HomeMy WebLinkAboutGRIFFINS BLOCK 295 - Filed RV-ROW VACATION - 2004-03-19RCPTN # 93034672 05/28/93 11:57:00 # PAGEb - 2 FEE - $10.00 M RODENBERGER RECORDER, LARIMER COUNTY CO STATE DOC FEE - $.00 ORDINANCE NO. 46, 1993 OF THE COUNCIL OF THE CITY OF FORT COLLINS VACATING THE RIGHT-OF-WAY FOR AN ALLEY DEDICATED WITH GRIFFIN'S SUBDIVISION OF BLOCK 295 AND RETAINING THE SAME AS A UTILITY AND DRAINAGE EASEMENT WHEREAS, the Council of the City of Fort Collins has received a request from the owners of the properties adjacent to the alley right-of-way located in Griffin's Subdivision of Block 295, more particularly described on Exhibit A, attached hereto and incorporated herein by this reference; and WHEREAS, said right-of-way is no longer necessary nor desirable to retain for either private or public vehicular access except as it may relate to maintenance and installation of public and private utilities; and WHEREAS, City agencies, private utility agencies, and the Poudre Fire Authority have been notified and report no objection to the proposed vacation of alley right-of-way upon the condition that said right-of-way be retained as a utility and drainage easement; and WHEREAS, there will be no cost to the City in making the proposed right-of- way vacation and retaining the said area as a utility and drainage easement; and WHEREAS, the rights of the residents of the City of Fort Collins will not be prejudiced or injured by the vacation of said alley right-of-way. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that the alley right-of-way located in Griffin's Subdivision of Block 295, more particularly described on Exhibit A, be, and the same hereby is, vacated, abated, and abolished, retaining, however, unto the City the said area as a utility and drainage easement. Introduced, considered favorably on first reading and ordered published this 4th day of May, A.D. 1993, and to be presented —for final passage on the 18th day of May, A.D. 1993. Mayor ATTEST: p.� City Clerk \ Passed and adopted on final AT STO:M(��l► City Clerk readin h�18th da of ay, A.D. 1993. -Mifof i try n ;.C+T COLLINS �^ EXHIBIT A i DESCRIPTION OF A 20.00 FEET WIDE ALLEY TO BE VACATED A 20.00 feet wide alley to be vacated located in the Northwest Quarter of section 11 Township 7 North, Range 69 West of the Sixth Principal Meridian, City of Fort Collins, Larimer County, Colorado, also being located in the Plat of Griffin's Subdivision of Block 295, a Plat of record with the Clerk and Recorder of the said Larimer County, more particularly described as follows; The East-West 20.00 feet wide alley located in the said Plat of Griffin's Subdivision of Block 295, lying between the east right of way of Wood Street and the prolongation of the west right of way of the north -south 20.00 feet wide alley as shown on the said Plat. I hereby state that the above description was prepared by me and is true and correct to the best of my professional knowledge, belief and opinion.
