f„ OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING A PORTION OF EXCESS STREET
RIGHT-OF-WAY FOR MCMURRY AVENUE AND RETAINING
THE SAME FOR UTILITY AND DRAINAGE EASEMENT PURPOSES

WHEREAS, the Council of the City of Fort Collins has received a request

from the Owner of Lot 1, Golden Meadows 3rd Filing, to vacate the excess public
right-of-way for McMurry Avenue adjacent to said lot more particularly described
on Exhibit "A," attached hereto and incorporated herein by this reference; and
WHEREAS, McMurry Avenue has been constructed to its ultimate width in this
location, and it is therefore no longer necessary or desirable to retain the
c r excess right-of-way for said street; and

WHEREAS, pertinent City agencies and private utility companies have been
contacted and report no objection to the proposed vacation upon the condition
that said right-of-way be retained for utility and drainage easement purposes;

WHEREAS, the rights of the residents of the City of Fort Collins will not
be prejudiced or injured by the vacation of said right-of-way and retention of
the same for utility and drainage easement purposes.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS
that that portion of the street right of way for McMurry Avenue which is adjacent
to Lot 1, Golden Meadows 3rd Filing, more particularly described on Exhibit "A,"
be, and the same hereby is, vacated, abated and abolished; RESERVING, HOWEVER,
if unto the City the said area for utility and drainage easement purposes.

DESCRIPTION OF A PORTION OF MCMURRY AVENUE TO BE VACATED
A portion of McMurry Avenue to be vacated, located in the South Half of Section
31, Township 7 North, Range 68 West of the Sixth Principal Meridian, City of Fort
Collins, Larimer County, Colorado, the said portion of McMurry Avenue is also
located adjacent. to Lot 1 Block 10 of the Plat of Golden Meadows Third Filing,
a Plat of Record with the Clerk and Recorder of the said Larimer County, more
particularly described as follows;
Commencing at the southeasterly most corner of the said Lot 1, Block 10, the said
southeasterly most corner is also the TRUE POINT OF BEGINNING of this
description;
THENCE along the southeasterly line of the said Lot 1 Block 10, North 32
degrees 40 minutes 20 seconds East for a distance of 78.35 feet;
THENCE continuing along the said southeasterly line of lot 1 Block 10,
South 89 degrees 46 minutes 20 seconds East for a
distance of 23.67 feet (plated as 23.69 feet) to the existing westerly right of
way of McMurry Avenue;
THENCE leaving the said southeasterly line of Lot 1 Block 10, South 32
degrees 40 minutes 20 seconds West for a distance of 90.69 feet to the
southeasterly prolongation of the southwesterly line of the said Lot 1 Block 10;
THENCE along the said southeasterly prolongation, North 58 degrees 21
minutes 51 seconds West for a distance of 19.98 feet to the point of beginning.
Containing 1688 square feet more or less.
