ORDINANCE NO. 78 , 1983
OF THE COUNCIL OF THE C=OF FORT COLLINS
VACATING A PORTION OF A BLANKET EASEMENT IN
UNDERHILL P.U.D., PHASE 1 ALLOWING THE BUILDING
ENVELOPE TO EXTEND INTO THE EASEMENT LESS THAN TWO FEET
WHEREAS, the Council of the City of Fort Collins has been petitioned
to vacate a portion of a "blanket" utility easement located on Blocks 1 and
2, Underhill P.U.D., Phase 1, set forth more particularly below; and
WHEREAS, during construction buildings were inadvertently placed 1.63
feet within the easement; and
WHEREAS, there are no utilities within the area requested for vaca-
tion; and
WHEREAS, the rights of the residents of the City of Fort Collins will
in no way be prejudiced or injured by said vacation.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that that portion of a "blanket" utility easement located on Blocks
1 and 2, Underhill P.U.D., Phase 1, set out more particularly as follows,to
wit:

Considering the west line of the Plat of Underhill At Fort
Collins, Phase I, as bearing S 00°22'28" East and with all
bearings contained hereon relative thereto:
Commencing at the northwest corner of said Plat, thence along the
said west line S 00°22'28" East 145.86 feet; thence N 89°37'32"
East 42.86 feet to the northwest corner of Building Envelope B
said Plat of Underhill at Fort Collins and the True Point of
Beginning of this description; thence N 89°37'32" East 103.00
feet; thence S 00°22'28" East 1.63 feet; thence N 89028100"
West 103.01 feet to the True Point of Beginning; containing 0.002
acres, more or less.
Considering the west line of the Plat of Underhill At Fort
Collins, Phase I, as bearing S 00°22'28" East and with all
bearings contained herein relative thereto:
Commencing at the northwest corner of said Plat thence along the
said west line S 00°22'28" East 253.86 feet; thence N 89°37'32"
East 42.86 feet to the northwest corner of Building Envelope C
said Plat of Underhill at Fort Collins and the True Point of
