ORDINANCE NO. 178, 1986
OF THE COUNCIL OF THE CITY OF FORT COLLINS
VACATING A PORTION OF THE BLANKET EASEMENT
ON LOT 1, OF THE TERRACES, P.U.D.
WHEREAS, the Council of the City of Fort Collins has been petitioned
to vacate a portion of the blanket easement located on Lot 1 of the
Terraces P.U.D., set forth in more particular below; and
WHEREAS, the owners of the property have requested that the building
envelope approved on the original plat be relocated five feet to the south
to provide a full depth loading bay at the rear of the building which would
remove service vehicles from the driveways; and
WHEREAS, this change in building envelope can be approved
administratively but requires a vacation of a portion of the blanket
easement to accommodate the change; and
WHEREAS, all utilities have been contacted and indicate no problems
with the vacation; and
WHEREAS, the rights of the residents of the City of Fort Collins will
in no way be prejudiced or injured by said vacation.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that a portion of the blanket easement located on Lot 1, of the
Terraces P.U.D. set out more particularly as follows, to wit:
A tract of land located in the Northeast quarter of Section 16,
Township 7 North, Range 69 West, of the 6th P.M. of Larimer
County, Colorado, being a portion of Lot 1 of the Plat of Replat
No. 1 of the Terraces P.U.D., a Plat of record with the Clerk and
Recorder of said Larimer County, more particularly described as
follows:
Considering the West line of the said Plat of Replat No. 1 of the
Terraces P.U.D. as bearing North 00'32'00" West and with all
bearings contained herein relative thereto:
Commencing at the Southwest corner of the said Plat; thence along
the said West line, North 00°32'00" West 69.37 feet; thence
leaving the said West line, North 89°28'00" East 23.00 feet to
the Southwest corner of the building envelope in the said Lot 1,
as shown on the said Plat and to the TRUE POINT OF BEGINNING of
this description; thence along the South line of the said
building envelope, North 89°28'00" East 40.00 feet; thence
leaving the said South line, South 00'32'00" East 11.57 feet;
thence South 89° 28'00" West 40.00 feet; thence North 00'32'00"
West 11.57 feet to the Point of Beginning.
The above described tract contains 463 square feet and is subject
to all easements and rights -of -way now existing or of record.

Introduced, considered favorably on first reading, and ordered
published this 4th day of November, A.D. 1986, and to be presented for
final passage on the 18th day of November, A.D. 1986.
