7iHilLEAS, the plat of Blacks 1 and 2 of Smeeton's Subdivision of
Tract No. 8 of Er^igh's Subdivision of the South half of the Southeast o_uarter
of section 14, Township 7 worth, Range 69 'uIest of the 6th P.h. , recorded in
Plat 'Book No, 4 at page 96 of the LarYrer County records, shows rights of way
for a strout, connonly kimwn as Virginia Street, and far certain alleys in
said blocks; and
Li_r'tS, t1.e State Board of Agriculture has requested that the present
right of way for Virginia Street between West Lake and West Prospect streets
be vaca.tcd, and that alley ways dedicated in the area under the plat for Smeeton's
Subdivision also be vacated, and
0102ASP it appears that said alleys have never been opened to the
use of the public and the City of Fort Collins has never expended any public
funds upon said alleys, and said alleys are not needed for any public purpose,
and
WHEREAS, Colorado State University desires that said itii_LM of way be
vacated so that married housing units may be constructed in the area involved,
and
WHEREAS: the State Board of Agriculture has agreed Qat, if said rights
of wLy be vacated, said Virginia Street will be relocated, and a right of way
between West Lake and West Prospect streets wil_- be located East of the present
right of '.:ay on the apVroximate boundary line between the so—called it arbison
and Stonaker tracts, and
hE L�ES, Colorado State University has agreed that if the rights of
way arc vacat-ed, the alternate location of Virginia Street between West Lake
and West Prospect streets wilt be opened as an access prior to the closing of
Me present Virginia. Street right of way, and has further ai;reed that it will
!;.stall, at the expense of the University, :Ti c rL and curb and gutter on
both sides of the proposed Virginia Street right of way, and has further agreed
that it will provide off—street surfaced parking along the North and 'South boundaries
of the planned married housing tract lying an the North side of West Prospect
Streets and the South side of West Lake Street., which committment would involve
the installation by Colorado State University of curb and gutter along West
Prospect and West Lake streets adjacent to the new housing development, and has
further agreed that Colorado State University wills in co—operation with other
property owners, share in the cost of surfacing West Lake Street where it is
bounded on one side by University propertys and on the other side by private
property,, and will bear the full cost where bounded on both sides by University
propertys and
WHEREASP it is the opinion of the City Council that it will be to the
best interests of the City of Fort Collins to vacate said street and alleys in
consideration of the agreements made by the State Board of Agriculture and
Colorado State University;
NOW, THEREFORE., BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS:
Section 1. That Virginia Street as located between West Lake and
West Prospect streets., and which is more particularly described as follows
to —wit:
Beginning at the Northwest corner of Lot 11 in Block 1
of said Smeetonts Subdivisions and running thence South
526.5 feet to the Southwest corner of Lot 3 in Block 1
of said Smeetonts Subdivisions thence West 50 feet to
the Southeast corner of Lot 1 in Block 2 of said Smeetonts
Subdivisions running thence North 526.05 feet to the
Northeast corner of Lot 9 in Block 2 of said Smeetonts
Subdivisions and thence East 50 feet to the point of
beginning;
be and the same is hereby vacateds abolishedo and abated;
Section 2. That certain alleys, more particularly described as
follows to —wit:
Alley in Block 1 Beginning at the Southwest corner of
Lot 11 in Block 1 of said Smeetonts Subdivision and
running thence East 140 feet to the Southeast corner of
Lot 9 in Block 1 of said Smeetonts Subdivisions thence
South 267.7 feet,, more or lesso to the Northeast corner
of Lot 1 in Block 1 of said Smeetonts Subdivision, thence
West 140 feet to the Northwest corner of Lot 3 in Block 1
of said Smeetonts Subdivisions thence North 20 feet

Smeeton's Subdivision, thence East 130 feet to the
Southeast corner of Lot 4 in Block 1 of said Smeetonls
Subdivision, thence North 227.E feet to the Northeast

thence West 130 feet to the Northwest corner of Lot 8,
Block 1 of said Smeeton's Subdivision, and thence North
20 feet to the point of beginning;
Pin Block 2 Beginning at the Southeast corner of
9 in block 2 of said Smeeton's Subdivision, and
running thence West 143.4-feet to the Southwest corner
of Lot 11 in Block 2 of said Smeeton3s Subdivision,
thence South 264.8 feet, more or less, to the Northwest
corner of Lot 3 in Block 2 of said Smeeton's Subdivision,
thence East 143.4 feet to the Northeast corner of Lot 1
in Block 2 of said Smeeton's Subdivision, thence North
20 feet to the Southeast corner of Lot 4 in Block 2 of
said Smeeton's Subdivision, thence West 133*4 feet to
the Southwest corner of Lot 4 in Block 2 of said Smeetonts
Subdivision, thence North 22,4,9 feet to the Northwest
corner of Lot 8 in Block 2 of said Smeetonlo Subdivisions
and thence East133.4 feet to the Northeast corner of Lot 8
in Block 2 of said Smeeton's Subdivision, and thence North
20 feet to the point of beginning;
be and the same are hereby vacated, abolished, and abated;
