OF THE PLANNING AND ZONING BOARD
OF THE CITY OF FORT COLLINS
VACATING THE STORM DRAINAGE EASEMENT
IN THE STETSON CREEK P.U.D., 1st FILING
DEDICATED BY DEED AT RECEPTION #95000804
AND FILED WITH THE LARIMER
COUNTY CLERK AND RECORDER
WHEREAS, Section 2-353 (4) of the Code of the City of Fort
Collins authorizes the Planning and Zoning Board to vacate
certain easements and rights -of -way, by resolution or by approval
of replats containing notation of such vacation; and
WHEREAS, the Owner of certain real property in Larimer
County, Colorado legally described at Reception #94098090, also
known as the Stetson Creek P.U.D., 1st Filing, has requested the
vacation of the storm drainage easement more particularly
described on the deed recorded with the Larimer County Clerk and
Recorder at Reception #95000804; and
WHEREAS, the storm drainage easement dedicated with said
deed is no longer necessary nor desirable to retain; and
WHEREAS, the vacation request has been reviewed and approved
by the pertinent City and private utility agencies and they
report no objections.
NOW, THEREFORE, be it resolved by the Planning and Zoning
Board of the City of Fort Collins, that the storm drainage
easement dedicated and more particularly described on the deed
recorded with the Larimer County Clerk and Recorder at Reception
#95000804, be and is hereby vacated.
Passed and adopted at a regular meeting of the Planning and
Zoning Board of the City of Fort Collins held this 27th day of
March, A.D. 1995. _)
