OF THE PLANNING AND ZONING BOARD
OF THE CITY OF FORT COLLINS
VACATING CERTAIN IRRIGATION AND UTILITY EASEMENTS
LOCATED IN THE PROVINCETOWNE P.U.D., FIRST FILING
WHEREAS, the Section 2-353(4) of the Code of the City of Fort Collins authorizes the
Planning and Zoning Board to vacate certain easements and right-of-way, by resolution or by
approval of replats containing notation of such vacation; and
WHEREAS, the Owner of the Provincetowne P.U.D., First Filing has requested the
vacation of certain irrigation and utility easements more particularly described on Exhibit 1, Exhibit
2A, and Exhibit 2B, attached hereto and incorporated herewith; and
WHEREAS, the Owner of the Provincetowne P.U.D., First Filing has requested the vacation
of the existing irrigation lateral presently traversing the Provincetowne P.U.D., First Filing, as more
particularly described on Exhibit 3, attached hereto and incorporated herewith; and
WHEREAS, said easements are not necessary to retain since the irrigation laterals have been
abandoned and the parties in interest have executed quit claim deeds; and
WHEREAS, said easements are not necessary to retain for utility easement purposes; and
WHEREAS, public and private utility agencies have reviewed the request and report no
objection to the vacation of said irrigation and utility easements as requested; and
NOW, THEREFORE, be it resolved by the Planning and Zoning Board of the City of Fort
Collins that the irrigation and utility easements more particularly described on Exhibit 1, Exhibit 2A,
Exhibit 2B and Exhibit 3, attached hereto and incorporated herewith by this referenced, by and are
hereby vacated.
