ORDINANCE NO. 160, 1998
OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING PORTIONS OF THE RIGHT-OF-WAY FOR AN
ALLEY DEDICATED IN BLOCK 103 OF THE CITY OF FORT COLLINS

WHEREAS, the plat of the Original City of Fort Collins dedicated to the public an alley
right-of-way within Block 103; and
WHEREAS, the Current Planning Department is considering a proposal for a project entitled
"Kruger Office Building, (Lot 20 of F.J. Spencer Subdivision)", which abuts said alley right-of-way;
and

�L WHEREAS, the approval of said project requires the vacation of the alley right-of-way
7° dedicated adjacent to Lot 20 more particularly described on Exhibit "A", attached hereto and
incorporated herein by this reference; and
WHEREAS, said portion of the alley right-of-way is no longer necessary or desirable to
retain because a portion of the alley was previously vacated and the portion proposed for vacation
serves only driveway and emergency access purposes; and
WHEREAS, pertinent City agencies and private utility companies have been contacted and
reported no objection to the proposed vacation, provided that an easement for utility, drainage and
emergency access be reserved unto the City; and
WHEREAS, the rights of the residents of the City of Fort Collins will not be prejudiced or
injured by the vacation of said alley right-of-way.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the portion of alley right-of-way more particularly described on Exhibit "A" is hereby
vacated, abated and abolished, reserving the same unto the City as an easement for utility, drainage
and emergency access purposes.

OF THE COUNCIL OF THE CITY OF FORT COLLINS
BEING AN ORDINANCE VACATING A PORTION OF THE
NORTH/SOUTH ALLEY IN BLOCK 103 OF THE CITY OF FORT COLLINS
WHEREAS, the City Council has been petitioned to vacate a portion of
the north/south alley in Block 103 of the City of Fort Collins, Colorado,
more particularly described below; and
WHEREAS, the portion of said north/south alley is not presently needed
as an alley or roadway; and
wFIFREAS, it appears that the rights of the residents of the City of
Fort Collins will in no way be prejudiced or injured by the vacation of
said portion of alley, provided that there is dedicated concurrently with
the passage of this ordinance an easeri;ent for utilities as are now con-
structed at said portion of alley.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the following section of the described portion of north/south
alley, more particularly described as follows, to -gait:
Corrmencing at the point 10 feet south of the northwest
corner of Lot 6; thence south 140 feet to the southwest
corner of Lot 4; thence 20 feet west to the southeast
corner of Lot 13; thence 140 feet north to a point 10
feet south of the northeast corner of Lot 11; thence 20
feet east to the point of beginning. More generally,
it is that portion of the north/south alley which lies
between the south 40 feet of Lots e and 11 and all of
Lots 4, 5, 12 and 13;
Be, and the same hereby is, abolished, vacated and abated.
