THIS AGREEMENT, made and entered into this 25th day
of February Ao D. 19 65 , by and bewtween THE CITY OF FORT
COLLINS, a mur^.cipal r,-�rporation, hereinafter designated as first party,
and University Acres, Inc,
Hereinn.ft-.r designated as second party, WITNESSETH:

pl.t of the su'e.iv ;aion to be known as University Acres Ninth Subdivision
For e-)proval by the Municipal Planning and Zoning Board and
t'�.s City Cc:,ncil of the City of Fort Collins, and
47'=„' SQ se.-_d subdivision plat is acceptable to first party
a::,d first party's Planning and Zoning Board, subject to construction of
utilities in the area to be subdivided,
NUt, THEREFOP.E, in consideration of the premises and the terms
of this agrocre:':t, it is mutually agreed as follows:
1e F'_:: party agrees that said subdivision plat shall be,
and the same is hereby approved.
In ro.isideration of the approval of said plat by first
party, and f=rct par'_-'s Planning and Zoning Board, second party agrees
as
(A) To submit to first party the following detailed
improvemntt pl^n-, a^c^ptable to the first party:
(1) A plan of the proposed water distribution system
including the c -n ecting pipelines to the points of connection to the
first party's e.,J-P,tirg wa+,er distribution system and showing all valYes
and fire hya +
(2) Plans and profiles of the proposed sanitary sewer
system including all manholes and connections to the first party's
existing sanitary sewer system.
(;) A plan of the proposed electrical distribution system
including conn-ting lines to the first party's existing electrical
distril-ti.cn - te' a w including all street lights.
O;) Plj.ns and profiles of all street improvements.
O Pln�,s and profiles of the proposed street drainage
system s' ^:,C -_.3 orAjeetinns to the first party's storm sewer system
and ir.clud Ig all storm sewer inlets and manholes.
(6) Items A (1) to A (5) inclusive are to be financed by the
party of the second part, excepting only Item (3) electrical distribution
system, All material required for street lights are to be paid for by
the party of the second part to the Light & Power De7,.rtment of the City.
In the event the City of Fort Collins shall require larger
ti,°a4or mains, sanitary sewer mai^s or storm sewer mains to be constructed
i4thin the subdivision than would be required by standard engineering
h -iceO.ces to serve the subdi_visicn, in order to prop:rly extend these
services to other areas, the City of Fort Collins will pzy a portion of
t o test of such enlarged facility based on prorat_on of the cost of the
actually constructed and the estimated cost of Curh facility as
:7rzm on t e subdivider°s approved plan, Such prorat:.�;n o£ costs between
the City of Fort Collins and the subdivider shall be determined in advance
of construction by the City Engineer and in the event of any dispute this
shall be submitted to the City Council for final determination.
IN WITNESS WHEREOF, first party has caused these presents to
be si,ned by its Mayor and its corporate seal to be here ttest
to by its City Clerk, pursuant to motion of the Council of the C ,;y of
Fort Collins dated the 4th day of Februarr
A. D., 19 65 , and second party has hereto set his hard and seal the day
and year first hereinabove written.
