U 0 NOW, THEREFORE, be it resolved by the Planning and Zoning Board of the City E of Fort Collins, that the blanket utility, access, and drainage easement dedicated on Tract ID �D B of Woodland Park Estates PUD more particularly described as follows to wit: • U `� ra Tract B of Woodland Park Estates, P.U.D., City of Fort Collins, Larimer w County, Colorado according to plat recorded January 5, 1997 at Reception a Number 96001446 EXCEPT: a 13 foot utility easement running parallel to the 0 South of Tract B (as depicted on the plat), and EXCEPT: a 5 foot drainage easement running parallel to the North property line of Tract B, and a 6 foot w utility easement also running parallel to the North property line of Tract B (as depicted on the plat) 0 U rn i be and is hereby vacated. PZ97-3 OF THE PLANNING AND ZONING BOARD OF THE CITY OF FORT COLLINS VACATING A PORTION OF THE 20 FOOT WIDE UTILITY AND DRAINAGE EASEMENT ON LOTS 12 AND 13 OF THE WOODLAND PARK ESTATES P.U.D. WHEREAS, Section 2-353 (4) of the Code of the City of Fort Collins authorizes the Planning and Zoning Board to vacate certain easements and rights -of -way, by resolution or by approval of replats containing notation of such vacation; and WHEREAS, the Owner of Lots 12 and 13 of the Woodland Park Estates P.U.D. has requested the vacation of a portion the 20 foot wide utility and drainage easement on said Lots dedicated with the original plat of the Woodland Park Estates P.U.D. and more particularly described on Exhibit "A", attached hereto; and z WHEREAS, the Owner has redesigned the utilities and drainage originally planned to be within the 20 foot wide easement on said lots; and WHEREAS, due to the relocation of said utilities and drainage facilities, the portion of the 20 foot wide utility and drainage easement which was to be occupied by said utilities and facilities is no longer necessary to retain for utility or drainage r purposes; and z WHEREAS, all public and private utility agencies have been notified of the R vacation request and report no objections. r NOW, THEREFORE, be it resolved by the Planning and Zoning Board of the City of Fort Collins that the portion of the 20 foot wide utility and drainage easement on Lots 12 and 13 of the Woodland Park Estates P.U.D. more particularly described on Exhibit "A", attached hereto and incorporated herewith by this reference be and is hereby vacated. Considering the South line of said Lot 12 as bearing S 61°30'24" E according to said plat. Commencing at the SouthWest Corner of said Lot 12; thence along the North line of a 20' Util. & Drain.
