VACATING A PORTION OF A BLANKET ACCESS, UTILITY,
DRAINAGE, AND POSTAL EASEMENT
LOCATED ADJACENT TO LOT 12 OF
SPRING CREEK PROFESSIONAL PARK P.U.D.
WHEREAS, Section 2-353 (4) of the Code of the City of Fort
Collins authorizes the Planning and Zoning Board to vacate certain
rights -of -way, by resolution or by approval of replats containing
notation of such vacation; and
WHEREAS, the Owner of Spring Creek Professional Park P.U.D.,
City of Fort Collins, Larimer County, Colorado, has requested that
the City vacate a portion of a blanket access, utility, drainage,
and postal easement adjacent to Lot 12 of said P.U.D. and more
particularly described below; and
WHEREAS, the said portion of said blanket easement is no
longer necessary to retain and the vacation request has been
reviewed and approved by the pertinent City and private utilities,
the U.S. Postal Service,and the Poudre Fire Authority and they have
no objections.
NOW, THEREFORE, be it resolved by the Planning and Zoning
Board of the City of Fort Collins that the portion of the access,
utility, drainage, and postal easement more particularly described
as follows, to wit:
A part of Outlot B of the Spring Creek Professional Park
P.U.D., located in the Northeast 1/4 of Section 22, Township
7 North, Range 69 West, of the Sixth P.M., City of Fort
Collins, County of Larimer, State of Colorado, which,
considering the east line of said Northeast 1/4 as bearing
N 00' 10' 30" W, and with all bearings contained herein
relative thereto, is contained within the boundary lines which
begin at a point which bears N 00' 10' 30" W 267.82 feet and
again S 89° 49' 30" W 418.00 feet from the East 1/4 corner of
said Section 22, and run thence S 89' 49' 30" W 20.00 feet;
thence N 00° 10' 30" W 20.00 feet; thence N 89°49130" E 20.00

RECOMMENDATION: Staff recommends approval of Resolution PZ94-7
EXECUTIVE SUMMARY:
The applicant has requested the vacation of a portion of the
blanket access, utility, drainage, and postal easement adjacent to
Lot 12 as shown on the attached sketch. The Owners of the Spring
Creek Professional Park P.U.D. have submitted an Administrative
Change to allow the construction of a gazebo adjacent to Lot 12
along Spring Creek. The area platted outside the building
envelopes is a dedicated access, utility, drainage, and postal
easement. Therefore, the portion of the easement beneath the
proposed structure must be vacated since no structures are allowed
to encroach into a platted easement.
The request has been reviewed by the public and private utilities,
the Poudre Fire Authority, and the Postal Service and they report
no objections to the proposed vacation. Therefore, the applicant's
Administrative Change request has been approved with the condition
that the portion of the blanket easement beneath the proposed
gazebo be vacated.

Attached for your review and comment is a sketch showing a portion
of an easement proposed for vacation at the Spring Creek
Professional Park, located just west of Shields Street, east of
Spring Creek and north of Rolland Moore Park.
The applicant is proposing to construct a gazebo adjacent to Spring
Creek as shown on the attached sketch. The gazebo is proposed to
be located in a portion of Outlot "B" which is an access, utility,
drainage, and postal easement and therefore the applicant is
requesting vacation of that portion of the easement.
Please return any comments to me by THURSDAY, MARCH 19, 1992. If
I do not hear from you by this date, I will assume you have no

OF THE PLANNING AND ZONING BOARD
OF THE CITY OF FORT COLLINS
VACATING A PORTION OF AN ACCESS,
UTILITY, DRAINAGE, AND POSTAL EASEMENT
IN THE SPRING CREEK PROFESSIONAL PARK, P.U.D.
WHEREAS, Section 2-353 (4) of the Code of the City of Fort
Collins authorizes the Planning and Zoning.Board to vacate certain
rights -of -way, by resolution or by approval of replats containing
notation of such vacation; and
WHEREAS, the Owner of the Spring Creek Professional Park,
P.U.D., City of Fort Collins, Larimer County, Colorado, has
requested that the City vacate a portion of an access, utility,
drainage, and postal easement on Outlot "B" in said P.U.D.; and
WHEREAS, that portion of said easement is no longer necessary
and the vacation request has been reviewed and approved by the
pertinent City and private utilities and the Postal Service and
they have no objections.
NOW, THEREFORE, be it resolved by the Planning and Zoning

VACATING ALL UTILITY EASEMENTS IN THE FIRST
REPLAT OF SPRING CREEK MANOR, P.U,D,
WHEREAS, the Council of the City of Fort Collins has been petitioned
to vacate all easements located in the First Replat of Spring Creek Manor,
set forth in more particular below; and
WHEREAS, the original easements are no longer needed as new easements
have been dedicated on the property as Spring Creek Professional Park
P.U.D., which replat has been approved by the Planning and Zoning Board on
April 28, 1906; and
WHEREAS, all utility companies have been contacted and indicate no
problems with the vacation; and
WHEREAS, the rights of the residents of the City of Fort Collins will
in no way be prejudiced or injured by said vacation.
NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT
COLLINS that those utility easements located within the plat of the First
Replat of Spring Creek Manor, P.U.D., set out more particularly as follows,
to wit:
All of the existing easements being located within the boundaries
of the Plat of First Replat of Spring Creek Manor, P.U.D., being

EXECUTIVE SUMMARY:
This Ordinance was unanimously adopted on First Reading on September 2.
The owners of Spring Creek Professional Park are requesting the vacation of
all easements of record on the first replat of Spring Creek Manor, P.U.D.
This area was replatted and approved by the Planning and Zoning Board on
April 28, 1986 as Spring Creek Professional Park.
All utilities have been contacted and indicate no problems with the
vacation.
