BEING AN EMERGENCY ORDINANCE RELATING TO THE VACATION OF TTIE
ALLEY IN BLOCK 1 OF CRAFTS' RESUBDIVISION OF LxKE PARK ADDITION
TO THE CITY OF FORT COLLINS.
WHEREAS, the City Council of the City of Fort
Collins has been petitioned to vacate the alley running in an
Easterly direction from Smith Street and dividing the North
and South part of Block 1 of Crafts' Resubdivision of lake
Park Addition to the City of Fort Collins, as shown upon the
plat of said Resubdivision; and
WHEREAS, it has been found that said petition
is signed by the owners of all the property in said Block
and is regular in form; and
WHEREAS, it appears that said alley has never
been opened to the use of the public and the City has never
expended any labor or money in connection with the maintenance
of said alley and said alley is a blind alley; and
WHEREAS, it further appears that the rights of
the inhabitants of the City of Fort Collins will in no way
be prejudiced or injured by the vacation of said alley and it
would be to the best interests of said property owners, as
well as the City of Fort Collins, that said alley be vacated.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL
OF THE CITY OF FORT COLLINS:
Section,l. That that certain alley as shown
upon the plat of Block 1 of Crafts' Resubdivision of lake
Park Addition to the City of Fort Collins running in an Easterly
direction from Smith Street and dividing the North and South
part of said Block 1, be and the same is hereby vacated and

from henceforth the said alley shall be treated as a part
of the lots abutting upon the same and all right, title and
interest therein shall and hereby becomes vested in the owners
of the lots abutting upon said alley as provided by law.
Section 2. Any and all expense incurred by the
City of Fort Collins .in. and about these proceedings shall
be paid by the petitioners seeking said vacation.
Section 3. In the opinion of the City Council
an emergency exists for the preservation of the public health,
peace and safety and this Ordinance shall take effect upon
its passage under and by virtue of the authority contained
in Sections 6 and 7 of Article IV of the City Charter.
Introduced, read at length and adopted by the
unanimous vote of all members of the City Council, at a
regular meeting of the City Council, held this 24th day of
June A. D. 1938.
