OF THE PLANNING AND ZONING BOARD
OF THE CITY OF FORT COLLINS
VACATING A PORTION OF A UTILITY EASEMENT
LOCATED ON LOT 21 OF VICTORIAN GABLES
PATIO HOMES AT SILVERPLUME P.U.D.
WHEREAS, Section 2-353 (4) of the Code of the City of Fort
Collins authorizes the Planning and Zoning Board to vacate certain
rights -of -way, by resolution or by approval of replats containing
notation of such vacation; and
WHEREAS, the Owner of Lot 21 of the Victorian Gables Patio
Homes at Silverplume P.U.D., City of Fort Collins, Larimer County,
Colorado, has requested that the City vacate a portion of a utility
easement on said Lot 21 of said P.U.D.; and
WHEREAS, said portion of said utility easement is no longer
necessary to retain and the vacation request has been reviewed and
approved by the pertinent City and private utilities, and they have
no objections.
NOW, THEREFORE, be it resolved by the Planning and Zoning
Board of the City of Fort Collins that the portion of the utility
easement more particularly described as follows to wit:
A part of the 12.00 foot wide utility easement situate on Lot
21, Victorian Gables Patio Homes at Silverplume, P.U.D. which
begins at a point on the East line of the said easement which
bears N 00*26142" E 46.00 feet and again N 89°33118" W 27.00
feet from the Southeast corner of said Lot 21 and run thence
along the said East line, N 00°26142" E 46.36 feet, and again
along the arc of a 8.00 foot radius curve to the right a
distance of 4.95 feet, the long chord of which bears N
18"10113" E 4.87 feet; thence N 89°33118" W 5.48 feet; thence
S 00°26142" W 51.00 feet; thence S 89*33118" E 4.00 feet to
the point of beginning.
be and is hereby vacated.
Passed and adopted at a regular meeting of the Planning and
Zoning Board of the City of Fort Collins held this 22nd day of
February, A.D. 1993.
