him or his
grantees shall not be erected nor (sic)
nearer than 65 feet from the E. lot line:
of each and every lot herein conveyed.
WHEREAS, Lot 8 in Block 10 aforesaid has now been CoJr;. :
to the City of Fort Collins, a municipal curporation, and 1.; '4,:
used for street purposes; and
WHEREAS, the houses located on the East t of Block 10
said are located nearer than 65 feet from the East Lot line:,
