00 VACATING THE 15 (FIFTEEN) FOOT UTILITY AND
DRAINAGE EASEMENT DEDICATED ON LOTS 1 AND 2 OF THE
TELLEZ ESTATES SUBDIVISION
WHEREAS, Section 2-353 (4) of the Code of the City of Fort Collins authorizes the
Planning and Zoning Board to vacate certain rights -of -way, by resolution or by approval
w of replats containing notation of such vacation; and

w WHEREAS, the Owner of Lots 1 and 2 of the Tellez Estates Subdivision has
requested that the City vacate the 15 (fifteen) foot utility and drainage easement dedicated
on Lots 1 and 2 of the Tellez Estates Subdivision and more particularly described below;

< m WHEREAS, the vacation request has been reviewed and approved by the pertinent
°' City and private utilities, and they report no objections.

" NOW, THEREFORE, be it resolved by the Planning and Zoning Board of the City
o F of Fort Collins, that the 15 (fifteen) foot utility and drainage easement dedicated on Lots
z 1 and 2 of the Tellez Estates Subdivision more particularly described as follows to wit:

u A 15.00 foot wide utility and drainage easement situate in Lots 1 and 2,
w Tellez Estates Subdivision, City of Fort Collins, County of Larimer, State of
a Colorado which begins at the Northwest corner of said Lot 2 and run thence
S 89°56'14" E 230.00 feet; thence S 00004'13" E 15.00 feet; thence N
89056'14"'W 213.66 feet; thence N 47°26'45" W 22.21 feet to the point of
w beginning.
