WHEREAS, the Park South P.U.D. was originally platted as a County subdivision approved by the Larimer County Planning Commission on February 15, 1978, and approved by the Larimer County Board of Commissioners on April 3, 1978; and WHEREAS, subsequent to said approval by the County, the Park South P.U.D. was annexed into the City of Fort Collins and replatted in part as the "Park South 2nd Filing P.U.D.", the "Park South P.U.D. First Replat" and the "Park South P.U.D. Second Replat", which replats were approved by the City of Fort Collins Planning and Zoning Board on, respectively, November 21, 1983, March 27, 1992, and July 27, 1992; and WHEREAS, the streets and easements that were dedicated on the plat of the original Park South P.U.D. have never been vacated, even though streets and easements that are intended to supersede those originally dedicated were laid out and dedicated on the Park South 2nd Filing P.U.D. and on both the first and second replats; and WHEREAS, the developer has requested that the streets and easements as dedicated on the original plat of the Park South P.U.D. be vacated except for Manhattan Avenue, Horsetooth Road, and such streets and easements to the extent that they bisect or overlap the streets and easements that were dedicated on the aforesaid replats; and WHEREAS, pertinent City agencies and private utility companies have been contacted and report no objection to the proposed vacations; and WHEREAS, there will be no cost to the City in making the proposed vacations; and WHEREAS, the rights of the residents of the City of Fort Collins will not be prejudiced or injured by the vacation of said streets and easements. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the streets and easements as dedicated and described on the County subdivision plat entitled "Park South P.U.D." approved by the Larimer County Planning Commission on February 15, 1978, and approved by the Larimer County Board of Commissioners on April 3, 1978, be, and the same hereby are, vacated, abated, and abolished; EXCEPTING AND RESERVING, however, Manhattan Avenue, Horsetooth Road, and such other streets and easements to the extent that, and at such locations as, they bisect or overlap any such streets, easements, rights -of - way, or other interests in real property as have been dedicated to the City pursuant to the plats of the Park South 2nd Filing P.U.D. and/or the Park South P.U.D. First Replat and/or the Park South P.U.D. Second Replat in the City of Fort Collins. Introduced, considered favorably this 20th day of April, A.D. 1993, and 4th day of May, A.D. 1993.
