ORDINANCE NO. 179, 1986
OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING A UTILITY EASEMENT
ON LOT 12, BLOCK 272 OF THE
WEST SIDE SUBDIVISION
WHEREAS, the Council of the City of Fort Collins has been petitioned
to vacate a utility easement located on Lot 12, Block 272, West Side
Subdivision, set forth in more particular below; and
WHEREAS, the owners of the property have determined that an incorrect
easement description was filed with Larimer County at the time of original
dedication; and
WHEREAS, this ordinance would vacate the incorrect easement and
provide an opportunity for the acceptance of the dedication of the correct
easement, which easement already houses electric utility lines; and
WHEREAS, all utilities have been contacted and indicate no problems
with the vacation; and
WHEREAS, the rights of the residents of the City of Fort Collins will
in no way be prejudiced or injured by said vacation.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that the utility easement located on Lot 12, Block 272, West Side
Subdivision set out more particularly as follows, to wit:
A five foot wide easement located on Lot 12, Block 272, West Side
Subdivision, Range 69, Township 7, County of Larimer, City of
Fort Collins, State of Colorado. The center of the easement
described as follows:
Commencing at the Northeast of said Lot 12, Block 272, West Side
Subdivision, thence due south along property line 50.5 feet to
the True Point of Beginning, thence west 32.5 feet, thence south
13 feet to the Point of Termination.
be, and the same hereby is, vacated, abated and abolished.
Introduced, considered favorably on first reading, and ordered
published this 4th day of November, A.D. 1986, and to be presented for
final passage on the 18th day of November, A.D. 198 .
