WHEREAS, Section 2.1.5 of the Land Use Code of the City of Fort Collins authorizes the

Director of Community Planning and Environmental Services to vacate certain easements by

resolution or by approval of replats containing notation of such dedication; and

WHEREAS, the Owner has requested that the City vacate a portion of a utility easement
w C N
located on Lot 25, Block 3, Brown Farm Third Filing, more particularly described on Exhibits "A"
in
and "B"; and

WHEREAS, the vacation has been reviewed and approved by the pertinent City
Departments, which departments report no objections to the vacation.
NOW, THEREFORE, be it resolved by the Director of Community Planning and
Environmental Services of the City of Fort Collins, that a portion of a utility easement on Lot 25,
Block 3, Brown Farm Third Filing, located on Montadale Court, which portion is more particularly
described on Exhibits "A" and "B," attached hereto and incorporated herein by this reference, is
hereby vacated.
Passed and adopted at an administrative hearing held by the Director of Current
Planning as the delegee of the Director of Community Planning and Environmental Services of
the City of Fort Collins this r � lk day of November A.D. 2003.
