PZ96-I OF THE PLANNING AND ZONING BOARD OF THE CITY OF FORT COLLINS VACATING A PORTION OF A UTILITY AND ACCESS EASEMENT ADJACENT TO BUILDING Y OF THE PIER CONDOMINIUMS AT THE LANDINGS P.U.D. WHEREAS, Section 2-353 (4) of the Code of the City of Fort Collins authorizes the Planning and Zoning Board to vacate certain easements and rights -of -way, by resolution or by approval ofreplats containing notation of such vacation; and WHEREAS, the Owner of Building Y of the Pier Condominiums at the Landings P.U.D. has requested the vacation of a portion of a utility and access easement, more particularly described on Exhibit "A", attached hereto and incorporated herewith by this reference; and WIIEREAS, the northwest corner of said Building Y encroaches into a portion of said utility and access casement; and WHEREAS, by vacation of the portion of the utility and access easement described more particulary on Exhibit "A", the encroachment will be eliminated; and WHEREAS, all public and private utility agencies have been notified of the vacation request and report no objections. NOW, THEREFORE, be it resolved by the Planning and Zoning Board of the City of Fort Collins that the utility and access easement area more particularly described on Exhibit "A", attached hereto and incorporated herewith by this reference be and the same hereby is vacated. Passed and adopted at a regular meeting of the Planning and Zoning Board of the City of Fort Collins held this 22nd day of January, A.D. 1996. FRIITRTT A Paqe 1 of 2 °7 ORDINANCE NO. 177, 1983 OF THE COUNCIL OF THE CITY OF FORT COLLINS VACATING A PORTION OF AN ACCESS AND UTILITY EASEMENT IN THE PIER CONDOMINIUMS AT THE LANDINGS P.U.D. WHEREAS, the Council of the City of Fort Collins has been petitioned to vacate a portion of a utility and access easement located in the Amend- ment to the Pier Condominiums at the Landings P.U.D. set forth in more particular below; and WHEREAS, the Amendment to the Pier Condominiums was approved by the Planning and Zoning Board on November 21, 1983; and WHEREAS, the Amendment is for a convenience store and gas station whose gas tanks are to be located in the existing access and utility easement; and WHEREAS, no structures are allowed to be constructed in an easement; and WHEREAS, the utilities have indicated no problems with the vacation of the portion of the easement requested; and WHEREAS, the rights of the residents of the City of Fort Collins will in no way be prejudiced or injured by said vacation. NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL OF THE CITY OF FORT COLLINS that that portion of an access and utility easement located in the Amendment to the Pier Condominiums at the Landings P.U.D., set out in more particular as follows, to wit: A part of an access and utility easement situate in the Amendment to The Pier, being a replat of a portion of The Pier Condominiums at The Landings P.U.D., Fort Collins, Colorado, which begins at a point which bears N 00005'25" W 220.00 feet and again S 89056'28" E 198.00 feet and again S 00°05'25" E 189.96 feet and again S 89°56'28" E 12.41 feet and again N 00°09'30" W 7.60 feet and again N 82°53'25" E 345.64 feet and again N 41°19'13" E 19.91 feet and again N 00°15'00" W 65.32 feet and again S 89°45'00" W 10.00 feet from the South 1/4 corner of Section 36, Township 7 North, Range 69 West of the 6th P.M., and run thence S 89045'00" W 11.00 feet; thence N 00°15'00" W 7.00 feet; thence S 89045'00" W 149.00 feet; thence N 00015'00" W 22.68 feet; thence N 89°45'00" E 160.00 feet; thence S 00°15'00" E 29.68 feet to the point of beginning. be, and the same hereby is, vacated, abated and abolished.
